UN's Ouster of Inner City Press Opposed from Yemen, Burundi, NY, Nigeria, Dominica, Geneva: Quotes From Petition, Round I

UNITED NATIONS, February 25 -- After Inner City Press was summarily ejected from the UN, which it has covered for ten years, on February 19, the ostensibly deciding official Cristina Gallach told no less than Nobel Peace Prize laureate Jose Ramos Horta that Inner City Press would still be able to cover the UN.

What she didn't say was that Inner City Press' ability to cover the unfolding UN corruption scandal in which she has played a role would be curtailed under the proposed arrangement - by design. Inner City Press is opposing this.

  And so now are a range of people from around the world, who have signed a petition to immediately restore Inner City Press to the UN Resident Correspondent accreditation it had for nine years until, without any due process, the UN pass was physically torn from its chest as UN Security throw its laptop onto the sidewalk in front of the UN (also owned by the UN and immunity from US law including the First Amendment).

This is another in a long line of incidents conclusively evidencing the UN's complete and utter disrespect for the laws of its HOST country, the US, in particular the 1st amendment!! How ironic this has happened just as the US House Committe on Foreign Relations is today, on 24 Feb, holding a hearing about the gross mistreatment of whistleblowers at the UN and WIPO.  But the UN Correspondents Association, at least its 15 Executive Committee members, issued a February 22 statement in context fully supporting the throwing of Inner City Press into the street, the seizure of passport, the Banning, all of it. We wonder if these scribes' employers know about this.

  For now we reiterate the obvious: the UN Press Briefing Room is presumptively open to all press. If Spokesman Dujarric, or DPI's Gallach, wants to lend it to their friends, at least provide a notice so journalists hungry for news don't get excluded and get nothing.

 Now there are not only pro-development pieces, like here - there's also false but illustrative pices like this one, from Mococco, raised to Gallach and higher. What now?

  After BuzzFeed ran an article about the underlying (pretextual) "incident," UNCA proffered a statement, of which BuzzFeed added two lines. Inner City Press hereby publishes in full the statement of the UNCA Executive Committee, attributable to each member and their media, and a critique as annotations, in bold:

"Tuesday, Feb. 22, 2016

STATEMENT: FOR THE RECORD

On the evening of Friday, 29 January, 2016, U.N. accredited blogger Matthew Lee of Inner City Press disrupted the Annual General Meeting of the United Nations Correspondents Association (UNCA).

Mr. Lee concealed himself in an interpreter booth in the room S-237 ahead of the meeting.

FALSE: Inner City Press waved at people from the booth, which it entred both not to be disruptive and because, unlike the UN Press Briefing Room after the UN's $2 billion Capital Master Plan renovation, has electical outlets.

UNCA President Giampaolo Pioli made clear at the start of the meeting that it was a closed meeting for UNCA members only.

NOTE: Pioli has no authority to thrown any journalist out of the UN Press Briefing Room.

There are more than 200 UNCA members and the association represents almost 100 percent of the resident correspondents at United Nations headquarters. Mr. Lee is not a member of UNCA.

Note: Inner City Press quit UNCA finding it and Pioli to be corrupt; the UN allows this UNCA to set rules for other journalists, illegitimately.

Mr. Lee began videotaping the meeting without UNCA’s knowledge.

Note: it was a Periscope live-stream: perhaps this technology is not in "UNCA's knowledge."

Once he was discovered doing so there was justified concern over his presence

Note: Why? Because UNCA took money from indicted Frank Lorenzo and Ng Lap Seng's South South News, and openly discusses selling UN office space?

 and UNCA respectfully asked Mr. Lee to leave, but he refused.

Note: did "respectfully" include Pioli and another UNCA insider quoted in BuzzFeed calling Inner City Press mentally ill? Is that "civil" as Ms Gallach says is required? Will Pioli lose his office?

UNCA contacted the U.N. Department of Safety and Security, the Media Accreditation Liaison Unit (MALU) and the Office of the Spokesperson for the Secretary-General.

UNCA suspended the meeting. U.N. Secretary-General spokesman Stephane Dujarric, deputy U.N. spokesman Farhan Haq, acting MALU chief Tal Mekel, a U.N. Security officer and journalists implored Mr. Lee to leave.

Note: Inner City Press said clearly, if and when UN DSS says it's a closed meeting, it would leave. Which it did.

After much resistance, Mr. Lee finally agreed. The UNCA meeting had been disrupted for more than 30 minutes. Despite being told it was a closed meeting, Mr. Lee still posted the video on his blog.

Note: this is dinosaur talk: Inner City Press has already live-streamed on Periscope. And the "video" UNCA members from Voice of America and AFP filmed -- wasn't it a closed meeting? -- was give to the authorities. This is UNCA: working for the Man. FUNCA livestreams for the people. Which is journalism in 2016?

UNCA stands for press freedom and vehemently defends rights of journalists at the UN and around the world. UNCA is committed to journalism ethics and expects journalists to act professionally."

B.S. -- UNCA under Pioli has tried again to get Inner City Press thorwn out for its acts of journalism.

So, all members are responsible. We'll have more on this.

  When on February 19 Inner City Press was being told it had to leave the UN on two hours notice, UN Security told it darkly they had “seen the video” of January 29 in the UN Press Briefing Room.

Inner City Press assumed that meant UN Security video, and asked in an article why a supposedly “closed” meeting would be filmed.

Then when BuzzFeed ran an article about the UN's ouster of Inner City Press, unnamed UNCA scribes showed the reporter video, focusing on Inner City Press sitting in the back row (that was after Dujarric and particularly his deputy Haq tried to made being in the interpreters booth the problem, not being in a non-closed closed meeting in the UN Press Briefing Room).

 So these “journalists” -- Margaret Besheer of Voice of America and Carole Landry of AFP among them -- in fact shot video in order to turn it over to the authorities.

Is that journalism?

On February 19 when eight UN Security guards pushed Inner City Press out the gate onto First Avenue, VOA' Margaret Besheer was there waiting, along with Sherwin of SABC. How did they know to be there, then?

So beyond providing video to the authorities, do these journalists “coordinate” with the authorities?

Is this journalism? Are these journalists?

  Gallach also has not said that the complainant against Inner City Press, Giampaolo Pioli's UNCA, is also involved in the Frank Lorenzo and Ng Lap Seng scandal, as well as other financial irregularities.

  South South News of Ng and Lorenzo, both now under indictment, gave money to UNCA and Ng was given by UNCA a photo op with Ban Ki-moon.

  Gallach in her short tenure at the UN already hobhobbed with Lorenzo at his South South Awards, as reported by Inner City Press - but Gallach did not recuse herself from issuing a ruling to throw Inner City Press out of the UN.

  Gallach and this conflict of interest was not mentioned, yet, in theFebruary 22 BuzzFeed piece, here - despite being the signer of the ouster order without even having sought or allowed Inner City Press side of the story.

 That piece said the UNCA, rather than explain why it sought to get the Press thrown out, would be putting out a statement later. Well here it is: "UNCA President Giampaolo Pioli made clear at the start of the meeting that it was a closed meeting for UNCA members only."

 This is a laughable. It is not for Giampaolo Pioli, more of a landlord than a journalist, to declare any event in the UN Press Briefing Room to be "closed."

 As Inner City Press said on January 29, and before that when with Dujarric also involved Francois Hollande tried to close the UN Press Briefing Room to all but the French traveling press, the UN Press Briefing Room is presumptively open to all journalists. On January 29, there was no notice in the UN Journal of a closed meeting, nor any sign on the door.

 So essentially, Cristina Gallach is ousting Inner City Press because it didn't obey an order by Giampaolo Pioli.

  But the two are united: Pioli's UNCA took Lorenzo's and Ng's South South News' money; Gallach was with Lorenzo at the South South Awards.

  When Pioli told Inner City Press to get out of the UN Press Briefing Room, and Inner City Press on principle and to follow the UNCA - Lorenzo story refused, Gallach plotted three weeks then threw Inner City Press out of the UN.

  It is too dangerous, apparently, to have a bloggest "spewing" - the words of UNCA's Masood Haider - when the scope and implications of the Ng Lorenzo scandal are still not known. These go to the very top of the UN - thus, no one up there has held Gallach to account for an "investigation" that omitted the defendant, and for not recusing herself.

  This must all be investigated, and will be. Inner City Press should not have to accept dramatically reduced access, especially at this time. And those who tried this gambit must face new scrutiny.

  When Inner City Press came to the UN on the morning of Monday February 22, with another journalist there to sign Inner City Press in as a guest, UN Security said, “You are Banned from the UN.”  Audio here.

  Inner City Press left the UN pass office, and set up shop in the Isaiah plowshares park across from the UN. Several Permanent Representatives, at least two Under Secretaries General (the same rank as Gallach) and many staff came to express outrage at the UN's censorship.

 But in the UN Press Briefing Room, which was "lent" to the UN Correspondents (or Corruption) Association back on January 29, the reaction was different.

 In an embarrassing colloquy, long time UNCA board member Masood Haider asked Spokesman Dujarric about "the blogger Matthew Lee" who has been "spewing on the Internet reports whether false or not."Vine here; Video here; UN transcript here.

On February 19 Inner City Press asked to get its passport and most important files but was pushed out onto First Avenue by UN Security Deputy Chief Michael McNulty without either. That's not seized? That's OK?

And the extortionate offer - no access unless with much reduced rights - is entirely disproportionate to the non-existent "crimes," which was to seek to cover an event in this same UN Press Briefing Room, by UNCA which took money from indicted Ng Lap Seng's and Frank Lorenzo's South South News then gave Ng Lap Seng a photo op with Ban Ki-moon.

  UNCA President Giampaolo was there, leaving first from the February 22 Press-less press conference; another UNCA board member slapped Dujarric on the back. Great job!

  Bloggers are, of course, hacked to death in Bangladesh, a country on whose free press record USG Gallach never even replied to a detailed email from the Free UN Coalition for Access, for protection for a Bangladeshi journalist then in the UN. Spewing indeed.

 Dujarric took the opportunity to deny that the UN had seized Inner City Press' files -- the reality is, when Inner City Press asked on February 19 to take the most important of them, and its passport, it was denied by UN Security. On February 22, UN Security said Inner City Press is Banned from all UN premises.

  Dujarric said, as if it's ok, that Inner City Press is being "offered" much reduced access, for four months. But Inner City Press did nothing wrong, and the "investigation" by Gallach which led to its ouster did not involve a single conversation with or reaching out to Inner City Press.

  Any reduced access to loss of office space -- which Masood Haider, who hardly writes articles, has, and UNCA President Giampaolo Pioli has, a private office, while writing about Morgan Freeman -- is unfair and is to cast a chill of freedom of the press. No staged colloquy can hide that. We'll have more on this.

  Later, after being told to leave even the UN Pass office, a UN Under Secretary General told Inner City Press Gallach had told other USGs that Inner City Press was in fact in the building - that AFTER Inner City Press was told by UN Security, twice, that it is banned from all UN premises and was told to leave the UN Pass office.

 Ban Ki-moon's Spokesman Stephane Dujarric, who'd also told those who questioned him that Inner City Press could end and cover “his” briefing on Monday.

  False. UN Security then said, you cannot wait in the pass office, you are banned from all UN premises. Trying to cover the UN Security Council meeting on Syria from the Isaiah plowshares park across from the UN, various Ambassadors came to say they were appalled. But Gallach's office has told then, nothing will be done.

  This is disgusting censorship by an increasingly corrupt UN.

As Inner City Press at the UN pursues unfolding stories of corruption, peacekeepers committing rapes in the Central African Republic, UN inaction in Burundi, South Sudan and Yemen, on February 19 with two hours notice UN Under Secretary General Cristina Gallach ordered Inner City Press to be ousted. Letter here.

   On the evening of February 19, UN Security Deputy Chief Michael McNulty, who refused to provide his name (audio), pushed Inner City Press out onto First Avenue (audio), having cut off its Periscope video livestream (video) and not allowed it to get its files, coat or passport from its longtime shared office. Gallach wants the office back, to retaliate and so the UN Correspondents Association can, in essence, sell the UN space just as it sells access to Secretary General Ban Ki-moon.

  On February 20, Inner City Press posed four questions to Dujarric and his deputy Farhan Haq, with a copy to Gallach --which 24 hours later have not been answered or even acknowledged (while both Dujarric and Gallach were wildly spinning to those who contacted them, includingNobel Laureate Jose Ramos Horta, see here, who was told there was no problem taking over Inner City Press' office and undermining its ability to report, edit videos, conduct interviews. There is a big problem. Here are the questions:

"Please state the status and condition of all of my papers and property in my office, Room S-303A, including investigative papers, communications from sources including whistleblowers and my passport and when I will have the access to them that I was denied on February 19 and since.

Please state when the Resident Correspondent UN pass I have had for years, but which was torn off my neck on Feb 19, will be returned, in connection with 1, above, and the UNSC meeting(s) and UN Noon Briefing on Monday February 22.

Please state and explain the role of the Office of the Spokesperson of the Secretary General in the deprivations in 1 and 2, above.

Finally, for now, please state the Secretary-General's position on UN Security Deputy McNulty on February 19 threatening twice to have me “handed over to NYPD” (including the concomitant acceptance by the UN of the NYPD's jurisdiction), of UN Security officers grabbing my phone which was live-broadcasting Periscope video at the UN Security Council stakeout and turning it off.

I have other questions but these are most pressing, for immediate answer."

  And as yet, 42 hours later, no answer. Watch this site.

  While Inner City Press was writing up a UN Security Council meeting on Syria that went into the evening, and Periscope broadcasting, UN Security guards walked up, grabbed Inner City Press' laptop, blocked its Periscope camera and turned off the livestream. Video here.

  Then eight UN Security officers led by Deputy Chief McNulty tore off Inner City Press' UN ID badge and carted off Inner City Press' laptop and camera, returning these by throwing them on the sidewalk of First Avenue. Audio here.

 They did not allow Inner City Press to get coat or sweater, or the files in its office. No provision was made for this.

  The ejection letter was signed by the Under Secretary General for Public Information Cristina Galach of Spain but ultimately Secretary General Ban Ki-moon is in charge. Ban and his chief of staff Edmond Mulet and Deputy SG Jan Eliasson were all written to with details as this took place.

  USG Gallach's office, Darrin Farrant in charge, merely "took note" of questions about and criticism of the lack of due process. Gallach did not respond to email, even from Nobel Peace Prize winner Jose Ramos-Horta, here.

  When Inner City Press was thrown out onto First Avenue, standing waiting, laughing and filming, was Voice of America's Margaret Besheer and another board member of the UN Correspondents Association, whose president Giampaoli Pioli told Inner City Press if it didn't remove a (truthful) article about his screening of a war crimes denial film for a tenant of his, Sri Lanka's then ambassador Palitha Kohona, he would get Inner City Press thrown out of the UN.

  But who is running this asylum? Ban Ki-moon, his spokesman also involved Stephane Dujarric (who threw Inner City Press out of the UN Press Briefing Room on January 29, also trying to turn off ICP's Periscoping phone), and, some surmise, some who don't like Inner City Press' questions. We'll have more on this.

  The pretext was Inner City Press three weeks earlier seeking to cover a meeting in the UN Press Briefing Room by an organization which has taken money from now indicted Ng Lap Seng and Frank Lorenzo's South SOuth News, then gave Ng Lap Seng a photo op with Ban.

Goldman Sachs Only Refinanced Mortgages of Whites in NYC Area in 2014, New Data Shows, Public Hearings on GE Capital Proposal Demanded

NEW YORK, September 22 -- The lack of seriousness in US bank regulation grows from the relatively smaller to the largest banks, with Goldman Sachs the most recent example. Goldman is trying to speed through Federal Reserve approval to buy $16 billion in insured deposits from GE Capital, and the Fed so far seems bent on helping. It began by withholding basic parts of Goldman's application, click here to view.

  On September 22, 2015, the Federal Reserve belatedly released the 2014 Home Mortgage Disclosure Act data. A quick review of the lending of Goldman Sachs Bank USA in the New York City Metropolitan Statistical Area shows the Goldman Sach focus which should require publish hearings in this case. 

  Fair Finance Watch, hours after the data was released, has commented to the Federal Reserve at the highest level that "in the New York City MSA in 2014, for conventional home purchase loans (Table 4-2), Goldman Sachs Bank USA made 45 such loans to whites, only two to African Americans and only one to a Latino. For refinance loans (Table 4-3), Goldman Sachs Bank USA made 16 loans to whites and NONE to African American or Latinos. This is inconsistent with the demographics of the New York City MSA and with other lenders' records; it further militate for the timely requested public hearings."

  Goldman Sachs has purported to respond to the comments of Inner City Press / Fair Finance Watch by releasing a small amount of the withheld information, and arguing that what the wider Goldman Sachs does cannot or will no be considered by the Federal Reserve on this Bank Merger Act application by Goldman Sachs Bank. We've put Goldman Sachs' response online, here. It says:

“FFW states that the audio released by examiner Ms. Carmen Segara requires an extension of the comment period and a public hearing... GS Bank believes the issue is outside the scope of the statutory factors for Board consideration under the Bank Merger Act... Goldman Sachs Bank USA ('GS Bank') hereby submits its response to the three comment letters, submitted on September 2, September 3 and September 9, 2015 (the 'Comment Letters'), by the Inner City Press's Fair Finance Watch ('FFW')....

"FFW makes accusations of 'predatory practices' in the 'mortgage field' and 'municipal finance,' and states that there are a number of compliance settlements that must be reviewed in connection with the Application. FFW references several articles related to lawsuits, settlements and other events, all but one of which involve Goldman Sachs but not GS Bank. GS Bank respectfully submits that such comments are not substantiated by specific arguments or facts. GS Bank notes that none of the articles relate to GS Bank itself, and believes these issues are outside the scope of the statutory factors for Board consideration under the Bank Merger Act.”

  Goldman Sachs is arguing that the acts of a parent company cannot be considered when its bank applies to buy ($16 billion) in insured deposits, an absurd argument. FFW has submitted another comment to the Fed, including that 

"ICP has received by mail from Goldman Sachs' counsel a purported response which claims that issues ranging from conflict of interest and under-regulation by the FRB (evidenced for example by the audio leaked by whistleblower Carmen Segarra) is not cognizable under the Bank Merger Act - an absurd argument. The FRB would be the decision maker, therefore such issues must be addressed.

 "Goldman Sachs cavalierly states that since it withdrew some of its indefensible requests for confidential treatment of its application, that issues is resolved. It is not - too much is still being withheld. Significantly, Goldman Sachs has offered no explanation of the specious requests for confidential treatment it made, denying commenters access to information during the comment period. As others now argue, the comment period would be extended and hearing held."

  Inner City Press will be covering this wider National (Community Reinvestment Coalition) protest, in which it joins; it has also submitted more comments to the New York State regulator, in a proceeding currently slated to come to a head on September 28, the first day of the UN General Assembly debate.

Goldman Sachs' Response to Inner City Press / Fair Finance Watch Comments on GE Capital Application, Sept 1... by Matthew Russell Lee

 As Inner City Press exposed last month, Royal Bank of Canada jumped the gun and began doing business with City National Bank without any Federal Reserve approval (see Los Angeles Times, here.)

 Now, even as New York regulators says their comment period on Goldman Sachs' GE Capital proposal extends at least through September 28, Goldman has published fine print notices in the New York Post and a newspaper in Utah saying the Federal Reserve will stop listening on September 19.

  Really? After the Fed made Goldman Sachs a bank holding company with no public comment period at all, so Goldman could get a bail-out? After the Fed's coziness with Goldman Sachs was again demonstrated, by the audio taped by then-Fed examiner Carmen Segarra?

  Inner City Press immediately submitted a Freedom of Information Act request for all of Goldman Sachs' GE Capital application and related records. The Federal Reserve has provided a heavily redacted copy, on which Inner City Press / Fair Finance Watch has commented to the FRB in Washington:

"Among many other things, Goldman Sachs believes it can withhold the volume of deposits it seeks to acquire from GE Capital Bank, WHAT is seeks to acquire (and what not to acquire) from GE Capital Bank, its number of employees in Utah, the contact people on its application, the number of non profit organizations it tells the FRB it serves on the board of -- presumptively public -- and even the NAMES of the exhibits it seeks to withhold entirely. This is abusive and unprecedented and the FRB must, in response, have the comment period begin again. Otherwise, applicants only benefit by making absurd and abusive requests for confidential treatment. There is much more to be said, including at the public hearings ICP is requesting, but it is imperative that the Board act on this as quickly as possible."

  When Goldman Sachs became a bank holding company literally overnight in 2008, Inner City Press / Fair Finance Watch and others including NCRC asked the Fed how this was done with no public comment period at all. 

  The answer, it seems, is to be found in the audio leaked by Carmen Segarra of the Federal Reserve, showing further Fed favors for Goldman Sachs.

 With this history, and Goldman's history in predatory lending with Litton Servicing and as an underwriter, see Occupy Wall Street video here, and UN / migration connection here, it seems clear that the Fed must hold public hearings on Goldman Sachs' GE Capital application, when it is filed. 

  But with the Federal Reserve, you can never be too sure, or too careful.

  When Community Bank System of upstate New York filed with the Fed nine answers to questions asked after Inner City Press' challenge, it tried to withhold fully eight of the nine responses. More here.

  Inner City Press immediately filed a Freedom of Information Act request for the whole submission - and even the Federal Reserve saw through Community Bank System's absurdly -- and tellingly -- overbroad withholding, releasing all but one part of one of the eight withheld responses. But since then, all the Fed has done is seek a mere antitrust control commitment.

Background: The largest bank merger recently proposed, that of Royal Bank of Canada and affluent-focused Los Angeles-based City National Bank, has since April been the subject of a Community Reinvestment Act challenge by Fair Finance Watch.

  The LA Times has reported on the "letter from the Fed [which] asks the banks to respond to questions raised in written comments by [FFW]. Spokesmen for the banks declined to comment.... Fair Finance Watch, a New York advocacy group for minorities, questioned a deal between the banks in a June 11 comment letter to the Fed."

  Inner City Press first put that Fed letter online, here; then Canada's National / Financial Post reported without credit it had "obtained" it. 

  By contrast, in the pending proposal of Community Bank System - Oneida, the Syracuse Post-Standard disclosedthat "Inner City Press forwarded the letter to news outlets. Some of the Fed's questions focus on whether Community could improperly control matters at Oneida in advance of the acquisition. Community is working on Fed's questions, said Hal Wentworth, Community's senior vice president for retail banking."

  One common theme is that non-control (and therefore antitrust) laws are being violated. One difference is that Community Bank System does comment to the media -- if only to blame the messenger -- while larger RBC and CNB do not. Arrogance?

 On Community Bank System's blaming the messenger, FFW has commented to the Fed that it will "will comment again when Community Bank System I has provided a copy of its response to the FRS' questions of July 13. Beyond the CRA and impermissible “control” questions raised therein, we wish at this time to raise the issues that, in a public response to ICP's comments, Community Bank System's SVP for retail banking said the following, in a prepared statement no less:

'In a statement today, Hal Wentworth, Community's senior vice president for retail banking, said that Inner City Press is not a local group and pointed out that letter was the only one filed on the Oneida deal. "This activist does not do business with either Oneida or Community Bank."'

If it would be inappropriate for Community Bank System to comment on or disclose information about its customers, in this context the same applies to the above-quoted, which, separately, is reminiscent of human rights abusing countries emphasizing where the rights groups who study and report on them are based."

   Now Community Bank System is trying to withhold eight of its nine responses; Inner City Press is challenging this under the Freedom of Information Act, comparing Community Bank System's outrageous withholding at the Fed with other banks, and with Community Bank System's to the OCC, more here.

   

Amid Legionnaire's Disease, UN Tells Inner City Press It Is Exempt From NY Laws, Drains Fountain

UNITED NATIONS, August 13 -- Amid the spread of  Legionnaire's Disease in New York, beginning from the South Bronx, Inner City Press on August 12 asked seven questions on how the United Nations, which refused to accept responsibility or to reform after bringing cholera to Haiti, is responding.

  On August 13, Pressed, UN spokesman Stephane Dujarric asserted that the UN is "exempt" from all local rules concerning cooling towers and legionella. Transcriptbelow. It is reminiscent of the UN bringing cholera into Haiti.

  Inner City Press, which has covered the UN's role in cholera in Haiti, impunity and South Bronx, had the following questions for the UN on August 12 - but UN Spokesman Stephane Dujarric did not allow them to be asked at the August 12 briefing, cutting the questions off and promises a "responsive" statement, see below. First, here are the questions Inner City Press submitted in writing to the UN:

1.  Has the Secretary General, Ban Ki-moon, directed that his staff be accountable for monitoring & testing UN facilities for the bacteria that causes legionnaires disease?

2.  Does the UN have cooling towers in any of its NYC facilities (to include rented properties outside the HQ complex)?

3.  In the past month, has any testing been done of UN cooling towers, and if so, on what dates, by whom?

4.  Has any host government authority asked the UN if it can enter UNHQ to test the UN's cooling towers for legionella?

5.  Does the UN consider itself exempt (or immune) from the new joint NY State/NYC regulations?

6.  If requested, would the UN allow host government authorities to enter the UNHQ to test for legionella?

7.  If the UN has tested its facilities for legionella bacteria, will it (yes or no) make test reports public by posting them online?

  Here is the full text of the UN's (first) response, from its spokesman:

"Matthew,  As per your question

Cooling Towers.

The cooling towers have biocide chemical supplies. We circulate the water twice weekly to keep it moving and to let the water draw more biocides as necessary from the system. We have HVAC technicians on staff who are certified on these systems and with these chemicals.

Main Fountain and Staff Memorial Pool

Normally we drain and clean these monthly. But we have increased the frequency because of the legionnaires outbreak. Last weekend we drained and refilled the main fountain. It will be drained again this coming weekend to allow CMP to perform work which is scheduled to take a week. That work will include the installation of UV lights that will treat the water. We will maintain increased frequency of draining cleaning and replacing during this period of heightened concern.

The water feature in this is out of service since the faulty installation failed and leaked some months back causing damage to office space below. It is still drained and not in service.

We have no other standing water features or systems."

  But is the UN claiming immunity from local health regulations? 

On August 13 Inner City Press asked Dujarric again:

Inner City Press: I wanted to ask you about Legionnaire’s disease, which is obviously becoming, at least in New York City treating it quite seriously, and they’ve required all buildings with cooling towers to register and to be tested.  Now, I got your response yesterday, but I wrote back to you to ask, is — one, is the UN registering with the city pursuant to this order?  Two, have the towers… you said something about bio something.  How…

Spokesman:  Let me…

Question:  Please.

Spokesman:  Let me tell you and, I think, those, after all, we’re all residents of New York City, so I think everybody has an interest in this.  The cooling towers that the UN has have biocide chemical supplies, which is a chemical substance which can deter, render harmless, or exert a controlling effect on any harmful organism by chemical or biological means.  We circulate the water twice a week to keep it moving and let the water draw more biocides as necessary from the system.  We have technicians on staff.  We’re certified for these systems and with these chemicals.  So that’s one way we keep the cooling towers safe.  I am aware that there are regulations, I think, in front of the New York City Council requiring registration and inspection.  As you all know, we do not fall under the jurisdiction of the New York City Department of Buildings or the municipal jurisdiction, and we’re not required to register our cooling towers.  However, we do have an arrangement in place with both the Department of Buildings and the FDNY, and we invite them… we invite them into the building, as well as other inspectors, as appropriate.  They give us opinions and make recommendations, but we’re not subject to their jurisdiction.  I think the important thing is that we do reach out to them.  We make every effort to abide by the high standards to keep the staff safe, the delegates safe, even the press safe, and all the visitors that come through the building.

Question:  Right.  But I guess… I understand that.  This commissioner’s order, whether you view yourself as subject to it or not, it requires… it requires all buildings in New York to be, to be consistent with industry standards and it lists the American Society of—

Spokesman:  What I’m—

[inaudible]

Spokesman:  What I’m saying to you is that the technicians we have on staff are certified to the highest standards.  Obviously, we want to keep everybody safe, and we will invite the Department of Buildings and the FDNY as the FDNY sometimes come into our building at our invitation to make sure everybody is safe.

Question:  But are they going to comply with the standards…

Spokesman:  I think — I’ve used a lot of words.  We are… We will go to the highest possible standards, and we will work at our invitation with the Department of Buildings and the FDNY.  And I will continue to take deep breath and breathe the air in this building.

 So, by the end of August 13, among the UNanswered questions:

Has the UN tested for legionella already? (seems not)

Will they test by August 20th?

If they do finally test, will they release the results, to NYC and to the public?

 We'll see.

  After bringing cholera to Haiti, the UN has refused to help the families of those killed by the cholera. Now the UN belatedly has a rule to get reimbursed by Troop Contributing Countries if it vaccinates their soldiers (hereat Para 61) - but still no compensation for the victims.

  In the legal appeal pending in the US Second Circuit Court of Appeals, the UN on July 14 was informed of its "Notice of Appearance Default," and told if it doesn't respond in 14 days it will not be heard at oral arguments except by the permission of the Court. 

 Inner City Press on July 14 asked UN Spokesman Stephane Dujarric:

Inner City Press: on Haiti, there's been a notice of them staring at now, sent to the Office of the Secretary-General about the Second Circuit appeal of the cholera case and it basically says… it's called a notice of appearance default notice, that if there's no response by the UN within 14 days, they can't be heard at the oral argument.  Are you aware of this?  And is it your intention to…?

Spokesman:  I'm not aware… I'm not aware of it.

  Last week, Dujarric told Inner City Press that the UN would respond to a letter urging it to take responsibility for bringing cholera to Haiti. But Dujarric did not say what the UN's response will be. We'll have more on this.

 Back on July 7 Inner City Press asked  Dujarric:

Inner City Press: Two very quick questions.  One has to do with contingent on equipment and this new guidance that's put out by the Secretariat about vaccinations noted by PassBlue.  They've noted that, and I'm looking at it now, that the UN now tells countries to vaccinate their peacekeepers if they come from a high-risk area, and if they don't vaccinate, the UN will do it and charge them.  Can you say, this seems to be a response to what occurred in Haiti?  And what would you say to those who say, if you're going to get into the UN receiving compensation for vaccinating peacekeepers, what about compensation for people that were made sick by the previous failure to have this policy?

Spokesman Dujarric:  Well, I don't think we're getting compensation for vaccinating peacekeepers.  I think what's important is that we keep improving our policies to keep people safe.

Inner City Press:  Right, but the sentence says, "The UN will deduct any expenses for vaccinations"…

Spokesman Dujarric:  That's not compensation.  That's just covering of costs.

Inner City Press:  Right.  It seems like a small amount of money, so…

Spokesman Dujarric:  Right, but… I… I… we agree to disagree.

  Meanwhile outgoing UN envoy on cholera Medrano did an "interview" with the UN's own UN News Centrewithout mentioning that the UN brought the disease to Haiti; the UN on July 6 "reported" about cholera without mentioning Haiti, here.

When UN Peacekeepers are determined, by the UN itself, to have killed three civilians in Mali by using excessive force, what accountability is there?  None - and UN Peacekeeping chief Herve Ladsous on April 2 refused to answer questions about his own responsibility. Video here.Vine here.  

 On June 23, Inner City Press asked Mali's foreign minister to confirm that the UN is going to pay compensation to the families of those its peacekeepers killed in Gao. He told Inner City Press to "ask the UN."

  And so Inner City Press did ask, at the June 23 noon briefing:

Inner City Press: This is something that the Malian Foreign Minister said to ask you.  So, I want to say that in advance before asking you.  And it has to do with whether… I asked him whether the UN is in fact going to pay monetary compensation to civilians that were killed by peacekeepers in Gao in that report that was issued some time ago.  And he said:  You should ask the UN.  So, I'm asking you.  Is the…

Spokesman:  Okay.  I will… let me check on what we'd announced at the time, and I'll get back to you.  [He later added that a compensation fund had been set up by the Department of Field Support.]

 The bracketed material, Dujarric's Office added to the transcript, after emailing Inner City Press this:

"Regarding your question on compensation for casualties in Gao, Mali, we would like to recall that a compensation fund has been set up by the Department of Field Support."

  Inner City Press has been told - NOT by the Spokesperson's Office -- that the UN is calculating how much to pay each family in Mali. But why has the UN paid NOTHING to the families of those killed by the cholera the UN brought to Haiti? Inner City Press asked the UN's Mali envoy Mongi Hamdi, who gamely tried to distinguish the two cases, focusing on the UN exonerating itself in Haiti. We'll have more on this.

  On June 11, the day after an attack against Malian military posts in the south of the country that killed one soldier and injured two, MINUSMA issued a statement which the Free UN Coalition for Access translates here:

  “MINUSMA firmly condemns the cowardly terrorist attack  against posts of the Malian military and security forces in Misseni / Kadiolo, in the south of Mali. The attack early on the morning of June 10 killed one soldier and injured two, as well as causing physical damage. MINUSMA offers its condolence to the Government and Armed Forces of Mali as well as to the soldier's family. The Mission wishes a fast recovery for the two wounded soldiers. MINUSMA again underlines the urgency of advancing the peace process to ensure that the Government and the stakeholders can combine their efforts and act in unity to put an end to the terrorism which threatens Mali and its people.”

  That the attack happened in southern and not northern Mali may be a bad omen.

After his May 16 press conference in Bamako, Ladsoussaid the UN's report about its killings in Gao will never be released; follow up question here. During the press conference, tellingly, Ladsous berated Malians for not sufficiently thanking... France and its Force Serval. Audio here, Minute 27:52.  

  Ladsous said, referring to criticism of him and his mission by Mali's president and others at the signing ceremony the day before, "Did I hear a single word of thanks for France and its Operation Serval? No." (Translation by Free UN Coalition for Access.)

   In this use of his UN post to serve France, for which he was a (most undiplomatic) diplomat for decades, this is similar to Ladsous' much worse intervention into the process of the UN Office of High Commissioner for Human Rights in trying to get fired OHCHR whistleblower Anders Kompass, who exposed reports of French Sangaris Force soldiers raping children.

  This appears in the UN Dispute Tribunal rulingreinstating Kompass, at Paragraph 9. It was not contested by OHCHR.  Ladsous, breaking with his striking refusal to answer Press questions, told Inner City Press, "I deny that." Video here.

 But Ladsous has not explained or answered what he is denying: getting involved in l'affaire Kompass at all, or just the wording? Ladsous was not asked this question in Bamako. 

 On May 18, Inner City Press asked the UN's deputy spokesperson Farhan Haq who Ladsous was speaking for:

Inner City Press: Mr. [Hervé] Ladsous of DPKO held a press conference in Bamako over the weekend.  There was some criticism, by actually the President of Mali, of the mission.  But, I wanted to ask specifically, in his press conference, he said that he sort of chided, he said:  Was there even a word of thanks for its operation in Sangaris?  No.  Isn't that curious?  And I wanted to know, in what capacity was he saying that?  Is the UN?  Does the UN have a position on Malians not being sufficiently grateful to France or was he speaking in some other capacity?

Deputy Spokesman:  I don't have any real comment.  I would just refer you to the text of his statements.  And if you have anything further, you can ask our colleagues in peacekeeping.

  Later on May 18, a well placed African Permanent Representative said "Ladsous should resign."

 On May 10, two UN Peacekeepers were wounded in Mopti in Mali, see below.

 Now Ladsous is under fire for appearing in a UN Dispute Tribunal ruling as urging the firing of the whistleblower who exposed rapes by French soldiers in the Central African Republic. Ladsous denied it - to Inner City Press - but the Office of the High Commissioner for Human Rights did not dispute it. Accountability?

 On May 10 "around 1 pm, the forces of MINUSMA on patrols hit a mine or an improvised explosive device 25 kilometers from Tenenkou, in the region of Mopti,” MISUMSA said in a statement.

  “Two blue helmets were seriously injured by the explosion and their evacuation to the MINUSMA hospital in Timbuktu was underway, MINUSMA said.

   “The head of MINUSMA Mongi Hamdi strongly the attack against the peacekeepers and emphasized that MINUSMA remains more determined than ever to implement its mandate in support of Mali and its people.”

 On May 8, the UN announced what the Press already knew, that Mbaranga Gasarabwe, a Rwandan national, is moving from the Department of Safety and Security in New York to become Hamdi's deputy in Mali. We wish her well.

 Back on April 27 the MINUSMA mission issued a statement that the Platforme group attacked the town of Manaka, loosely translated by Inner City Press below. But how does UN Peacekeeping killing civilians, then its boss refusing to answer or even take questions about it, impact the UN's credibility?

 Here is our loose translation of the MINUSMA press release of April 27:

SRSG Mongi Hamdi called for the armed groups to immediately cease hostilities and return to their positions. “This resurgence of tension puts in jeopardy all efforts to restore durable peace in Mali,” Hamdi said. MINUSMA said that on Monday near noon the mission learned of an attack launched by the MAA-Platform and GATIA groups on the town of Menaka, held by elements of the Coordination of Movement of Azawad (CMA). MINUSMA said it deployed helicopters to evaluate the situation.

Hamdi went to Nouakchott on April 26 to meet the representatives of the CMA, who reaffirmed their adherence to the peace process under way, and confirmed their intention to initial the agreement.

“Two months of intense negotiations involving all of the parties with a view to put an end to the Malian crisis could be threatened. These actions are a grave violation of the ceasefire accords reiterated in the declaration of February 19, 2105,” Hamdi said in his statement.

Hamdi also cited the UN Security Council's statement of February 6 which threatened the imposition of targeted sanctions on anyone who returned to hostilities and violated the ceasefire.

“I therefore appeal for calm and reason for the benefit of all Malians. The only solution to this crisis is through the route of dialogue. I remain convinced that all the parties will show wisdom and reason and sign this historic peace agreement,” Hamdi said.

Inner City Press: on Darfur, I saw the clarification put out by UNAMID [African Union-United Nations Hybrid Operation in Darfur], but the Government of Sudan is saying that the UNAMID peacekeepers killed seven civilians, and I wonder, what… beyond just UNAMID putting out a press release, some of which in the past have been press releases that the UN has ultimately walked away from, is there an intention to do the type of report that was done in Mali when people were killed or in Haiti when people… when people were shot at?

Deputy Spokesman Frahan haq:  On that, I actually expect that we will have a statement from the Spokesman for the Secretary-General responding to the latest events in Darfur.  So, I'll wait until… until we get that.

Inner City Press:  But, is the protocol if a Member State alleges that UN peacekeepers have killed civilians to do such a report, or is there no such protocol?

Deputy Spokesman:  Like I said… first of all, I… as you know, you're aware of the press release from UNAMID, which is their clarification of the situation, and then beyond that, we do expect to have a statement attributable to the Spokesperson.

  But when the statement came it did not even mention the government's allegations. Khartoum's credibility may be low - but what about Ladsous'? We'll have more on this.
