On Fentanyl Death in Bronx Daycare Grei Mendez Pled Guilty Now Gets 45 Years

by Matthew Russell Lee

SDNY COURTHOUSE, March 3 – Following the death of a one-year old baby by fentanyl, on September 19, 2023 the US Attorney for the Southern District of New York charged Grei Mendez and Carlisto Acevedo Brito.

On September 25, with no notice and Inner City Press initially the only person in the courtroom gallery, the third man was brought in: Renny Antonio Parra Paredes. Inner City Press live tweeted, thread

On January 23, Paredes' lawyer argued, and lost, before the assigned District Judge Jed S. Rakoff: "Minute Entry for proceedings held before Judge Jed S. Rakoff: Oral Argument as to Felix Herrera Garcia, Grei Mendez, Carlisto Acevedo Brito, Renny Antonio Parra Paredes held on 1/23/2024. The trial date is adjourned to 6/10/2024

On February 12, Inner City Press went to a possible change of counsel hearing on lead defendant Felix Herrera Garcia - but soon Judge Rakoff asked everyone but Herrera Garcia and his still counsel to leave the courtroom, "even my favorite reporter."

On June 10, the day of jury selection on Herrera Garcia, his trial was canceled; he pled guilty.

On June 13, Judge Rakoff issued a blistering order chiding Federal Defenders and the US Attorney's Office, and recommending that CJA counsel henceforth be available on Saturdays: "OPINION as to Grei Mendez: While the Court is extremely disappointed with the conduct of the Federal Defenders and the Government in this case, it also recognizes the role that this District's standing policy of not requiring CJA counsel to be on call on Saturdays had in precipitating the events of September 23, 2023. If this District, instead, had a standing policy that provided for CJA counsel to at least be on call on Saturdays, this entire situation would never have occurred. Accordingly, the Court has recommended to the relevant committee of this Court that it revise this policy so as to ensure that indigent defendants always have immediate access to conflict-free counsel and permanently prevent the misconduct that occurred here from happening again in the future. (Signed by Judge Jed S. Rakoff on 6/13/2024)."

Back on March 21, Grei Mendez was brought into the Magistrates Court to be arraigned on a superseding indictment. Inner City Press was there, thread

the Court severed Ms. Mendez from the jury trial of her co-defendant set to proceed on June 10, 2024, and a new trial will be calendared in her case."

On July 11, another guilty plea, Inner City Press was there, thread

On October 8 Grei Mendez had a pre-trial conference and Inner City Press went, thread

Inner City Press went to a 10:30 am proceeding on October 29. Grei Mendez cried as she said, I have four kids myself, I never meant for this to happen. She pled guilty.

Her sentencing was set for March 3 at 2 pm. She remains detained.

On December 26 Judge Rakoff granted an undocketed request for delay the PSR, but not sentencing: "This Court is scheduled to sentence Ms. Mendez on March 3, 2025, and no change in the sentencing date is necessitated by the amendment of the schedule for disclosure of the Presentence Report. (Signed by Judge Jed S. Rakoff on 12/26/2024)."

On January 3, 2025, before sentencing, Grei Mendez hired - retained - new counsel: "Minute Entry for proceedings held before Judge Jed S. Rakoff: Status Conference as to Grei Mendez held on 1/3/2025.. Present were the defendant and her past counsel, new counsel Paul King and the CJA Attorney on duty this date. The Court relieves the defendant's past counsel. The defendant is continued to be remanded."

On February 24 a mitigation report for Grei Mendez was submitted, concluding "we respectfully recommend that the Court consider a minimum sentence."

On March 3, Grei Mendez was sentenced to 45 years in prison.

Denmark Takes Over UNSC No Reply to Press on Ban by Guterres Nor Ukraine or Greenland

by Matthew Russell Lee, Patreon Book Substack

UN GATE, March 3 – Denmark took over the UN Security Council presidency on March 1, 2025 - while Inner City Press is still banned from the UN, despite its June 19 application.

Back on February - and before that, in January - Inner City Press wrote to Denmark's Mission to the UN, nycmis@um.dk and andnyg@um.dk: "This is a timely request that you allow Inner City Press to enter the UN and cover, and/or provide the WebEx  pass code(s) to access Denmark's UNSC Presidency press briefing by Denmark's Ambassador Lassen on March 3, 2025 at 1 pm. I have questions to ask on what you will do this month about Gaza, UNRWA and Rwanda, DRC, Greenland, Sudan, Ukraine, DRC and Rwanda, about the SDNY indictment involving Turkey's Mission to the UN as well as the coups in Gabon and Niger and the conflicts in Ukraine, Ethiopia, Cameroon, Yemen and Libya -  and on ongoing cases of sexual abuse and exploitation by UN peacekeepers, and Missions' abuses in NYC, on many of which Inner City Press first reported - including its current scoops on Colombia, DRC, Libya and Somalia. And most recently South Sudan and UNECA.

Please note that Inner City Press and I participate in the WebEx briefings of, for example, the IMF: March 31, 2022 and since with new IMF spokesperson Sept 28, 2023:

The Denmark Mission to the UN has not answered - we will stay on this.

 Watch this site.

Inner City Press on June 19, 2024 again applied to the UN for access, as it gives 100s, to cover the UNGA week. Inner City Press has a NYC Press Pass and writes about the UN. From Denmark and its UN Mission, nothing.

Libya UN Staff Complain to Guterres of His Corrupt Leaders from Lebanon and Egypt

by Matthew Russell Lee, Patreon Book Substack

UN GATE, March 3 – How corrupt has the UN become under Antonio Guterres? Today's example is again from the UNSMIL mission in Libya, sent to Inner City Press which Guterres and his Melissa Fleming ban from entering the UN to ask, while Spox Stephane Dujarric refuses written questions. Now we are asking about these letters to Guterres, leaked to us by a whistleblower:

Dear Matthew Russell Lee, This is the usual situation in UNSMIL for National Staff. If we protest for our rights, Internationals fire us but they don't do the same with corrupt Staff like our former CMS Huda, her boyfriend Louay and the rest of their gang. For them very long disciplinary actions despite proven evidence and promotions without any test or just fake job openings. OIOS and OHRM are doing nothing to them. The findings are always put in the trash. CDU in the Mission is even doing less because they have Lebanese friend and Senior protection  in UNSMIL. It is so absurd our situation that none of us believe in the UN anymore. You should know what is going on. Thanks a lot from us

The beginning, first of a series:

SG and SRSG,  This is the second time in UNSMIL that a National Staff  Union representative has been fired with pretexts because he wanted to improve our life as Libyans in UNSMIL.  We wanted to share with you and your Team in HQ, the attached appeal of our  former National Colleague and Brother  Wajdi, fired in 48 hours for claimed lack of performance. Many years in UNSMIL and no negative performance till he became a target and subject of retaliations being an active NSU Staff member.  Every time a NS tries to improve the working and living situation at UNSMIL is immediately out of job. Especially if he is serving in the National Staff Union.

Previously our National Colleague Ramadan in NSU  was also fired because we wanted to reestablish our rights. It is not a coincidence. False accusations were built against him  with the support of International Staff from Lebanon and Egypt and got  dismissed. They are not friends of our Country and they are not friendly with us.

Despite this, their brotherhood is renowned in UNSMIL and continuously growing.  For corrupted, rotten International Staff nothing is done. As per the below mail from Wajdi, former CMS, Ms. Huda Hannina D1  is still on special leave with full pay despite a positive OIOS investigation  for fraud and abuse of authority, plus two fact findings positives for abuse of power and authority on us

More to follow - watch this site.

That's today's UN under Guterres: pure hypocrisy...We will have more on this - the UN bans the Press and refuses to answer questions

In UN Scandals Exposed by Inner City Press Animal Cruelty UNMISS to UNSOS Corruption

by Matthew Russell Lee, Patreon Book Substack

UN GATE, March 2 – How corrupt is today's UN under Antonio Guterres? The follow up below is again on his mission in South Sudan, UNMISS, about which his spokespeople Stephane Dujarric and Melissa Fleming refuse all Press questions. Inner City Press has asked them, and others, about the newest sex abuse case against the UN there. Now this, from a UN whistleblower sent to Inner City Press:

Dear Mr. Matthew Russell Lee:

The United Nations Mission in South Sudan (UNMISS) has been implicated in the frequent and inhumane killing of cats and dogs within its compound, as depicted in distressing images...

Now this:

Dear Mr. Lee:      Referring to your post on animals in South Sudan.  Almost all field missions and offices have an animal control problem of some nature and each pretty well has a solution, although the solutions are widely different.  Perhaps the opposite to UNMIS is UNSOS.  UNSOS has in place a humane solution for the caring of feral animals.  The mission has established feeding points, there is a trap, neuter and release program in place, all backed up by veterinary care.  Many lower level staff adopt feral cats as pets and bring them into their accommodations. Hats off.

While no one could accuse UNSOS of being unkind to animals, they can be considered unkind to member states money.  Over time the programs that UNSOS has put in place have costed the member states far too many millions.  Not because this is the value of the needed service, but because this is another contract payoff to local business interest, and something which under Director Q is common place.

When the SG announced funding cuts, its largely due to the payoffs and mismanagement across the system that has gotten the UN in this position. Staff who are affected by spending reductions need to look no further than their leadership to understand why.   It can be expected that these leaders will jump ship before things catch up to them

Guterres, they say, should resign or lose immunity - and end censorship. Watch this site.

In South Sudan UN Stole Radio Station Now Ordered Out of Airport Land as D2 Spreads Lies

by Matthew Russell Lee, Patreon Book Substack

UN GATE, March 2 – How corrupt is today's UN under Antonio Guterres? Today's follow up is yet again on his mission in South Sudan, UNMISS, about which his spokespeople Stephane Dujarric and Melissa Fleming refuse all Press questions. Inner City Press has asked them, and others, about the newest sex abuse case against the UN there. Now this, from a UN whistleblower sent to Inner City Press:

Dear Mr. Matthew Russell Lee:

The recent statement by the Government of South Sudan calling for UNMISS to evacuate its compound near Juba Airport is deeply concerning - it is said the UN lied and kept Radio Mireya after independence, and now acts as a ugly guest.

This incident highlights a significant oversight by the Chief of Staff, Leda Limann, in managing relations with the host government. Instead of prioritizing essential diplomatic efforts, Ms. Limann appears more focused on advancing her own career from D-2 to DSRSG, thereby jeopardizing the mission’s objectives and welfare of the staff. Furthermore, Ms. Limann has been known to undermine capable staff supporting the SRSG through intimidation and attacks, reflecting her lack of diplomatic background and necessary job experience. Her preference for spreading baseless rumors about Benjamin Bol Mei, who is married to the president's daughter, is particularly concerning. These rumors, which falsely accuse Mr. Mei of threatening to shut down UNMISS and confiscate its land, could seriously damage relations with South Sudan.

It is alleged that Ms. Limann has even suggested that donors impose sanctions against Mr. Mei, portraying him as a threat to the UN and various NGOs.  This behavior is risky, and the Government of South Sudan could declare persona non grata (PNG) status against her, similar to actions previously taken by the Somali government against the current SRSG in UNMISS. It seems possible UNMISS may close without achieving its mandate like Mali and Congo

Guterres, they say, should resign or lose immunity - and end censorship. Watch this site.

Handler For Day Care Fraud Got 58 Months Menachem Lieberman Delay So Rangott Too

By Matthew Russell Lee, Patreon

SDNY COURTHOUSE, Feb 28 – Isidore Handler, Martin Handler, Menachem Lieberman, Harold Schwartz and Ben Werczberger were indicted and then presented on January 11 before U.S. District Court for the Southern District of New York Magistrate Judge Robert W. Lehrburger.

Inner City Press was there, the only media in the Mag Court. There was an argument about the defendants phones being searched, see below.

The charges include wire fraud, theft of government funds, aggravated identity theft and money laundering.

On August 31, a change of plea (to guilty) hearing was docketed: "ORDER as to Isidore Handler: The Court has been informed that Defendant Isidore Handler may wish to enter a change of plea."

He did, and on February 16, 2024 Isidore Handler asked for a non-custodial sentence.

On March 7, it emerged that the lead defendant is to plead guilty: "ORDER as to (23-Cr-00004-1) Martin Handler. The Court has been informed that Defendant Martin Handler may wish to enter a change of plea. Accordingly, on Tuesday, March 12, 2024 at 10:15 a.m., a plea proceeding will take place... (Signed by Judge Jennifer H. Rearden on 3/7/2023)."

This was pushed back to March 15 at 10:30 am. Inner City Press went, see

Ok - now at guilty plea of Martin Handler.

AUSA: He needs to be arraigned on the S-2 indictment first.

The plea deal is to tax evasion.

Handler: ... On counts 5 and 7, from for profit day care NY Early Learning Co., I misapplied more than $5000...On the superseding information, I claimed charitable deductions for funds that weren't given until later. I am sorry.

Then they went back to the S-2 indictment...

Jump cut after much litigation to October 2, 2024, when Martin Handler was sentenced in a full courtroom. Inner City Press was there, thread

now at sentencing of Martin Handler in NYC day care fraud case. His daughter is sobbing and asking for leniency for him.

AUSA: This case is not about technical violations - this is about greed, not need. He chased financial gain. He put his loved ones in the crosshairs of the criminal justice system, as you saw in the Rangott trial [which Inner City Press also covered]

Martin Handler: It is years since my arrest. I want to apologize to the Head Start program at large. I don't want to waste your time Your Honor as I apologize to my family. My mother says it was not my fault but it was. I have lost so much.

Judge: I will take a break before imposing sentence..

Back in packed courtroom. Judge: I sentence Martin Handler to 58 months.

Then a schedule to brief bail pending appeal...

On January 15, 2025, the sentencing of Menachem Lieberman which had been scheduled for January 17 was adjourned "sine die" - without a new date - for a Fatico hearing on issues including "whether the 2019 religious contract between Martin Handler and Mr. Lieberman intended to convey an ownership interest in Project Social Care to Mr. Lieberman" -- "The sentencing hearing scheduled for January 17, 2025 at 10:00 a.m. is adjourned sine die. By January 17, 2025, the pa1ties shall file a joint letter informing the Court of the anticipated length of the Fatico hearing and the witnesses the parties intend to call. (Signed by Judge Jennifer H. Rearden on 1/15/2025)

On February 28, counsel to Arie Rangott wrote it to push back his sentencing, so as to incorporate "facts and argument" from Menachem Lieberman's March 13 Fatico hearing. Judge Rearden has held open May 1 at 11:45 am.

Back on July 22, with Arie Rangott on trial, Judge Rearden addressed his request to cross examination CW-1 about a divorce proceeding more than ten years ago, and a night the witness spent in the jail. Judge Rearden denied the request, or to put it another way, precluded that cross. She asked the sealed filings highlight in the copy to Chambers what is being withheld from the public. In this case, the US Attorney's Office's filings, too, have a many redactions.

On July 23, the prosecutors played for the jury voice notes between Rangott and Isidore Handler, about installing Chelsea in the financial position previously held by Sarah, and showing Head Start paperwork to back it up. And so it proceeds.

On July 24 it emerged that Chelsea will be the US' next witness, after Peralta. There is a pending motion for a defense witness.

On July 25 Chelsea was on the stand, in person - not as she was initially interviewed, by Zoom. In the docket, we can now report, Rangott has raised the Supreme Court's decision in Fischer v US about 18 USC 1512...  Inner City Press remains on the case.

On July 29, cooperator Schwartz was on the stand, describing how he was CEO in name only, and that he knew that it was wrong. Isidore Handler's photo was shown to the jurors...

On July 30, Sara Newman was on the stand, looking at herself being quoted from a meeting she said never, in fact, occurred...

At the end of the trial day on July 31, the jury charge was debated, from a question of multiple conspiracies (with Second Circuit case law cited) to Ragott opposing a "conscious avoidance" jury instruction - or in the alternative, wanting it emphasized the good faith would be an absolute defense.

On August 2, Arie Rangott was found guilty by the jury on all three counts. Sentencing set for 12/10/2024 at 11:30 AM before Judge Jennifer H. Rearden

On August 27 for Ben Werczberger, counsel wrote in asking for time served when he is sentenced on September 10 at 11:30 am.

Inner City Press went on September 10, into a full courtroom, from the thread:

Werczberger: I'm a family man. I have caused heartache. I am sorry.

Judge: The US requests time served, 6 months home detention. You made false statement to a bank. I sentence you to time served, 3 months home detention, 100 hours community service

The indictment, while ordered unsealed on January 11, was still not in PACER - in its place were two copies of the order to unseal. Inner City Press has obtained and published it on its DocumentCloud, here.

Docketed on April 15, another co-defendant now intends to plead guilty: "ORDER as to Ben Werczberger. The Court has been informed that Defendant Ben Werczberger may wish to enter a change of plea. Accordingly, on April 18, 2024 at 2:15 p.m., a plea proceeding will take place (Signed by Judge Jennifer H. Rearden."

Summary: They are charged with participating in schemes to steal millions of dollars from government-funded childcare programs for low-income families, including by stealing proceeds from a fake after-school program that received millions in funding and by using funds to purchase private real estate, items at auction, and a luxury vehicle.

The defendants were ordered released on bond on January 11.

There was an argument about phones seized from the defendants. Defense counsel wanted to litigate before any search warrant can be obtained. But Assistant US Attorney Daniel Wolf said the issue wasn't ripe, that they could move to suppress later.

Judge Lehrburger recommended that defense counsel write a letter to the assigned District Judge Jennifer H. Rearden.

On January 18, they did, arguing that "the government has not set forth the basis for the agents' belief that - at the time of the seizure - they had probable cause to believe that these specific phones contained evidence of criminality." And some phones, they say, were not in plain view. Motion on Patreon here

On January 19, Judge Rearden held the arraignment, and moved on to trial date. Inner City Press thread here, more on Patreon here

On March 14, 2023, the US Attorney's Office docketed redacted letters as to Martin Handler and Martin Lieberman, asserting their lawyers have conflicts of interest - that could be waived - with the blacked out material said to "address ongoing non-public matters before the grand jury."

On March 16, Judge Rearden ordered: "ORDER as to Martin Handler, Menachem Lieberman. Defendant Martin Handler, his counsel, and the Government shall appear for a Curcio Hearing on March 22, 2023 at 11:00 a.m. Defendant Menachem Lieberman, his counsel, and the Government shall appear for a Curcio Hearing on March 22, 2023 at 2:00 p.m." Inner City Press asked in its March 16 story, Can they hold a Curcio hearing which does not disclose the conflicts?

Almost, is the answer. Inner City Press attended and covered both Curcio hearings on March 22. The 11 am, or Menachem Lieberman, when smoothly: he waived the conflict. But at 2 pm, Martin Handler's lawyer contested several of the questions - and then argued that the Court cannot order her client to speak to another lawyer. Judge Rearden asked for a letter by 5 pm on March 23 before she issues an order.

At the end, the AUSA asked to redact the transcript, as the name of one of the companies was said. Inner City Press heard it and wrote it down, but is voluntarily not reporting it here.

On the afternoon of March 23, Handler proposed his own Curcio counsel, citing Supreme Court precedent on a defendant's right "to choose who will represent him."

On March 23, the US Attorney's Office responded that the Court should question the counsel Handler has proposed. Then it separately reported on cellphones, some of which it has still been unable to decrypt or extract.

On March 30, Judge Rearden ordered: "ORDER as to Martin Handler: Martin Handler's application to retain Stacey Richman as independent Curcio counsel, ECF No. 74, is GRANTED. Mr. Handler, his counsel, his independent counsel, and the Government shall appear ... on April 11, 2023 at 10:30 am to continue the March 22, 2023 Curcio hearing."

Inner City Press was there. Midway through the more than an hour hearing, Handler said he couldn't or wouldn't waive the right to cross examine employees of the two entities. His lawyer added that is not what in her understanding the law or ethics requires - only that information gained in the previous representation cannot be used. It emerged that both entities in the last 24 hours provided waivers. But the AUSA sought and got a question on that these waivers are not necessarily forever. After all this, a knowing acceptance of the (possible) conflict was found, and the case proceeds.

On April 18, all defendants and their counsel were before Judge Rearden. The defense requested a trial date in mid May 2024 but Judge Rearden said that was too far off. One has a conflict in EDNY in March; Judge Rearden asked for emailed about other dates in the first     quarter of 2024.

Inner City Press will continue to cover this case.

The case is USA v. Handler, et al., 1:23-cr-4 (Rearden)
