Man From Ecuador Who Entered US in 2023 Filed Habeas Now Order for Bond Hearing Next

SDNY COURTHOUSE, July 13 รข€“ A man from Ecuador in ICE detention in 26 Federal Plaza in lower Manhattan filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

  The petition says he was "forced to flee his native country due to violence" and entered the US through Mexico on November 29, 2023. He was detained on July 3, placed in 26 Fed, and filed the petition through his next friend, the pastor of his church.

 The case was assigned to Judge Lewis J. Liman.

Judge Liman held a hearing on July 13, and Inner City Press live tweeted it:

Judge: Does the petitioner call himself Mr. Bravo or Mr. Moscoso? Petitioner: Moscoso. Judge: Do you have a lawyer? Petitioner: Yes, at NAULA in Queens. Judge: Do you have a name or telephone number there? Petitioner: I do not have my phone

 Judge: What's the government's position? AUSA: That he is subject to detention but is entitled to a bond hearing. You could order the immigration court to hold one. It's complicated because ICE informed us that this is under 1225(b)(2)(a). We disagree

Judge: What if I order the hearing, and no automatic stay? AUSA: I'm looking.. I'm sorry, I'm thinking Judge: You may do so, obviously AUSA: If you order a hearing under 1226(a), I believe ICE will comply with it Judge: I'll ask the Jackson Height lawyer if he can

Petitioner: I preach the good word to young people who are lost, I pray for the sick AUSA: Your Honor, I apologize for this

Judge: I don't need your apology but for your institution to understand that it is doing. Mr. Moscoso you have 2 weeks to respond

The case is Bravo v. Francis, et al., 1:26-cv-5687 (Liman)
