FEDERAL COURT, June 16 -- On June 16, months after the DC Circuit's decision in US v. Munchel, DDC Judge Emmet G. Sullivan held a hearing on Jonathan Gennaro Mellis, who is detained and alleging abuse by guards. Inner City Press live tweeted it here (and podcast here)
Mellis: Your Honor, it is crazy in here. Judge Sullivan: Thank you. Counsel? Mellis' lawyer: We are waiting on a plea offer. Let's continue this for 45 days.
Judge Sullivan: What about the time between now and then? Mellis' lawyer: This will be the last extension.
Judge Sullivan: If I were to continue for 45 days, would the US be prepared to have extended an offer?
AUSA: The answer is Yes. We have given discovery, body-worn camera footage. There will be a plea offer in his hands in 60 days due to summer and supervisors' OK
Mellis' lawyer: I've dealt with this AUSA for over 20 years, he's fine. It goes above him. The officer at issue was not hospitalized.
Judge Sullivan: 45 days, then. The AUSA's reference to holiday season probably goes over like a lead balloon to Mr. Mellis...
Judge Sullivan: Aug 4 at 2:30 pm. Mr Mellis, you'll have a plea offer by then or before.
Mellis: I'm going to have to trust my attorney. I'm sorry to complain each time.
Judge Sullivan: I gave you the time. I complain every time I go to court, it's called life.
So, there'll be a plea offer on or before Aug 4. No action taken on Mellis' complaints. Adjourned.
