Crypto Defendant Avi Eisenberg Is Jailed Pending April 2024 Trial Now Early Dec Qs

SDNY COURTROOM, Nov 21 -  In the U.S. District Court for the Southern District of New York on December 27, 2022 a complaint was ordered unsealed charging Avraham Eisenberg with commodities fraud. He was arrested in Puerto Rico.

On January 9, Inner City Press came across the CFTC case against Eisenberg, just filed (still with no title in PACER) and put it out on Patreon here. The 21-page civil complaint is, as is often the case, more detailed...

 On April 12, the US Attorney's Office filed a motion to intervene and stay the Mango Labs v. Eisenberg case, saying that neither side opposed the stay. The US seeks a "full stay until the conclusion of the parallel criminal case."

  On July 27 Eisenberg moved to dismiss and to suppress; he submitted a 7-page affadavit including "In the evening of December 26, 2022, I arrived by airplane at The Luis Munoz Marin International Airport in Carolina, Puerto Rico, just outside of San Juan. 3. I disembarked the airplane with my luggage, a backpack and a suitcase. 4. I walked to the United States Customs counter. There, I was questioned by a United States Customs and Border Protection ("CBP") agent regarding the purpose of the trip I had just completed and general questions about the contents of my luggage. 5. The CBP agent directed me to a specific area several feet away from the Customs counter for additional questioning, and there another CBP officer opened the suitcase and backpack. I recall the agent pulling out the laptop and asking me to turn it on" - full affidavit on Patreon here.

On February 3, Eisenberg in a yellow jump suit and feet shackled was brought into Magistrates Court at SDNY. He had, at least for the proceeding, the same lawyer Ethereum developer Virgil Griffith had in the North Korea sanctions case he pled guilty in: Brian Klein.

  His parents were in the gallery and he looked at them, from two rows away. The prosecutor said that (unlike on Sam Bankman-Fried) they were seeking detention, and that he was consenting at least for now.  Here is Inner City Press' thread.

On November 2, 2023 Eisenberg's counsel wrote it seeking to push the December 4 trial to March or April. They said Eisenberg was moved from Essex to the MDC, and not allowed to bring his discovery material with him. The SDNY prosecutors acknowledge that's a problem, but want only a one-week delay to December 11 - or to April, citing an unrelated murder trial.

On November 3, it was moved to April 2024. And on November 21, Judge Amit Subramanian set out questions to be answered in early December, including "Whether any transaction involving USDC, even where it is used as a medium of exchange to purchase something that is not a commodity, is nevertheless a “contract of sale of any commodity” given the statutory and regulatory definitions (see Dkt. 37 at 5-6);  Whether the indictment alleges manipulation as to the price of USDC, deceptive conduct affecting the USDC market, or deceptive conduct otherwise “in connection with” a contract of sale of USDC (see Dkt. 37 at 7–8);  Whether the indictment alleges a manipulative device “in connection with . . . any swap” where Eisenberg was the party on both ends of the MNGO Perpetuals" - full order and questions on Patreon here.

  Ultimately Judge Liman extended the TRO for two weeks, after for two letters by Tuesday, and said he will rule on March 10.

Man Charged with Planning al Shabaab Attack Wants to Go Passive at Trial After Sealed Court

SDNY COURTHOUSE, Nov 21 – Cholo Abdi Abdullah is charged with planning with al Shabaab to attack the US with a commercial jet. 

 On September 5, 2023 he appeared in court saying he has lost faith in lawyers, and intially saying he now wants to represent himself. Inner City Press was there, the only media in the courtroom.

  U.S. District Court for the Southern District of New York Judge Analisa Torres advised him that without a lawyer he would be at a major disadvantage.

After a break, it was agreed he said confer with CUNY law professor Ramzi Kassem, and be back in court on September 19 at 3:30 pm. There is more to be reported but for now, here, this is it.

On November 21, Inner City Press went at 9 am to Abdullah's Faretta hearing. But it was asked to leave the courtroom, from 9:22 am to 9:50 am. It has filed a letter to get the transcript of the closed proceeding, here.

After being readmitted to the courtroom, Abdullah said he wants to represent himself at trial and "stay passive," allowing the government to make its case. Apparently more reasons were given in the sealed session. A stand-by counsel was appointed, who quickly asked for a co-standby. More soon.

Celsius Bankruptcy Decision Is Stayed Pending Appeal Amid Mashinsky Case in SDNY

SDNY COURTHOUSE, Nov 21 – After Alexander Mashinsky of Celsius was arrested on July 13, US Attorney Damian Williams held a press conference, and Inner City Press asked a question, see below.

Late on November 14, 2023, the Bankruptcy Court decision on Celsius was appealed to the U.S. District Court for the Southern District of New York, where the appeal was found by Inner City Press. A stay was requested - stay motion on Patreon here.

Docketed on November 21, the stay was granted: "ORDER granting [3] Motion to Stay re: [3] MOTION to Stay Pending Appeal. Back on July 13 Inner City Press asked US Attorney Williams to explain his office's thinking in agreeing to release on bail for Sam Bankman-Fried and Shakeeb Ahmed, for example, but demanding and obtaining the ongoing pre-trial detention of Avi Eisenberg and Miles Guo.  

 US Attorney Williams responded that every case is different. Inner City Press asked if his office would in the afternoon be seeking the detention of, or agreeing to release, Mashinsky. He declined to say either way, saying you will soon see.

Trevor Milton Asking for No Jail at Sentencing Gets It Pushed to December 18, Nikola Info Qs

SDNY Courthouse, Nov 21  – In September and October 2022 Trevor Milton, founder of Nikola Motor was put on trial for fraudulent claims about NKLA's hydrogen trucks.

On Friday, October 14, Milton was found guilty on three of four counts.

  Published hours after the verdict was a book by Matthew Russell Lee, who live tweeted and reported on the trial daily, and put questions to Milton and his lawyers in Foley Square outside.

On December 14, Milton filed requesting a new trial - citing InnerCityPress.com "Book Interviews" published on October 16 and 17, 2022, see Milton's filing on DocumentCloud here.

On November 14, 2023 Milton's counsel  asked for mere probation, contrasting Milton to Elizabeth Holmes and more recently OneCoin's Sebastian Greenwood (whose sealing of sentencing letters Inner City Press has appealed while still seeking pro bono counsel). On November 16, there was a brief proceeding about Milton being able to use documents from his arbitration with Nikola, for his sentencing. The parties were to confer. On November 20, Milton's counsel said the conferring had not been successful, and asked for an order providing access to, among other things, deposition and/or hearing testimony of Girsky, Russell, Brady, Worthen, Kevin Lynk and Dane Davis; and interviews of Tony Heaton, Pablo Koziner, Nicole Rose, Christian Appel, Michael Erickson, Vince Caramella, Stephanie Fleck- full letter on Patreon here.

On November 21, Judge Ramos docketed an order pushing Milton's sentencing to December 18: "The sentencing currently scheduled for November 28, 2023, is rescheduled for December 18, 2023, at 11:00 a.m. The government's sentencing submission shall be due December 11, 2023. After Milton's December 14 filing, Inner City Press reached out to the juror about Milton's team's claims. She scoffed, "It’s an old Facebook post from 2017 like when Bernie ran And it was a repost from AOC not even my words Trevor wasn’t even on the radar then. And I liked Elon until he bought Twitter Taxing the rich isn’t the same as fraud Which I think makes sense anyways The funny thing is. I really don’t use social media. Like yeah my Facebook is active and Twitter and instagram but I don’t actively use them. I’ll never delete my Facebook because if my family needs me that’s how they reach me."

And on February 2, 2023, Milton's team filed a reply, quoting the above and equating skepticism about corporate fraud with racism, demanding a hearing or a new trial. They write: "her post-trial interviews - including one given recently about Mr. Milton's motions - demonstrate she understands perfectly well that the 'news' is not just YouTube and that "social media" includes Facebook and Twitter." Filing(s) are pending before Judge Ramos.

On January 23, Judge Ramos pushed Milton's sentencing back to June 21: "ORDER granting [261] LETTER MOTION request a revised post-trial briefing schedule and adjournment of sentencing. The revised post-trial briefing schedule is approved. Sentencing is adjourned to June 21, 2023 at 10 a.m. The Clerk of the Court is respectfully directed to terminate the motions, docs. 262 and 263. So how much change does Milton's appeal on this have?

Interviews: Juror #9, "V" - "Sure, Overall the entire trial was very dense in terms of information I myself I estimate took at least 50 pages of notes front and back. While Mr. Milton may not have liked the result he should know that he did in fact receive a completely fair trial in my opinion. Personally in my notes I did have to write "credibility?" and ultimately did not use two witnesses testimony in my deliberation reasoning due to the fact I just couldn't find them credible....

... Roughly for the first hour and a half absolutely no decision was made at all on any counts. Personally it began to feel like we may have been a hung jury.

"This is when we began to request a few pieces of evidence we did not take any notes on that we needed to break the ice. Once we received those aids deliberations became smoother albeit there were moments of silence here and there as we contemplated what a juror may have said or looked for a piece of evidence that contradicted or further supported what was said.

"That being said on Count 2 that I've seen many questions on after looking up to see what the public thought was he was close to being convicted he reached 2/3 requirements and we began discussing the third it was then that I re-read the charge and noticed that while similar to count 1 count 2 had to meet ALL requirements.

"When asking if anyone noticed any evidence to suggest the government had met this criteria we found they fell short.   In regards to count four I just wanted to mention we in fact did not even like Mr. Hicks and personally I believe he is greedy, but examining the law Trevor was still in fact guilty."     Lee was each day in the courtroom of U.S. District Court for the Southern District of New York Judge Edgardo Ramos, and venturing farther afield to investigate leads exclusively give to him and Inner City Press and by Nikola whistleblowers.

   As the trial wound down, Inner City Press published descriptions of documented destroyed within Nikola, and guilty knowledge by officials still at the company.

    This review will leave it to others to find over-reaches and typos. For his reporting, Lee was banned from the United Nations in 2018 by SG Antonio Guterres, whose Media Accrediation chief Melissa Fleming has ignored appeals from a UN Special Rapporteur on Freedom of Expression and, pro bono, the law firm of Quinn Emanuel.

   One might surmise that history leads to some of the book's (over?) identification with the defendant.

CRA Challenged to Burke & Herbert on Summit Is Deemed Protest by FDIC despite Bogus Reply

SOUTH BRONX, Nov 20 – Virginia and Delaware portrayed as diverse and ever progressive places. But their banks, not so much. 

 Consider for example the proposed acquisition by Viriginia-based Burke & Herbert Bank & Trust Company of Summit Community Bank. Despite a showing of disparities at Burke & Herbert even worse than at Linkbank, which the FDIC imposed a condition on, Burke on November 15 issued a vacuous response. They drop an ad-hominen footnote which ignores that the evidence put forward in a litigation survives the suit's withdrawal.

On November 20, the FDIC overruled Burke & Herbert's position: "

Box 20047 New York, New York 10017 Dear Mr. Lee: We received your e-mail dated November 10, 2023, regarding the application for Peoples Security Bank and Trust Company to merge with FNCB Bank. We reviewed your correspondence in accordance with the guidelines of 12 C.F.R. Section 303.2(c) and 303.2(l), and we consider it a protest... Any future comments should be sent to the applicant and to this office."

Inner City Press and Fair Finance Watch have long exposed redlining - and in this vein, on October 28 they filed a Community Reinvestment Act challenge with the FDIC:

"In Virginia in 2022, Burke & Herbert Bank & Trust Company made 104 mortgage loans to whites, but only 12 to African Americans. This is out of keeping with the demographics of its footprint, and its competitors.  

 Beyond Virginia, Burke & Herbert Bank & Trust Company is scarcely better. In 2022, Burke & Herbert Bank & Trust Company overall made 119 mortgage loans to whites, but only 16 to African Americans.   

  Summit Community Bank is also of concern. In West Virginia in 2022 it made 403 mortgage loans to whites, and only EIGHT to African Americans. Meanwhile it denied 3 applications from African Americans, and only 97 from whites (compared to 403 originations).  This is disparate, and more disparate both than the aggregate in West Virginia. 

  And that's not even getting into Burke & Herbert's overdraft fee abuses. More on that to follow - more than conditions, this application should be denied.

 In October, after a similar challenge by Fair Finance Watch on data and complaints not even as bad, the FDIC required from LINKBANK a plan to improve its lending to African Americans, which Inner City Press has published on its DocumentCloud here.


If the regulators at the FDIC means what they claim, including in the new CRA regulation, this application should be denied. Watch this site.

Narco Tomas Colon Sealed Sentencing Memo So Inner City Press Opposed now Nov 28 OTSC

SDNY COURTHOUSE, Nov 20 – The entire sentencing submission by Tomas Colon, described as the "leader of a major drug trafficking organization," was filed under seal on November 16.

That evening, Inner City Press wrote to U.S. District Court for the Southern District of New York Judge Valerie E. Caproni questioning and challenging the sealing. 

 On November 20, Judge Caproni ordered the defense to by November 28 "show cause why he should not be required to file a public version of his sentencing submission redacted only to protect sensitive information that is not already public." Colon's sentencing was pushed back to December 1.  

 This comes as, for example, all of the sentencing letters of OneCoin crypto currency fraudster Sebastian Greenwood were sealed, regarding which Inner City Press filed a notice of appeal and is now seeking pro bono appellate counsel to pursue.

After NBA Fraudster Williams Got 10 Years and Bynum, Davis Guilty Darius Miles Time Served

SDNY COURTHOUSE, Nov 20 – Former NBA players Anthony Allen, Sebastian Telfair, Terrance Williams and 15 others former players were named in an indictment unsealed on October 7, 2021 for defrauding the NBA health fund, in Telfair's case, for $350,000.

  Telfair nevertheless got a publicly funded lawyer. Inner City Press was there, in U.S. District Court for the Southern District of New York Magistrates Court and live tweeted it here and below(street video here)

On November 13, 2023 the trial of William Bynum and Ronald Davis was winding down. Bynum was being cross examined about paying Terrence Williams $30,000. Asked if he'd stopped speaking with Terrence Williams, Bynum said only money, "I'm a positive person," still talking about basketball. Rule 29 motions were denied and one rebuttal witness' testimony trimmed but not precluded.

On November 15, the jury found both guilty "of a criminal scheme to defraud the NBA Players’ Health and Benefit Welfare Plan."

On November 20, Darius Miles got time served. Inner City Press was there, thread:

He: I apologize to the NBA and players. It is a brotherhood.  I was wrong. 

Judge Caproni: You were drafted out of high school, you are a poster child for why that was a bad idea. You have a podcast, on YouTube I understand...

 Judge: False claims is a serious crime for $360,000. This is the 14th sentencing in this case. You are similar to Shannon Brown. I sentence you to time served and three years of supervised release

 Judge: Also, restitution of $359,000 and 150 hours of community service.

Back on September 26, 2023, Doctor William Washington flew from Seattle to New York to plead guilty before Magistrate Judge Ona T. Wang. Inner City Press was there, the only media there when a rift in the plea agreement emerged. The prosecutors say the guideline is 27 to 33 months, while Washington says it's zero to six months. The differences are based on the loss numbers - which Judge Caproni will have to rule on. There is as yet no sentencing date, just December 26 (the day after Christmas) as a control date.

Back on August 26, 2022 lead defendant Williams pleaded guilty, to a plea agreement that he will not (and now cannot) appeal any sentence 145 months or less. Plea agreement on Inner City Press' DocumentCloud here.

On August 2, in advance of sentencing, the US Attorney's Office informed Judge Caproni that when Williams was arrested on October 7, 2021, "[t]wo SWAT special agents recall that a loaded mazagine was inserted into the Glock 9mm. Neither agent recalls whether the Glock had a bullet loaded in the chamber." There were three more guns.

On August 3, Inner City Press went to the sentencing. Williams got 10 years in prison. Thread.

On September 22, Judge Caproni set the schedule for the trial of remaining defendants, after she set a sentencing date for Telfair: "ORDER as to Sebastian Telfair: WHEREAS the sentencing hearing in this matter is currently scheduled for Friday, November 3, 2023; and WHEREAS this time is no longer convenient for the Court. IT IS HEREBY ORDERED that Mr. Telfair will be sentenced on Friday, January 26, 2024, at 2:30 P.M. in Courtroom 443 of the Thurgood Marshall United States Courthouse, located at 40 Foley Square, New York, New York 10007. The parties' sentencing submissions are due on January 12, 2024 Status Conference as to William Bynum, Ronald Glen Davis, William Washington held on 9/22/2023. Jury Trial to begin November 1, 2023 at 9:00 a.m. Defendant bail conditions continued."

Back on July 25, 2023, Anthony Allen asked for a sentencing of probation, citing philanthropy in including a meeting with (then) Senator John Kerry and Boston students. There is an exhibit of "press clippings of charitable work."

On August 8, Allen got the time served sentence: "Minute Entry for proceedings held before Judge Valerie E. Caproni: Sentencing held on 8/8/2023 for Anthony Allen (3) Count 1ss. Defendant Anthony Allen present with attorneys Scott Resnik, Michael Rosensaft and Ifedapo Benjamin. AUSA Ryan Finkel present. FBI Agent Michael Coughlin present. Defendant sentenced to time-served."

On April 21, 2023 there was a pre-trial conference as to William Bynum (6), Ronald Glen Davis (7), Darius Miles (11), William Washington (21). Inner City Press live tweeted it, thread here:

Judge: I have received that report from Ms. Greenwood [the Coordinating Discovery Attorney in this and other cases]

Counsel: The problem is the Merlin software.

Judge: I can't force the US to turn over the 3500 material early. You could try to turn up the charm [joke] Counsel: It's pushing into the area of being ineffective to your client. We'd like you to encourage them to produce it early.

 Judge: Let's talk about the timing of the trial. There's a terrorism trial [Inner City Press is also covering it, in DDC, here] with a lot of foreign witnesses; there's a need for delay and another judge asking to be accommodated. I will. So...

AUSA: We have a root canal expert...

Judge: Nov 13. But hold Oct 30 open, depending on an Arizona case with an undercover... Expert disclosure by May 26.

On January 30, 2023, co-defendant Milton Palacios was up for sentencing. Judge Valerie E. Caproni noted that he had made, according to the public record, $4.9 million in his NBA career but now owes tax liens. She sentencing him to time served with a $20,000 fine - and a financial literacy class with a two page letter to her.

On February 15, Judge Caproni approved Palacios for travel to Puerto Rico to coach: "dated February 14, 2023 re: Travel for Employment.... For the reasons explained below, we write to respectfully request that the Court issue an order allowing Mr. Palacio to relocate to Puerto Rico so that he can commence his upcoming employment as an assistant basketball coach for the Guaynabo Mets in the Puerto Rican professional basketball league. ENDORSEMENT: Application GRANTED. SO ORDERED. (Signed by Judge Valerie E. Caproni on 2/15/2023)."

Meanwhile this: "ORDER as to Sebastian Telfair. IT IS HEREBY ORDERED that a bail review hearing is scheduled for Friday, February 17, 2023 at 11:30 A.M. The hearing will be held in Courtroom 443 of the Thurgood Marshall United States Courthouse, located at 40 Foley Square, New York, New York 10007. (Bail Review Hearing set for 2/17/2023 at 11:30 AM before Judge Valerie E. Caproni.) (Signed by Judge Valerie E. Caproni on 2/1/23)."

Inner City Press went to the courtroom at that time. Judge Caproni, just finished with a sentencing in the case, told Telfair, I do not want to remand you but I would. She told Telfair to be sure to comply with his conditions, including drug treatment; she noted he was already showing up for mental health treatment. She asked Telfair, What will happen if you do not comply? "You're going to put me in jail," Telfair replied. Judge Caproni nodded and wished him well.

Back on November 29, co-defendant Anthony Allen filed a request to unseal documents the US Attorney's Office has labeled "confidential," which Allen's counsel describe as containing "statements made by counsel for the NBA Plan... explaining that the money allegedly stolen belonged to the players themselves."

Judge Caproni has ordered that "[t]he Government must file its response to Defendant's unsealing request in a letter not to exceed two single-spaced pages."

When the US Attorney's Office filed, it said it "does not oppose unsealing portions of the letters marked as Exhibits A and B... filed under seal."

Jump cut to January 13, 2023. Anderson had missed a December court appearance, and sent letters to Judge Caproni asserting he is no subject to her or US authority. He was arrested on a warrant, and arrested in Westchester County Detention Center via Grady, Oklahoma. His lawyer argued at length for him to be released, but his letters were cited by Judge Caproni to keep him in detention. Will the sentencing have to be pushed back? Watch this site.

The case is against 18 former NBA players "for defrauding the NBA’s Health and Welfare Benefit Plan out of approximately $4,000,000." It was been assigned to SDNY District Judge Valerie E. Caproni.

The line up: Indictment charging TERRENCE WILLIAMS, ALAN ANDERSON, ANTHONY ALLEN, DESIREE ALLEN, SHANNON BROWN, WILLIAM BYNUM, RONALD GLEN DAVIS, CHRISTOPHER DOUGLAS-ROBERTS, a/k/a “Supreme Bey,” MELVIN ELY, JAMARIO MOON, DARIUS MILES, MILTON PALACIO, RUBEN PATTERSON, EDDIE ROBINSON, GREGORY SMITH, SEBASTIAN TELFAIR, CHARLES WATSON JR., ANTOINE WRIGHT, and ANTHONY WROTEN with conspiracy to commit health care fraud and wire fraud, in connection with a scheme to defraud the National Basketball Associations (“NBA’s”) Health and Welfare Benefit Plan out of nearly $4,000,000.  TERRENCE WILLIAMS is also charged with aggravated identity theft in connection with the same scheme.

"When at last the Sam Bankman-Fried trial started on October 3, 2023 with jury selection, after Sam had been remanded to the MDC jail, the courtroom on the 26th floor was full, and an overflow room established on the 23rd.  The author went back and forth between them, and down to the Press Room he'd been admitted to after six months of covering cases here, after he was thrown out of the UN...

"He did not know then how it or he would turn out. It could have been called, Crypto Houdini. But it wasn't." And a second trial?

On November 7 Judge Kaplan issued a two page order explaining his bases for denying SBF's bid to dig into alleged inconsistencies in Gary Wang's and Nishad Singh's prior testimony, the former about "allow negative" and on Singh whether he felt "a pit in his stomach" as he bought the house or after. Judge Kaplan found it "of no moment."

On November 17 SBF's lawyers asked for more time: "On behalf of our client, Samuel Bankman-Fried, we respectfully submit this letter to request an extension until Friday, December 1, 2023, to file our post-trial motions, as well as a corresponding adjustment to the other filing deadlines.
