Man Pled to Running 68 Guns to NYC from Georgia Got 57 Months Now Time Served Bid

SDNY COURTHOUSE, May 8 - In the U.S. District Court for the Southern District of New York on May 25, 2022 a detention or release proceeding was held by Magistrate Judge Robert W. Lehrburger on a man arrested and charged with trafficking 68 guns from Georgia to New York.

  Judge Lehrburger ordered the defendant released on $150,000 bond. The order of release is on Patreon here. Assistant US Attorney Matthew J. King said his Office may or may not seek to appeal.

   Ronald Rogers was arrested and his iCloud searched. It contained photos of guns that the prosecutors said were up for sale. His wife Anauncia Rogers, who the AUSA said has made domestic violence allegations in Georgia, was listed as the purchaser of 47 of the guns. The prosecutors consented to her release in Georgia.
 
   Rogers' assigned Federal Defender Ian Marcus Amelkin pointed to that release, and to the Second Amendment right to have firearms. He said, "You can't punish your way to gun control."

  Judge Lehrburger, after a break, agreed. He characterized the domestic violence as mutual. He surmised that Rogers sold guns to support his three children, and said that while on release he can continue working for Door Dash while hoping a more stationary job comes through. Rogers has previously worked for FedEx and for Carter's, a children's clothing business. He and his wife - and mother - live in Griffin, Georgia.

  Travel will be restricted to the Northern and Middle Districts of Georgia, and SDNY for purposes of court appearances. He may stay with one of his two sisters in New York, who it was said work as a nurse and for a metropolitan credit union, respectively.

  In the courtroom gallery, where Inner City Press was the only media, were two of the defendant's relatives, including an uncle who crossed himself when Judge Lehrburger ordered release.

Jump cut to June 30, when Ronald Rogers and Anauncia Rogers were to appear together to be arraigned before District Judge Jesse M. Furman, in the courthouse he is using to preside over the Joshua Schulte alleged CIA leaks trial. Inner City Press covered it.

  Ronald Rogers appeared with a Federal Defender and pleaded not guilty. But Anaucia Rogers' Marshals-paid flight from Atlanta was late. Judge Furman said she might have to arraigned in the Magistrates court.

Inner City Press went there, covered another case - but they had not heard that Anaucia Rogers would be coming. Ultimately she was arraigned before Judge Furman and pleaded not guilty. Both were to appear on November.

The trial date was set: "Pretrial Conference as to Ronald Rogers and Anauncia Rogers held on 11/16/2022. Defendants present (on bail) ... Trial is scheduled for 7/31/2023 and is estimated to late one week. Time is excluded in the interests of justice from 11/16/2022 until 7/31/2023."

On May 25, Judge Furman docketed that Ronald Rogers - but not Anauncia Rogers? - intends to plead guilty: "SCHEDULING ORDER as to Ronald Rogers. The Court has been advised that the Defendant may want to enter a change of plea. Accordingly, the parties shall appear for a conference with the Court on June 29, 2023 at 2:30 p.m. in Courtroom 1105 of the Thurgood Marshall Courthouse, 40 Centre Street, New York, New York. In accordance with Section 7(B) of the Court's Individual Rules and Practices for Criminal Cases, defense counsel should, in advance of the proceeding, review with the Defendant if necessary, with the assistance of an interpreter any Pimentel letter or plea agreement. Additionally, the Defendant should be prepared to give narrative allocutions that incorporate all of the elements of the offense(s) to which the Defendant is pleading guilty. In the interest of clarity and efficiency, the Court encourages counsel to assist the Defendant in writing an allocution that can be read in open court during the plea proceeding (Signed by Judge Jesse M. Then on June 16 with nothing else in the docket Judge Furman ordered this: "SCHEDULING ORDER as to Ronald Rogers and Anauncia Rogers: Trial in this case is scheduled for July 31, 2023 at 9:30 a.m. It is hereby ORDERED that any proposed voir dire, proposed jury instructions, and proposed verdict forms, as well as any motions in limine or trial memoranda, shall be filed by noon on July 19, 2023. Any opposition to a motion in limine or trial memorandum shall be filed by 5:00 p.m. on July 24, 2023... It is further ORDERED that the parties appear for a final pretrial conference on July 26, 2023, at 10:00 a.m. in Courtroom 1105 of the Thurgood Marshall Courthouse, 40 Centre Street, New York, New York 10007. The final pretrial conference must be attended by the attorney who will serve as principal trial counsel.  (Signed by Judge Jesse M. Furman on 6/16/2023)."

On June 21, Ronald Rogers' Federal Defender asked to end home detention or in the alternative for permission "for Mr. Rogers to celebrate his birthday at an indoor skydiving facility in the SDNY on Saturday, July 24, 2023."

On June 23, Judge Furman granted the application as unopposed: "MEMO ENDORSEMENT as to Ronald Rogers on [45] LETTER MOTION requesting Modification of Bail Conditions: Application GRANTED as unopposed. See ECF No. 46. The Clerk of Court is directed to terminate ECF No. 45. SO ORDERED. (Signed by Judge Jesse M. Furman on 6/23/2023)."

On June 29, Rogers pled guilty: "Change of Plea Hearing as to Ronald Rogers held on 6/29/2023. Defendant present (on bail) with attorney Ian Howard Marcus Amelkin. AUSA Matthew King present. Court reporter present. -- Defendant sworn in. Defendant withdraws previously entered not guilty plea and enters a plea of GUILTY to Counts 1 and 2 of the Indictment. PSR ordered. Sentencing is scheduled for 10/12/2023 at 10:00 AM."

Anauncia Rogers, described in the case as his wife and also as making domestic violence charges, may or may not plead: "ORDER denying [49] LETTER MOTION Seeking an Adjournment of Pretrial Submission Deadline as to Anauncia Rogers (2). July 26th is the final pretrial conference. The Court appreciates counsel's confidence that a change of plea will occur on that date, but if it does not then trial will begin the following Monday, July 31st. To be prepared for the possibility of trial, the Court needs the pretrial materials. Accordingly, while the Court will grant a courtesy extension to Friday, July 21st, the request for an extension beyond that, let alone until after the final pretrial conference, is DENIED. To the extent that results in make-work given a change of plea, the parties have no one to blame but themselves as the trial date in this case has been set since November 2022 - more than eight months ago - and there was plenty of time to negotiate a disposition before the eleventh hour. On July 20, Anauncia Rogers, flown to New York on the public dime, appeared before Judge Furman and pled guilty. Her sentencing is set for December 20 at 3 pm.

On September 29, Ronald Rogers noting his new wife and business in New York asked for a sentence of a year and a day.

On October 6 the SDNY prosecutors wrote in asking for 71 months, the top of the guideline, quoting his messages about profiting from revenge after shootings.

When sentenced on October 12 (docketed on October 13), Ronald Rogers got 57 months.

Jump cut to May 8, 2026 when counsel to Anauncia Rogers wrote in asking for time served on May 13.
