Man from Mexico Detained by ICE with Traumatic Brain Injury Ordered Free in SDNY

SDNY COURTHOUSE, May 29 รข€“ A 39-year-old man from Mexico who has lived in the US for 20 years - and has a traumatic brain injury - has been detained by ICE in the Orange County Jail since late 2025.

He filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

 On May 29 SDNY Judge J. Paul Oetken held a hearing, which Inner City Press covered. Petitioner's lawyers referred to several other SDNY cases, most by their Westlaw citations for some reason. 

  The AUSA said there was no right to a pre-deprivation hearing. Judge Oetken disagreed and ordered release.  

The case is C.A.R. v. Genalo, et al., 1:26-cv-4275 (Oetken)
