SDNY COURTHOUSE, June 15 – Gavin Finders sued Bobby Khorrami and his now-shuttered Adella Restaurant at 410 West 43rd Street and its BK 17 entity for breaching their duties to investors in the restaurant.

On March 29, U.S. District Court for the Southern District of New York Magistrate Judge Robert W. Lehrburger held a discovery hearing. Inner City Press covered it.

The defense said they can't produce bank records because they are locked up in the restaurant and ordering them from the bank would cost five dollars a page.

As to why the restaurant is shuttered, the answer was non-payment of rent.

It was said Khorrami when BK19 was hit for back taxes shifted the business into a similarly named company not subject to liens.

On June 15, Judge Lehrburger held another proceeding and Inner City Press again covered it. Khorrami has not been complying with discovery, and has yet to be his bankruptcy in the docket. As a sanction, Judge Lehrburger ordered the payment of plaintiff's attorney's costs in filing the letter requesting the conference and appearing at it.

The case is Finders et al v. BK 19 Inc. et al., 19-cv-11802 (Carter / Lehrburger)
