Man From Ecuador Who Pled Guilty to Sexual Misconduct Detained by ICE so Hearing May 6

SDNY COURTHOUSE, May 5 รข€“A man from Ecuador now in ICE detention in Orange County Correctional Facility filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

  The petition says while he pled guilty to sexual misconduct in May 2022 and is "SORA Level 1, the lowest risk of re-offense."

   Then on March 22, 2026 he was charged with offenses under the NY Vehicle and Traffic Law. On April 21 at a probation appointment he was detained by ICE.

  In response to his habeas corpus petition, Judge Arun Subramanian has ordered that he be produced in court on May 6 along with a government witness "who they contend made the individualized determination to detain (and not just arrest) the petitioner."

The case is A.P.A. v. Arteta, 1:26-cv-3394 (Subramanian)
