EPA Is Sued By 5 Atlantic States Over Neighbor Pollution SDNY Judge Koeltl Wants Answers

SDNY COURTHOUSE, Juy 14 – Five mid-Atlantic states sued the EPA earlier this year under the Clean Air Act.
 On July 14 U.S. District Court for the Southern District of New York Judge John G. Koeltl held an oral argument. Inner City Press covered it.  
 At issue is the good neighbor provision and principle, and pollution from Illinois, Indiana, Michigan, Ohio, Pennsylvania, Virginia and West Virginia, referred to in the Complaint as the "Upwind States."  
 The EPA cited the Cross-State Air Pollution Rule Update, and a 2019 case about Wisconsin from the D.C. Circuit.
Judge Koeltl had a number of questions, which he has asked be answered by July 20.
The case is State of New Jersey et al v. Wheeler et al., 20-cv-01425 (Koeltl)
