As UNSG Guterres Bans Inner City Press 21+ Days His Alison Smale Says It was Uncivil While Assaulted At Budget Cttee

By Matthew Russell Lee, Video Petition Q&A 2d, Q&A2

UNITED NATIONS, July 24 – Two weeks after banningInner City Press from entering the United Nations, which has closely and critically covered for a decade, UN Under Secretary General Alison Smale for the first time deigned to explain in writing her basis for the ban, or suspension of privileges.
She wrote: “On two recent occasions, Mr. Lee violated th[e] Media Guidelines by attempting to access United Nations premises beyond the scope of his non-resident correspondent status and by confrontations with United Nations Security and Safety officials. While you have characterized these confrontations as being unprovoked, the relevant facts do not support that characterization. Furthermore, according to the above-mentioned Media Guidelines:

'Where unexpected circumstances arise, the approach will be to avoid confrontation, maintain civility and find the fastest, safest and most secure acceptable solution. Those Correspondents who violate the ground rules governing access, including the abovementioned standards of ethical behavior may have their accreditation withdrawn or suspended by the United Nations.'
As a result of Mr. Lee's recent actions in violation of the Media Guidelines and his unacceptable comportment when dealing with United Nations Security and Safety officials, Mr. Lee's privileges of access to the premises of the United Nations as a non-resident correspondent have been suspended. These privileges of access will remain suspended pending a review of this matter to determine what further action, if any, should be be taken with respect to such privileges.”
With the ban on Inner City Press now hitting three weeks, and Smale having left on a three week vacation, there is much to be said about her reasons. First, in other of the two occasions, Inner City Press was within the Guidelines, which state that “Non-Resident Correspondents can access UNHQ through the Visitors’ Entrance at 46th Street and 1st Avenue between 0800-1900 hours from Monday through Friday. Non-resident Correspondents only have access to UNHQ on weekends or after hours accompanied by a resident correspondent or when a meeting is advised as taking place. Entry will be allowed two hours prior to the start of the meeting. At the conclusion of the meeting, the non-Resident correspondent must exit the premises within an hour, unless accompanied by a resident correspondent.”
On June 22 Inner City Press was pushed out of the UN by UN Lieutenant Ronald E. Dobbins, irregularities in whose promotion Inner City Press has reported on in a previous years, based on a UN Security e-email leaked to it, through the General Assembly lobby in which it was covering an event, listened in Smale's Department's Media Alert, which featured a speech by Secretary General Antonio Guterres. Dobbins called in four Emergency Response Unit officers who refused to give their names when Inner City Press asked.
On July 3 - after Inner City Press has complained in writing to Guterres about its improper ouster on June 22 including Dobbins' animus and the ERU officers' refusals to give their names - Dobbins and other still unnamed officer assaulted Inner City Press as it was covering a UN Budget Committee meeting, announced or advised to it by the UN Spokesman for the President of the General Assembly. The meeting concerned Guterres' $6.7 billion budget and proposed moving of UN jobs from New York to Mexico City, Uganda to Kenya and Geneva to Budapest. Inner City Press' reporter's laptop was smashed into his backpack, damaging it. His shirt was torn and his arm was pulled, then twisted.
Most ghoulishly, Smale's July 19 explanation to the Government Accountability Project claims that if a person being thus assaulted by UN Security speaks up, saying loudly “I am a journalist!” they are being uncivil, justifying a suspension of entry for three weeks and counting.
The “review” that Smale cites has included in these three weeks, as to Inner City Press, a single one hour interrogation on July 10 in a basement room across from the UN by UN Security officers Raughn Perry and Valentin Stancu. Perry asked questions, only about the July 3 ouster and refused to include in his write-up Inner City Press allegation of retaliatory animus by UN Lieutenant Dobbins or that Inner City Press had informedGuterres (and Smale) of it on June 25 before the July 3, making each of them partially responsible.
In the two weeks since that “interview” by UN Security, nothing, and not only Smale but also Guterres has gone on vacation, with his Spokesman now three times refusing to answer Inner City Press' written questions as to where, and how much the public is paying.
Background: Inner City Press on July 5 was banned from entering the UN, the day after it filed a criminal complaint against UN Security Lieutenant Ronald Dobbins and another for physically removing it from covering the July 3 meeting about the UN's $6.7 billion peacekeeping budget, as witnessed and essentially cheered on by senior UN and British official Christian Saunders, tearing its reporter's shirt, painfully and intentionally twisting his arm and slamming shut and damaging his laptop. Secretary General Antonio Guterres' deputy spokesman Farhan Haq told Fox News that the ban of Inner City Press is pending a “full review of the incident," which by July 9 Haq was calling an altercation - except only UN Security used force, before even talking. On July 12, The Independent (UK) via its US bureau chief Andrew Buncombe, covered the ongoing ban, reporting that "Stephane Dujarric, a spokesman for UN Secretary-General António Guterres, said it was 'ridiculous' to suggest Mr Lee had been treated as he had because UN officials were upset with his coverage.  He said many correspondents published stories that were embarrassing to the world body. He said a review had been launched into the manner in which Mr Lee had been removed and his future accreditation." But for the two weeks and counting that Inner City Press has been banned from the UN by Guterres, his chief of Communications Alison Smale has not answered the e-mails or 5000+ petition of Inner City Press; the "investigation" seems either a cover up or an attempt to keep Inner City Press out for as long as possible, even forever. Now Smale, Guterres' chief of staff Maria Luiza Viotti and at least three members of the US Congress have been written to, on July 17, by the DC-based whistleblower protection organization the Government Accountability Project. Here is the letter, on which we will have more: "July 17, 2018

Alison Smale, Under Secretary General for Global Communications
United Nations, New York, New York 10017

Dear Ms. Smale:
The Government Accountability Project (GAP) is concerned about the United Nations’ actions related to Matthew Russell Lee, a journalist and blogger for Inner City Press. As you are aware, Inner City Press has been accredited to cover the UN by the predecessor department to your office, the Department of Public Information, since 2006. For twelve years, Mr. Lee has covered UN operations diligently, informing the English-speaking public via internet about budget decisions, General Assembly resolutions, audit reports, and research findings, among other things. Mr. Lee has also covered
important stories that affect the public interest in a global sense. Among his articles are stories about human rights abuse, peacekeeping, criminal misconduct, and the treatment of children in conflict zones.
GAP was therefore baffled to learn that the United Nations Secretariat has now banned Mr. Lee from its
New York premises. We have been unable to find any reference to regulations allegedly violated by Mr.
Lee. On the contrary, we see only evidence of unprovoked harassment. For example, in 2016, the
Secretariat evicted Mr. Lee from his resident correspondent’s office with insufficient time to prepare for the move. At the time, he was trying to cover an event in the UN Press Briefing Room, convened by a
group that had accepted funds from Ng Lap Seng, who was subsequently convicted of bribery and sentenced to a four-year prison term by a US court. Twice in the past thirty days, Mr. Lee has been expelled from the UN’s New York Headquarters as he tried to cover newsworthy events there.
The UN Media Accreditation and Liaison Unit Guidelines for ‘Non-Resident Correspondents’ state, at
Paragraph 2a, that:
Non-Resident Correspondents can access UNHQ through the Visitors’ Entrance at 46th Street and 1st Avenue between 0800-1900 hours from Monday through Friday. Non-resident Correspondents only have access to UNHQ on weekends or after hours accompanied by a
resident correspondent or when a meeting is advised as taking place. Entry will be allowed two hours prior to the start of the meeting. At the conclusion of the meeting, the non-Resident correspondent must exit the premises within an hour.
On June 22, Mr. Lee was covering an event, in the UN Media Alert, which featured a speech by the
Secretary General, when he was forced to leave the UN, without his laptop, in violation of the
Guidelines.

Even after Mr. Lee informed you, the Secretary General and others in a June 25 e-mail of the ouster and
what he alleges was the animus behind it, he was ousted again, more violently, on July 3 while covering
a UN Budget Committee meeting of the type he has covered for over 10 years, including the last two as
a non-resident correspondent. The existence of the meeting was advised to him by the Spokesperson of
the UN General Assembly. He was, in short, improperly forced to leave, and violently so.
Mr. Lee informs GAP that his previous messages to you, through which he sought an explanation for the
United Nations’ withdrawal of his resident (and later non-resident) correspondent’s credentials, have
gone unacknowledged and unanswered. We are therefore requesting from your office the following
information in writing:
• The regulation Mr. Lee violated that precipitated his expulsion on June 22, 2018 and again on
July 3;
• His action that warranted expulsion under the rule;
• The name of the decision maker who approved the order to expel him.
Moreover, GAP understands that Mr. Lee is temporarily banned from access to the United Nations New
York Headquarters building, pending the completion of a review. Given this, GAP also requests the
following information:
• The authority under which the review has been undertaken;
• The name(s) of the reviewer(s);
• The process anticipated for conducting the review (i.e. phases, responsible authorities and
timeline).
If there is no regulation violated, GAP requests that Mr. Lee be restored to resident correspondent
accreditation, and his (now) unused office S-303 be reassigned to him. Only that will prevent further
targeting by UN Security with animus, who have not been informed of the rules by the Media
Accreditation and Liaison Unit.
As the Under Secretary of Global Communications, GAP realizes that you are sensitive to the need for
due process when taking action against a journalist. Frequently, regimes that silence journalists and
revoke freedoms of expression ultimately come to abuse other human rights and/or tolerate corruption.
The link between human rights abuse and a lack of freedom of expression is recognized in the preamble
to the Universal Declaration of Human Rights. Similarly, Article 19 of the Declaration is explicit in its
directive to protect freedom of expression and access to information. The possibility that the United
Nations may avoid accountability by restricting access to its premises is disconcerting, and GAP would
very much appreciate responses to the questions posed above.
Very truly yours,

Matthew Russell Lee, Inner City Press"
In the first visible step of the UN's self-investigation of the July 3 assault on the Press, on July 10 Inner City Press was interviewed for more than an hour by UN Security officer Raughn Perry in a windowless basement room of the UNITAR building across from the UN on 47th Street. Perry and his partner / witness Officer Valentin Stancu refused to include in what they typed and edited either the June 22 ouster of Inner City Press by Lt Dobbins and four Emergency Response Unit officers who refused to give their names, or Inner City Press' June 25 formal notification to Guterres, his deputy and chief of staff and Global Communicator Alison Smale that Inner City Press was being targeted by Dobbins based on an investigative piece it published about scam promotions in UN Security, including Dobbins' and others'. They would not include Inner City Press allegation of retaliation or vendetta, saying it was beyond the scope of their interview. They told Inner City Press not to make any notation to this effect on the statement they printed out, complete with mis-spelling of Cameroon, that it could submit that information later. But to whom? Their boss Peter Drennan has not acknowledged any of Inner City Press' e-mails to him, even those at the suggestion of Guterres' "Victims' Advocate" Jane Connors who kindly spoke with Inner City Press outside the visitors entrance and promised to appropriately forward what Inner City Press sent her, so far without effect. On June 11, after refusing to provide Inner City Press with even a summary of what Dobbins and Saunder have said, Perry did hand Inner City Press a copy of "its" statement. It says at the top, "This is a United Nations document and may not be disclosed or used outside of the Organization without first obtaining written permission from the United Nations." It seems absurd that the UN could further retaliate against Inner City Press publishing the print out of its statement about being attacked by UN Security. But when Inner City Press wrote to Perry and USG Drennan notifying them of its intent to publish and asking their confirm receipt, there was no response. This is Guterres' UN. So Inner City Press in an abundance of caution has transformed the hard-copy of its statement handed to it by UN Officer Perry into the below, without any changes other than to fix the UN's telling mis-spelling of Cameroon:
"My name is Matthew Lee. I am a journalist attached to Inner City Press.... I would like to state that on the evening of the 03 July 2018, I remained in the "Bull Pen" press area on the fourth floor of the Secretariat Building from 07:00PM to approximately 10:00PM writing articles and waiting to check on the status of the Fifth Committee Budget meeting. I would like to state that this area is reserved for Non-Resident Correspondents to perform their duties as they are not provided with offices or cubicles. At approximately 10:00PM, I proceeded to the Viennese Cafe, located on the first basement level of the UN Conference Building, to cover the Fifth Committee Budget meeting. I was aware that the meeting was closed so I anticipated waiting in the Viennese Cafe to speak with any of the Committee members about any news regarding the budget. I recalled that Mr. Tommo Monthe, Permanent Representative of Cameroon to the United Nations, and Chairman of the Fifth Committee, approached me in the Viennese later that evening and explained the current state of the meeting/ discussions. I recorded our conversation on my mobile phone.
After Mr. Monthe and I ended our conversation, I proceeded to the dining area of the Viennses Cafe where I sat down to transcribe what Mr. Monthe had shared with me. Less than five minutes after sitting down, I observed two UN Security Officers approaching me. I recognized one of the Officers as Lieutenant Dobbins; I did not know the other Officer. Lieutenant Dobbins immediately said to me that I had to leave the building, while he (Lieutenant Dobbins) grabbed my computer from the table and put it in my backpack. The Officer I did not know approached me and grabbed at my chest. I did not know if that officer was attempting to reach for my UN grounds pass (which was hanging foom around my neck) but he grabbed the shirt I was wearing and he ripped it, creating two holes. That Officer then released my shirt and then grabbed my right forearm and begun twisting it and pulling me towards the front of the cafe towards the garage. I observed that Mr. Christian Saunders was in the vicinity. I called out to him and asked him if he could intervene. Mr. Saunders came over to where the Officers and I were and told me, "If the Officers are asking you to leave, then you should leave." I told Mr. Saunders that there is a Media Accreditation Liaison Unit rule that allows me to remain in the building beyond 07:00PM if there is a meeting to be covered and one hour after the meeting. The Officers then continued to physically pull me by my arms towards the UN garage. I then asked Mr. Saunders to accompany me as the Officers escorted me; to which he did. Mr. Saunders accompanied me as both Lieutenant Dobbins and the other unknown Officer escorted out of the UN premises via the 43rd Street and 1st Avenue exit. There was no other physical altercation through the UN garage or at the exit to the UN compound.
Matthew Lee
This statement was recorded by me at UNHQ on Tuesday 10 July, 2018 at 1100 hours, at room GA-1B-052.
Raughn Perry
Witnessed by: Valentin Stancu"
Even with the material Perry and Stancu refused to include - while including the wrong room number for the "recording" of the statement which took place in a windowless basement room of the UNITAR building which is not the GA or General Assembly, it is amazing that the UN's response to this is to ban Inner City Press from entering the UN for nine days about counting, including so it misses and cannot ask questions at Guterres' rare July 12 press conference. We'll have more on this. On July 11 at noon, Guterres' lead spokesman Stephane Dujarric was asked about Inner City Press by a sunny correspondent, UN transcript here: Question:  Thank you.  Can you update us on the status of the usual occupant of this chair?

Spokesman:  The usual occupant of this chair?

Question:  Of this chair.

Spokesman:  His… there was an incident, I think, last week or a bit… I'm starting to get lost in the weeks.  His status is being reviewed.  And I know… my understanding is that he will be having discussions with various parts of this administration, and then we'll keep you updated, and I'm sure he will keep you updated.

Question:  And is he currently suspended?  Is he barred entry to this…

Spokesman:  Yes.  His credentials and pass have been suspended, pending review." What review? UN Security investigating itself, and covering up for Guterres who was informed of Lt Dobbins' vendetta on June 25 and did nothing? Officer Perry declined to or could not explain what the process or timing is going forward, or who unilaterally banned Inner City Press pending and apparently during this "investigation." He said to ask MALU and DPI - but DPI's Alison Smale has refused to answer or acknowledge a single one of Inner City Press' seven emails. We'll have more on this.

Ban Urged To Reverse “Crude & Heavy-Handed” Order To Evict Inner City Press from UN

By Matthew Russell Lee
UNITED NATIONS, April 6 -- Days after the UN threw Inner City Press out onto First Avenue on February 19, the free speech and whistleblower protection organization Government Accountability Project (GAP) from Washington D.C. wrote to the US Mission to the UN urging the Mission to work to get Inner City Press restored. It is UNclear what if anything was done.
On April 5, the day before the eviction deadline set still without providing any specifics on the alleged violation nor any opportunity to be heard or to appeal, despite a petition with over 1,280 signatures, GAP wrote a second letter, PDF here, directly to Secretary General Ban Ki-moon. It speaks for itself:
5 April 2016
Secretary General Ban Ki-moon
United Nations Secretariat
New York, New York 10017
Dear Mr Secretary General:
On behalf of the Government Accountability Project (GAP), a free-speech and whistleblower protection advocacy organization in Washington D.C., I want to object to the treatment accorded to Matthew Lee of Inner City Press by the United Nations. The decision to expel Mr. Lee from the UN Secretariat and to exclude him from the access needed by a journalist to cover the Organization comprehensively is capricious and targeted. No rule breaking has been cited, nor has any process or established procedure been invoked to explain the action to be taken.
If such a process exists, or if Mr. Lee violated a UN protocol or regulation, whether knowingly or unknowingly, for which he is to be expelled, would you please inform us at GAP or him?
As you know, Article 19 of the Universal Declaration of Human Rights reads:
“Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.”
The Declaration is a fundamental document for much of the work of the United Nations and forms a baseline for interpretation of international law around the world. The Secretariat's crude high-handed treatment of Mr. Lee is tantamount to a repudiation of Article 19 on the premises of the very Organization entrusted by the international community to defend freedom of expression.
I respectfully request that you take action to reverse the decision that will soon result in Mr. Lee's expulsion from his office and the withdrawal of his access to the UN premises.
Very Truly Yours,
Beatrice Edwards

On Western Sahara, Projected UN Security Council Meeting Not Called, Two Tweets by Spox of US Mission to the UN Noted

By Matthew Russell Lee

UNITED NATIONS, March 19 -- Why can't UN Secretary General Ban Ki-moon go to El Aaiun in Western Sahara, even to visit the headquarters of the UN Mission for the Referendum in Western Sahara?

On March 16, Inner City Press asked the US State Department about Western Sahara and then (from the State Department briefing room) published this, emailed to Inner City Press from Deputy Spokesperson Mark Toner:

"The United States continues to support the UN-led process designed to bring about a peaceful, sustainable, and mutually-agreed solution to the conflict in the Western Sahara, one in which the human rights of all individuals are respected.

We support the work of the UN Secretary General’s Personal Envoy for the Western Sahara and the mandate of the UN Mission for the Referendum on Western Sahara (MINURSO).

We encourage all of the parties to remain fully and actively engaged in pushing the process toward an effective resolution."

But on March 19, a strongly rumored UN Security Council meeting about Western Sahara did not happen, at least by 3 pm. And two tweets from the account of the acting spokesperson for the US Mission to the UN got a lot of play, on both sides of the issue, click here to view.

On March 18, lead State Department spokesperson John Kirby said:

"We’re aware of those reports that they’ve asked the UN mission for the referendum in Western Sahara to reduce the size of its mission – to leave, as you put it.  We reiterate our support to that UN mission and to its important mission – to the important job that it’s there to do.  Yesterday the United States participated in a closed session of the UN Security Council, where members expressed concern about the situation.  The United States encourages all of the parties to remain fully and actively engaged in seeking an effective resolution."

On March 18 Inner City Press asked Kirby, again, about theGovernment Accountability Project's letter to the US Mission to the UN about UN retaliation against the Press. Kirby said, "I’m also happy to refer you to our mission up in New York City." Later his office put in writing, "On the question on the Government Accountability Project letter, we’d refer you to the U.S. Mission to the United Nations."

But Inner City Press has already asked three at the US Mission about the GAP letter.

After the Security Council met on March 18 about Western Sahara, the Council's President for March, Ambassador Gaspar Martins of Angola, said the members had agreed to work both bilaterally and as  Council. Which is it? Left solo, France reflexively defends Morocco. French Ambassador Delattre on his way in said:

"With respect to Western Sahara, we, as France, but also as member of the Security Council, are having one clear objective, which is to appease the tensions. And that is why we believe that, at this stage, an important thing in order to appease the tensions, is for Morocco and the UN to have a serene, respectful, and in-depth dialogue. We believe this is absolutely important in order to, again, appease the tensions. This is our number one priority, and we will continue on this path."

 Sounds bilateral... Watch this site.

On March 17 Inner City Press reported there would be an "emergency" meeting, under "Any Other Business," about MINURSO and Morocco's decisions. Since Ban's Secretariat, through USG of DPI Cristina Gallach, threw Inner City Press out of the UN on two hours notice on February 19, covering UN events has been significantly more difficult.

Nevertheless, even for now at this remove we can report: Ban's Secretariat says MINURSO has 85 international staff and 157 national staff; it is considering a "family" duty station, which family members in El Aaiun and Las Palmas -- for now. The Security Council did not offer up the support Ban wanted. Then again, what has Ban done on injustice perpetrated by his Administration?

On March 13, there was a protest of Ban Ki-moon in Rabat, Morocco that we predict will trigger a canned response (a protest in Jaffna, Sri Lanka drew no response at all, despite repeated questions).

It was, it now seems clear, in a ham-handed attempt to forestall such protest that the UN on March 7 published UN spokesman Stephane Dujarric's Q&A on Western Sahara only in its English transcript of the day's noon briefing, not in the French version. Ham-handed and UNtransparent.

On March 14, Inner City Press asked Ban's spokesman Stephane Dujarric about an upcoming meeting it had heard from other sources about. From the UN transcript:

Inner City Press: Has there been a request by Morocco's Foreign Minister to meet with the Secretary-General this week?

Spokesman Dujarric:  Yes.

Inner City Press:  And will that be an open photo op?

Spokesman Dujarric:  The meeting is still… we're still working on the scheduling of the meeting.  Obviously, it will be a photo op, as it is usually with every Foreign Minister that comes to town.  Vine here.

And then, despite Inner City Press' question, Dujarric's office waited until four minutes before the deadline to go up to photograph the meeting to announce it. Some photo op.

Hours afterward, Ban's / Dujarric's Office issued this, in English only:

"Readout of the Secretary-General’s meeting with H.E. Mr. Salaheddine Mezouar, Foreign Minister of the Kingdom of Morocco

The Secretary-General met today with H.E. Mr. Salaheddine Mezouar, the Foreign Minister of the Kingdom of Morocco, to exchange views on the state of efforts to settle the Western Sahara dispute, as well as his recent visit to the region to explore ways to intensify the negotiating process.

The Secretary-General took note of the misunderstanding related to his use of the word “occupation” as his personal reaction to the deplorable humanitarian conditions in which the Sahrawi refugees have lived in for far too long.

The Secretary-General also conveyed his astonishment at the recent statement of the Government of Morocco and expressed his deep disappointment and anger regarding the demonstration that was mobilized on Sunday, which targeted him in person. He stressed that such attacks are disrespectful to him and to the United Nations.

He also requested a clarification regarding the reported presence of several members of the Moroccan Government among the demonstrators. The Secretary-General asked the Foreign Minister to ensure that the United Nations enjoys respect in Morocco.

In choosing to misrepresent the purpose and progression of the Secretary-General’s trip to the region, the demonstrators, and their sponsors, deliberately chose to ignore that at every stop on his trip he underlined his personal commitment to encouraging genuine negotiations between the parties to achieve “a just, lasting and mutually acceptable political solution, which will provide for the self-determination of the people of Western Sahara”, as the Security Council has repeatedly requested.

The Secretary-General underscored to the Foreign Minister that he has adhered closely to the Security Council’s mandate.

The Secretary-General reiterated his 4 November 2015 call for genuine and serious negotiations without preconditions to make progress soonest."

On February 29, Inner City Press directly asked Ban's spokesman Stephane Dujarric, who replied that Ban's trip will be in two parts -- it's just that when the El Aaiun portion will happen is not known.

On March 7, Dujarric called in to the UN Noon Briefing from - where else -- Paris and made much of Ban's visit to part of the MINURSO mission but not its headquarters. Dujarric said there would be a second stage of the trip - to Rabat.

Inner City Press now asks: why did the English language UN transcription of the March 7 briefing include Dujarric Q&A on Western Sahara, here -- while the UN's French language transcription, here, pointed did not?

Is this to please France?  On March 10 Inner City Press asked Dujarric,Vine here, UN transcript here:

Inner City Press: when you called in from Paris about Western Sahara, I've looked at the transcriptions, the UN transcriptions of the noon briefing that day in English and French.  And in English, there's your whole Q&A about Western Sahara, and in French, it's just not there.  And I'm wondering, is there some reasons? They're both working languages, et cetera.  What's the reason for that?

Spokesman Dujarric:  I don't… I'm not sure we put out a transcript in French of my…

Inner City Press:  No, in English… in the English noon brief…

Spokesman Dujarric:  I'm not sure we put out a transcript; I'll check.

Twenty five hours later, nothing. So on March 11, even as Dujarric tried to deny Inner City Press any more questions, Inner City Press asked, UN transcript here:

Inner City Press: on Western Sahara, do you have an answer on the two press statements, English and French?

Spokesman Dujarric:  No.  But I… we're working on it.

Vine here. Then Dujarric abruptly walked out of the UN Press Briefing Room, from which he ousted Inner City Press directly on January 29, and indirectly through another on February 19.

Working on it? How hard can it be? At 6 pm on March 11 Dujarric's office called "lid," end of day, still without answering; Dujarric said something about "two weeks." Watch this site.

On March 7, Inner City Press asked Dujarric if Ban had even tried to get to MINURSO's headquarters in El Aaiun -- Dujarric didn't answer that -- and if Ban hadn't in his comment distributed on March 6 given Morocco a veto over the referendum promises even in the name of the MINURSO mission.

On March 6, Ban Ki-moon (provided by the UN in French only)

"j’ai aussi rencontré les membres du personnel de la MINURSO, qui font preuve d’un grand dévouement. Ils sont prêts à aider à organiser un référendum s’il y a un accord entre les parties. Je me suis rendu dans plusieurs sites, et je compte aller prochainement au quartier général de la mission, à Laayoune, au Sahara occidental."

Ban met staff of MINURSO - but not at its headquarters in El Aaiun - and said they are ready, after decades, to help organize a referendum IF there is an agreement between the parties. So Morocco has a veto?

Dujarric dodged this too, saying that Envoy Christopher Ross should visit Rabat in late March. Inner City Press asked if Ban, now in his final year as SG, will at least ask the "Group of Friends" on Western Sahara, including France with its implicit or secret veto, to allow the promised referendum.

Dujarric said he does not agree France wields a secret veto -- again, no surprise there - but to watch Ban's report to the Security Council in April. We will.

Still, many long suffering Saharawis say even this half-visit by Ban Ki-moon is better than nothing. We'll see.

On March 5, Ban Ki-moon said he was in the regin "to visit the United Nations Mission for the Referendum in Western Sahara (MINURSO). I will visit the team site in Bir Lahlou, as well as personnel performing vital demining activities. I saw the remarkable and demanding work the Mission is doing in harsh conditions of the Hammada. I also expect to visit the headquarters of MINURSO in Laayoune, Western Sahara, soon."

When? And why not say when he's not doing in now? And why he canceled in November (on the off chance he could go to North Korea. Priorities.)

Ban also said, "I have been heartened by the faith Sahrawis people put in the UN, its principles, and international law." If true, has the faith paid off?

Back on March 2, Inner City Press asked Dujarric's deputy Farhan Haq why Ban is not going, while wanly claiming he has the right to do. UN transcript here.

Ban was supposed to go in November 2015 but he canceled it, thinking he could get more political - read, South Korea electoral -- play by going to North Korea. But then North Korea turned him down.

On February 25, Inner City Press asked Dujarric about issues including Western Sahara, after three days reporting on the UN from outside after Ban's head of Communications Cristina Gallach threw Inner City Press out without due process: petition here; weird pro Morocco spin on the ouster, here.

Now ahead of Ban's March 1 stop in Spain - will Gallach be there? - there is pick up of the fact that Gallach is Spain's highest UN official, and that she ousted the Press from the UN.

Will it be resolved by, or come to head on, March 1? In defense of Ban and Gallach, anonymous troll account has taken to tweeting, now at Spanish journalists, that Gallach is fine and didn't throw Inner City Press out of the UN on two hours notice without once speaking to it. But those are the fact. Among the new troll account's followers are Ban Ki-moon's spokesman Stephane Dujarric and four UNCA board members, plus Reuters bureau chief Louis Charbonneau, who has a history with this, see here.

On February 26, Dujarric said, "the Secretary-General's right to visit any peacekeeping mission, but there is the de facto authorities in that area would need to provide the clearance for the plane to land."

So, he really DOESN'T have the right, and isn't really pushing for it. Inner City Press on February 26 asked Dujarric, UN transcript here:

Inner City Press: I wanted to ask what the Secretary-General's goals are for this Western Sahara trip.  What is he seeking to come out of it?  Does he… would he like to see a referendum with independence as a goal?  What's he go into it looking at?  Thanks.

Spokesman Dujarric:  Obviously, the… you know, a lot… a large focus will be on the humanitarian situation.  He'll be visiting the camps near Tindouf, and it is also part of his preparation, obviously… he will report on the trip in his upcoming report, which is scheduled for April.

Humanitarian,? We'll have more on this.

We'll see. UN President of the General Assembly Mogens Lykketoft announced a trip to Europe and Morocco; particularly as the bribery case against former PGA John Ashe proceeds, with two guilty pleas and also indicted former Dominican Republic Deputy Permanent Representative (and South South News executive) Francis Lorenzo found to NOT have immunity, taking Moroccon government funding for a trip to Morocco with a Morocco-provided staffer, particularly (but not only) if not addressing the obvious issue of Western Sahara, seems ill-advised. We'll have more on this.

Why is this not covered more? Well, Lorenzo's (and also indicted Ng Lap Seng's) South South News gave tens of thousands of dollars to the UN Correspondents Association - where Lykketoft at least early in his term held his “press” events, and which more recently got the Office of the UN Spokesperson to throw the Press out of the UN Press Briefing Room, amid these corruption questions. We'll have more on this, too.

Since the criminal complaint, Inner City Press has asked Ban's spokespeople for basic information, and has been rebuffed. Most recently, both the UN Development Program and Ban's spokesman Stephane Dujarric (previously of UNDP) have refused to provide even a copy of the agreement signed by Ng, UNDP's Teresa Liu and Dominica Prime Minister Roosevelt Skerrit.

Inner City Press reported that UNDP was asking corporations for $100,000 to be seated next to heads of state by UNDP. Closer to Ban, literally, the UN Correspondents Association (which previously took money from Ng's media vehicle, then gave it an UNCA Award and Ng a photo op with Ban) now offers seats at the VIP table, next to Ban, for $6,000 (half table) or $12,000 (full table). By most definitions, this is corruption.

Mogen Lykketoft, meanwhile, couldn't bring himself to say Ashe's name, only referring to the President of the 68th General Assembly session. Lykketoft, who allowed his Office to be used for fellow Dane Helle Thorning-Schmidt to campaign for the top spot in the UN's refugee agency UNHCR, said he will be making reform proposals. We will be there - with questions for Lykketoft.

Ban again mentioned what he told Inner City Press at his last stakeout, a task force under his chef of staff Susana Malcorra. But as Inner City Press asked Ban's spokesman Dujarric, with all due respect, Malcorra accepted one of Ng's South South Awards, for Ban. And as note, Gallach went. We'll have more on this.

ICP Asked About Lorenzo's Bribery, US Cites UN Audit, Not South South News

By Matthew Russell Lee, Follow Up on Exclusives

UNITED NATIONS, March 16 -- For more than six months Inner City Press has asked the UN about its dealings with Frank Lorenzo, former Deputy Permanent Representative of the Dominican Republic and head of South South News, who has now formally pleaded guilty to conspiracy to commit bribery at the UN.

Secretary General Ban Ki-moon, who had accepted a prize from Lorenzo, has yet to comment; Ban's spokesman Stephane Dujarric on February 9 told Inner City Press, “I'm done answering questions.” Vine here.

Inner City Press on March 15 asked US State Department spokesperson John Kirby, transcript here, Vine here, full video here, from Minute 21:02:

Inner City Press: I wanted to ask you, there was – today – it was announced today that the deputy ambassador of the Dominican Republic, Frank Lorenzo, is set to plead guilty to bribery charges at the UN. So I wanted to ask, what’s the State Department’s view of that case? Do you view it as just a slip-up in the president of the General Assembly’s office, or is it a reflection of a wider corruption or sale of access at the UN and what the Government Accountability Project also calls retaliation against the press reporting on the case? Do you – what do you make of this case that began in October and is ongoing, the wheels are turning?

MR KIRBY: I’m going to have to take that question. I do not believe I have anything for you on that. So you’re going to have to let me get back to you.

On the afternoon of March 16, when Inner City Press asked Kirby's deputy Mark Toner the above questions, along with questions on Yemen, Sudan and genocide, a State Department official on background answered Inner City Press:

"Rooting out fraud and corruption, and advancing accountability is a priority for the United States, and has been for many years. In addition to ongoing legal action in the Southern District of New York, we support the Secretary General’s request for an Office of Internal Oversight Services (OIOS) audit of the interaction between the UN and the Global Sustainability Foundation and the Sun Kian Ip Group, and the use of any funds received from these entities. As this matter is under ongoing investigation by the U.S. Attorney’s office, as well as by the UN and OIOS, it would be inappropriate to comment further."

We'll have more on this - for example on what the indictment calls "NGO-1," which is South South News, and about the US and the GAP letter. Watch this site.

On February 19 Inner City Press was ordered out of the UN, which it has covered for ten years as a Resident Correspondent with a shared office full of files, by a letter signed that day with two hours notice by Under Secretary General for Public Information Cristina Gallach - who attended the September 2015 South South Awards with Lorenzo, photo here.

On Gallach's order, and with the participation of Ban's spokesman Dujarric, Inner City Press was thrown out onto First Avenue along with its laptop, but without its passport still in its shared office, by eight UN Security guards.Audio here. On February 22, UN Security told Inner City Press it was Banned from all UN premises.

After stories in BuzzFeed and Business Insider, Inner City Press re-entered the UN on a much reduced “non-resident correspondent” pass, Banned from covering such events as UN Security Council reform, Sri Lanka and terrorism, and the Office of the President of the General Assembly. (Inner City Press has continued, with sources, to report, for example here.)

The harassment continued: hours after Inner City Press raised its case orally to Ban Ki-moon and his deputy, UN Security against physically ordered Inner City Press to leave the UN, at 8 pm.  Video here.

Dujarric said it is not his job to find Inner City Press a place to work. Q&A here. More and seemingly final threats were made on March 14 -- just before it emerged that Lorenzo is pleading guilty to bribery charges. Now what?

The UN has proved itself unable to reform itself. Under Secretaries General Inner City Press contacted about Gallach's outrageous no due process order, and her failure to recuse herself, did nothing. One said, You can only speak with Gallach; another said, I don't get involved in individual cases.

On March 14, after the threats and asked about Inner City Press' detailed email about the violation of its rights as a journalist, a third USG said, Do you expect me to respond to that? Well, yes.

The DC-based Government Accountability Project wrote to the US Mission to the UN urging them to work to get Inner City Press' resident correspondent accreditation and office restored. But US Ambassador for Management and Reform Isobel Coleman did not even respond to Inner City Press' detailed March 3 email; an oral question to Samantha Power at the UN Security Council stakeout on March 14 after the threats has gone unanswered. Vine here.

Now what? Beyond Lorenzo's guilty plea, how will the UN be cleaned up? All retaliatory acts must be rescinded and appropriate impartial investigations launched.

The pretext Gallach used to oust Inner City Press was its attempt on January 29 to cover a meeting of the UN Correspondents Association, which took money from Lorenzo's South South News and then granted a photo op with Ban Ki-moon to the main funder, also indicted Ng Lap Seng.

The meeting was in the UN Press Briefing Room, apparently “lent” to UNCA by Ban's spokesman Dujarric, who at UNCA boss Giampaolo Pioli's request came in and told Inner City Press to leave so he could see his “f*cking kids.”

Inner City Press said it would leave the glassed in interpreter's booth from which it was live-streaming the meeting as soon as UN Security asked it to. One guard came in and said that Spokesman Dujarric wanted Inner City Press to leave, which it did, and published a story and video.

Without once speaking to Inner City Press, Gallach used this “incident” as a pretext to throw Inner City Press out. Inner City Press has asked the UN the following questions:

Please explain the lending of the UN Press Briefing Room to Lorenzo, and that it was not listed in the days' UN Media Alert.

Please explain USG Gallach's appearance with Lorenzo at the South South Awards, which ICP reported, and that USG Gallach did not recuse herself from ordering Inner City Press' expulsion from its UN office on 2 hours' notice on February 19.

Please explain your [Dujarric's] role, on January 29 to February 19, in the expulsion of Inner City Press.

Please state who lend the UN Press Briefing Room to UNCA on Jan 29.

As a matter of UN ethics, shouldn't USG Gallach have offered me an opportunity to be heard, some due process?

As a matter of UN ethics, to whom an the UN Press Briefing Room be "lent," and by whom, on what basis, without disclosure?

Please provide your response: should staff of the Office of the Spokesperson for the Secretary General, and staff of DPI, accept free liquor and other gift from UNCA, while giving UNCA the UN Press Briefing Room and ousting other journalist whom UNCA's leadership doesn't like?

Please state, no or yes and explain: Do staff of the Office of the Spokesperson for the Secretary General provide advance copies of UN documents to favored journalists who are affiliated to UNCA?

And now: “This is a formal request for Ban Ki-moon's comment on the guilty plea for conspiracy to commit bribery etc by Frank Lorenzo.” Watch this site.

After UN Department of Pubilc Information Ousts Inner City Press, Government Accountability Project Asks US Mission To Get Pass and Desk Back

By Matthew Russell Lee

UNITED NATIONS, February 26 -- After Inner City Press was summarily ejected from the UN, which it has covered for 10 years, on February 19, the ostensibly deciding official Cristina Gallach told no less than Nobel Peace Prize laureate Jose Ramos Horta that Inner City Press would still be able to cover the UN.

What she didn't say was that Inner City Press' ability to cover the unfolding UN corruption scandal in which she has played a role would be curtailed under the proposed arrangement - by design.

Now the Government Accountability Project, which defends whistleblowers, has written to the US Mission to the UN, Ambassador of Management and Reform Isobel Coleman, to ask the US to ensure Inner City Press gets back its office and Resident Correspondent's pass. GAP letter here.

GAP's Beatrice Edwards cites the UN's lack of due process and of rules, and the seeming retaliation against Inner City Press for its reporting. (There's also the physical ouster of Inner City Press, audio here.) Other missions have openly taken action: what will the US Mission do?

Meanwhile in defense of Ban and Gallach, anonymous troll account has taken to tweeting, now at Spanish journalists, that Gallach is fine and didn't throw Inner City Press out of the UN on two hours notice without once speaking to it. But those are the fact. Among the new troll account's followers are Ban Ki-moon's spokesman Stephane Dujarric and four UNCA board members, plus Reuters bureau chief Louis Charbonneau, who has a history with this, see here.

Because as a working journalist it needed access to cover the February 25 UN Security Council meeting about North Korea, and only in connection with filing a lawyer's letter telling Gallach and the UN not to touch Inner City Press' office or files, Inner City Press late morning entered the UN with a so-called "Green P" non-resident correspondents pass.

At the day's noon briefing, after asking of Burundi, Western Sahara, Darfur and the UN corruption scandals, Inner City Press asked Ban Ki-moon's spokesman Stephane Dujarric two simple question, to which he said #AskGallach. From the UN transcript:

Inner City Press: I'd like this to go smoothly, so I'll do it really quickly.  I noticed that on Monday, when I was not able to attend the briefing, that you had a little Q&A about my accreditation status.  So, I just want to state one thing very briefly.  A legal letter has been received by DPI [Department of Public Information] to not touch my office, not touch any of the files, but I need to cover the meeting this afternoon.  I'm just stating that, because I thought it was inappropriate.  But, my question is as follows:  Is it common UN practice to… to tell a journalist to leave the building and give up Resident Correspondent status without ever once speaking to them?  Is that considered an investigation?  What is the lowest standard that the UN can go to to have something to be considered a review of the facts?

Spokesman Dujarric:  I would encourage you to direct all those questions to Ms. [Cristina] Gallach and to DPI.

Inner City Press:  I have one more question.  What are the rules for the use of physical force by UN security?  Because on Friday evening, I was pushed down the escalator and into the street, and my laptop was thrown on the street, and I… and I was offering absolutely zero physical… physical… so I wanted to know what is the recourse for someone to whom this happens?  That's my question.

Spokesman:  I would encourage you to raise all these issues having to do with your accreditation, your treatment, and so forth to Ms. Gallach.

Question:  What are the rights of people not to be pushed by UN security?

Spokesman:  That's… that was my answer to your question.  Thank you.

Wait - so the UN has no protocols on the use of force? Or DPI's Gallach is in charge of the use of force, and ordered it? How can the UN and USG Gallach be so contemptuous to the most basic forms of due process?

Inner City Press is opposing all this.

And so now are a range of people from around the world, who have signed a petition to immediately restore Inner City Press to the UN Resident Correspondent accreditation it had for nine years until, without any due process, the UN pass was physically torn from its chest as UN Security throw its laptop onto the sidewalk in front of the UN (also owned by the UN and immunity from US law including the First Amendment).

Here are just some of the comments of those signing thepetition directed to Ban Ki-moon:

I'm signing because the barring of access to Mr. Lee appears to be at worst motivated by a reluctance to engage with and continue to receive the probing questions he asks, and at best the result of a petty personal vendetta based on unprofessional antipathy towards Mr. Lee by the 'respectable' wing of the United Nations press corps. -Marlon Ettinger, Hastings-on-Hudson, NY

I am signing this petition for Matthew Russell Lee and Inner City Press be restored to the shared UN office and Resident Correspondent accreditation they have had for eight years prior to this pretextual incident. It also requests, as does the Free UN Coalition for Access that Matthew co-founded, that an investigation be launched into how all of this occurred. It's unfair to throw someone out like that with out hearing from his side of history. -Hermon Tsegay, Slough, United Kingdom

Such a crck down on media in an organization promoting freedom of speech and information is really awkward and clearly disgraceful and unacceptable. -Florent Nduwayo, Kibungo, Rwanda

This is another in a long line of incidents conclusively evidencing the UN's complete and utter disrespect for the laws of its HOST country, the US, in particular the 1st amendment!! UN IMMUNITY = IMPUNITY--END IT NOW!! Journalists are the ultimate whistleblowers, and I am well aware of how UN whistleblowers like Mr Lee are persecuted and suffer grievous harm at the hands of rogue UN officials. The treatment of Mr. Lee is an outrage.

How ironic this has happened just as the US House Committe on Foreign Relations is today, on 24 Feb, holding a hearing about the gross mistreatment of whistleblowers at the UN and WIPO. Congress must act now to cut off 15% of US appropriations to the UN this year on account of its failure to protect and encourage UN whistleblowers like Mr Lee, as provided for in US law, as it already did to WIPO!! -ted beacher, Geneva, Switzerland

ICP is doing a great job. UN should support, respect and promote free speech. -Kalu Thapa, Kathmandu, Nepal

There are more...

But the UN Correspondents Association, at least its 15 Executive Committee members, issued a February 22 statement in context fully supporting the throwing of Inner City Press into the street, the seizure of passport, the Banning, all of it. We wonder if these scribes' employers know about this.

For now we reiterate the obvious: the UN Press Briefing Room is presumptively open to all press. If Spokesman Dujarric, or DPI's Gallach, wants to lend it to their friends, at least provide a notice so journalists hungry for news don't get excluded and get nothing.

At UN, Whistleblowing in the Wind as Ethics Office Fails 99% of Complainants, Raid Redux

By Matthew Russell Lee
UNITED NATIONS, April 9 -- Even when the whistle is blown in the UN's lack of effective protection for whistleblowers, the UN's response is first to refuse to comment, then to churn out statistics that experts in the field view as misleading.
On April 8, Inner City Press asked Secretary General Ban Ki-moon's deputy spokesman Eduardo Del Buey:
Inner City Press: There was a press conference earlier today across the street by the UNMIK [United Nations Interim Administration Mission in Kosovo] whistleblower, Mr. [James] Wasserstrom, and he is calling on the US to implement a law which would cut 15 per cent of the funding by the US to the UN for failure to protect whistleblowers. And one of the questions that arose that I would specifically want to get your response to is whether in the whole course of his case, which has been pretty widely reported, the Secretary-General or his team has ever sought to meet with GAP [Government Accountability Project] or with Mr. Wasserstrom in terms of trying to reform what seems to be a broken whistleblower protection system? I was told by GAP that the Secretary-General has never responded even to letters from them. So how can that be?
Deputy Spokesperson Del Buey: Well, Matthew, the only thing I can say is the matter is under consideration for appeal to the UN Appeals Tribunal, and of course, we cannot comment on it until the litigation is over.
Inner City Press: He was complaining this morning that, despite what he called retaliation, what was found to be retaliation, he was awarded $65,000, which doesn’t even cover his costs; he says other whistleblowers won’t come forward. Is the Secretary-General trying to reduce that further or does he also feel that his award means that whistleblowers essentially will just stay quiet?
Deputy Spokesperson: Matthew, as I said, that the issue is under litigation, I cannot comment on it.
The next day, April 9, Inner City Press asked Del Buey a more generic question: how many claims of retaliation has the UN Ethics Office process, and many has it verified or “established”?
Later on April 9, the UN sent Inner City Press the following statistics:
Subject: Your questions on complaints presented to the Ethics Office
Date: Tue, Apr 9, 2013 at 3:40 PM
From: UN Spokesperson - Do Not Reply [at] un.org
To: Matthew.Lee [at] innercitypress [dot] com
In response to your question at the noon briefing, we can say that from August 2006 to July 2012, the Ethics Office initiated 106 formal retaliation complaint preliminary reviews. Of those 106 cases, 1 remained under review and 18 were closed as a result either of the complainant having withdrawn or abandoned his or her complaint or of the case having been resolved informally to the satisfaction of the complainant. For the remaining 87 complaints, the Office determined that 9 had presented prima facie cases of retaliation and referred those cases for formal investigation. Investigations were completed for five of the cases, after which the Office determined that retaliation had been established for one of them. Four cases are still pending completion of the investigation.
Even though, or perhaps because, Ban Ki-moon has not responded to their inquiries, the Government Accountability Project are among the experts in this field. So Inner City Press asked GAP's Shelley Walden about the UN's response. Here is GAP's reply:
“This information appeared in the UN Secretariat Ethics Office’s 2012 report (see A/67/306, para. 47). The Ethics Office says it initiated 106 formal retaliation complaint preliminary reviews, but if you add up all of the protection against retaliation inquiries mentioned in the Ethics Office’s reports from 2006-2012, the number comes to 343...
“The Ethics Office says that it completed a preliminary review in 87 cases and ultimately determined that retaliation was established in one case. But whether you use the 87 number, 106 number or 343 number, the UN Ethics Office has still failed to protect 99% of UN staff members who have requested protection against retaliation.
“The reason that we tend to use the 343 number is because we don’t know how many of these people had valid retaliation complaints that the Ethics Office failed to review, due to lack of jurisdiction or for other reasons. We know, for example, that the Ethics Office will not review retaliation complaints from UN police officers as they have concluded that they are not protected by the UN whistleblower protection policy when they report misconduct. So those kinds of cases are reflected in the 343 number but are most likely not reflected in the 106 number. To be fair, the Ethics Office has informed us that some of the 343 cases were not whistleblower cases (i.e. claims in which the staff member was not a whistleblower and merely wanted to contest a performance review). They also include cases in which someone requested advice regarding the protection against retaliation policy, but did not submit a complaint.”
Still. And what about the UN's now clear retaliation against the Press, going as far as a non-consensus March 18 raid of its office, and March 21 leaking to BuzzFeed of photographs of its desk and bookshelf? We'll have more on this -- on the retaliation front too, we hope. Watch this site.
