man was brought by US Marshals
into the U.S. District Court
for the Southern District of
New York Magistrates Court on
June 24 on an alleged
violation of supervised
release. Inner City Press was
there, and live tweeted: Judge: Time of
arrest? AUSA: 6:40 am
this morning. Judge: I have
before me a warrant, the
charge is that you filed to
report to the Probation
Department within 72 hours of
release. Judge: Do you
wish for me to schedule an
identity hearing? Federal
Defender: No. Judge:
Does the District Judge in
Puerto Rico set the
preliminary hearing date?
AUSA: A control date AUSA: We seek
detention on risk of flight
and danger to the community
groups. They have the burden.
On flight risk, this was not a
foot fault. He has been on the
lam for nearly two years. He
was convicted of hostage
taken, pretending to be
police, got 288 months Judge: When was
this? AUSA: More than
twenty years ago. Federal Defender:
He is not a danger. He was
taken into immigration custody
and transferred by an agent
who told him he was doing to
be deported. Then disappeared.
So he didn't know. He believed
he was free He was released,
with an ankle monitor. The case is USA v. Encarnacion-Montero, 1:26-mj-2485 (Wang)
