June 29 รข A man arrested with
54 vials of crack, coming out
of a car with a gun in the
console, was up for sentencing
before U.S. District Court for
the Southern District of New
York Judge Loretta A. Preska
on May 27. Inner City Press
was there. The
defendant's CJA lawyers from
Skadden Arps argued for an 18
month sentence; Probation was
recommending 24 months.
The
US Attorney's Office sited a
prior conviction stemming from
a knifepoint robbery of a
victim in 2015 (resulting on
conditional discharge in NYS
court), and gunpoint robbery
in 2021 with the same
result. The
defendant said he would not
appear again in Judge Preska's
courttoom. " I
take you at your word," she
said, adopting the lower
sentence: 18 months. On June 15 for
the lead named defendant,
counsel wrote in asking for a
21 month sentence on June 29. And on June 29
that's what he got: 21 months
then three years of supervised
release. The overall case is USA v. Avila, et al., 1:25-cr-671 (Preska)
