In DC Capitol Case, Bustle Duo Plead Guilty & Face Sentencing in 4-6 Weeks

FEDERAL COURT, June 4 -- Nearly five months after the January 6 events in Washington, on June 14 DDC Judge Thomas F. Hogan held a guilty plea proceeding for two defendants, and said he'll sentence them in four to six weeks. Inner City Press live tweeted it here:

now before DDC Judge Hogan, change to plea (to guilty) of defendants JOSHUA KAHLE BUSTLE and JESSICA LOUISE BUSTLE. Judge Hogan begins by explanating why he will be asking the questions in the guilty-plea script (do you know the rights you are giving up, etc). Doesn't seem there'll be immediate sentencing as Judge Lambert has set for Anna Morgan-Lloyd on June 18

The Bustles are in their 30s; Mr. Bustle says "high school." Judge Hogan: Either treated for narcotics drugs? Both: No. [Two-person guilty plea is not something they do here in the SDNY . To each District its own, it seems]

 Judge Hogan: If you plead guilty, you are waiving your right to a trial and therefore to any appeal of any trial. There is no sentencing guideline here. Zero to six months under the statute. The government has not made any sentencing recommendation. AUSA: Correct

 Judge Hogan: Were you threatened to plead guilty? Both: No. Judge Hogan: Anyone promise you what your sentence will be? Both: No Judge Hogan: The plea agreement says, Mr Bustle entered the East Entrance of the Capitol. There is video, and signs protesting vaccines

Judge Hogan: Do you want me to accept your plea? Ms. Bustle: Can I say speak? Judge Hogan: I just want to know if you want me to accept you plea. Ms. Bustle: Yes. Judge Hogan: I accept it. Now I'm happy to hear from you. Ms. Bustle: I also said, Pray for America.

Judge Hogan: Probation is doing a lot of cases. Bustles' lawyer: You won't learn much from pre-sentencing report. Let's sentence now or very soon. Judge Hogan: I'm not prepared to do the sentencing today. And I don't set the date today. A month or six weeks.

Lawyer(s) - Mr. Bustle needs to travel to Maryland for  real estate business. And the Bustles will move to South Carolina in August.

Judge Hogan: We can modify the order. I'll ask probation for a report & set a sentencing date.
