detained him after his arrest
for allegedly selling
counterfeit bags filed a
habeas corpus petition in the
U.S. District Court for the
Southern District of New York,
where Inner City Press found
it. The
petition says he is seeking
asylum "because he faces
persecution and serious hard
if returned to his home
country," which is not named
in the petition. A
petition, filed by his next
friend, was assigned to Judge
J. Paul Oetken. He scheduled a
telephonic status conference
for August 20. Diagne v.
