after Maria Hernandez was
murdered in her Upper West
Side apartment, Lashawn Mackey
was on trial before NYS
Justice Felicia Mennin in February. After a mistrial,
he is again on trial in May,
see below. On February 17
the building resident who gave
her Ring camera footage to the
police was on the stand. Inner
City Press was there, live
tweeting: ADA: After reviewing
your Ring camera footage, what
did you do? Witness: I spoke
with my super Oscar Sanchez
ADA: How long has he been the
super there? Witness: 20 years
ADA: Did you give
the Ring footage to law
enforcement? Witness:
Yes. ADA: Does
building management keep a
copy of the key to your
apartment? Witness: No. Witness: Yes.
ADA: Had you seen a memo about
the super going on leave in
May 2022? Witness: Yes, a
memo, in elevator and door Cross: Defense lawyer
Jessica Horani: On January 18,
2023, you spoke with your
neighbor Samantha - but she's
not in the Ring footage?
Witness: She is not.
Horani: Do you know her last
name? Witness: No. Horani: Age
- old, young? Witness: She was
young Horani: What level of
Ring account did you have?
Witness: Normal. Horani: How
long would they keep the
footage for you? Witness: I
don't know. Horani: You
emailed the footage to the
police on Jan 19? Witness:
Yes. Horani: What did you
send? Witness: 5 clips
Lengthy
sidebar(s) A week later on
February 24, Horani was
cross-examining the decedent's
sister, Mrs. Guerrero - not an
enviable task. At the end
Horani seemed to imply that
Mrs. Guerrero had taken some
benefits from the prosecutors'
office. But what? Therapy? A
list of phone numbers to call
to seek housing when the rent
on West 83rd Street went up? Judge Mennin
called for a sidebar, at which
she audibly said, One at a
time! But it has
come to two - trials, that is.
After a mistrial, on May 4 the
same witness - Erika Chen of
the NYPD lab - talking about
the rope, the same voir dire
by the defense lawyer, who won
the mistrial. Will it be
