Man from Peru in US Since 2023 Is Detained by ICE So Files Habeas and Gets Stay of Removal

SDNY COURTHOUSE, June 22 รข€“A man from Peru who has been in the US since 2023 has been detained by ICE at 26 Federal Plaza.

He filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

  The petition says he "fled Peru to seek asylum in the US and has lived in the US since October 28, 2023."

    The case has been assigned to Judge J. Paul Oetken, who has issued an order barring removal or transfer and directing the Government to file a letter with answers in two days.

The case is A.J.C. v. Genalo, et al., 1:26-cv-5234 (Oetken)
