Judge Stein denied Nadine
Menendez' request for bail
pending appeal, writing that
while "According to defendant,
the Government manufactured an
attorney-client conflict
between defendant and
defendant's preferred trial
counsel, David Schertler, that
forced Schertler and his law
firm to withdraw from
defendant's defense team and
deprived defendant of her
Sixth Amendment right to the
counsel of her choosing. (See
Dkt. No. 938 at 6- 11.) The
Court disagrees that defendant
raises a substantial question

Judge Stein held a hearing
(and attempt to resolve in
chambers) on the issue of
Nadine Menendez' seized
jewelry, the Second Circuit's
denial of bail pending appeal
was docketed. On July 2, Judge
Stein pushed back: "ORDER as
to Nadine Menendez. The Court
has received todays letter
from defendants counsel
requesting an almost
four-month adjournment of
defendants surrender date with
a status conference in
September to update the Court
on Mrs. Menendez's status at
that time [ECF Doc. No. 946].
The government is directed to
respond to defendant's letter
by 9:00 a.m. on Wednesday,
July 8; defendant is directed
to inform the Court by July 6
why it filed its request for
this adjournment 90 minutes
prior to the close of business
before a three-day federal
holiday and merely eight days
in advance of defendants
scheduled surrender date(
