Murders Has SDNY Trial in Sep US
Wants 3500 Delay

COURTHOUSE,
May 8 - A man who was charged
in The Bronx with two 2021
murder and then found not
guilty in a less than two week
trial there now faces a
Federal trial for the same
murders, starting on September
14. On April 28 U.S.
District Court for the
Southern District of New York
Senior Judge Colleen McMahon
held a conference. Inner City
Press was there. The US
Attorney's Office on April 21
wrote in that the Acting
Attorney General, Todd
Blanche, directed that the
death penalty not be sought.
Still, there is learned
counsel on the
case. The AUSA, who has
said he is on two other
death-eligible cases in SDNY,
asked that the 3500 material
be attorneys-eyes-only until a
week before trial. He said the
witnesses live where the
defendant does - or did. He is
now in detention, awaiting
trial. On May 8 the US
Attorney's Office wrote in
asking Judge McMahon to
reconsider her order they
produce 3500 material by
August 21, arguing politely
that she does not have the
authority, and that "the
Government's witnesses did not
testify at the state trial,"
that safety is implicated. The case is USA v. Savage, 1:25-cr-472 (McMahon)
