Substack FEDERAL
COURT,
May 6 â
Capital One Auto Finance was
sued in 2024 in the U.S.
District Court for the Western
District of Pennsylvania. Amid
a dispute about the timing of
discovery production, Capital
One moved for sanctions.
The
plaintiff's responded by
submitting medical records and
more. The motion to seal,
found by Inner City Press
which beyond its unsealing in
SDNY, 100 Centre Street and
the Second Circuit it looking
further out, states: "Exhibits I and J
relate to an ongoing criminal
proceeding arising from the
violent assault committed
against Plaintiff and contain
sensitive victim-impact
information, medical injury
descriptions, safety concerns,
and personally sensitive
information concerning
Plaintiffâs participation in
the criminal matter, as
follows: a.) Exhibit I: Court
Subpoena, February 4, 2026 b.)
Exhibit J: Victim Impact
Statement, February 4,
2026." There was
an order on the motion on May
6. In free CourtListener, it
is mentioned without any link.
But even in for-pay PACER, the
order is not there. The case is Pope v. Capital One Auto Finance, et al., 2:24-cv-845 (W.D.P.A.)
