On OneCoin Greenwood Lost Motion to Exclude Global Losses Now Seals Scott Exhibits

By Matthew Russell Lee, Patreon Podcast Filing

SDNY COURTHOUSE, May 1 -- For money laundering for scam crypto currency OneCoin, lawyer Mark Scott was convicted by a jury after testimony by Konstantin Ignatov and others but was allowed to remain free on bail pending sentencing.

On December 5, 2022, the related indictment against Frank Schneider was unsealed and Inner City Press immediately uploaded it here.

On April 11, 2023, Judge Edgardo Ramos heard argument on, then denied, Sebastian Greenwood's argument that non-US losses should be excluded from his sentencing. Inner City Press was there and exclusively live tweeted, here (vlog here)

OK - now at One Coin argument on if sentencing based on global loss (over $550 million) or only US loss.

Sebastian Greenwood is here, with US Marshals.

Greenwood's lawyer is citing a 2d Circuit case about trafficking of Pakistani heroin, saying including non-US harm in sentencing is plain error. Says, selling OneCoin from Bulgaria to China is not US wire fraud

Judge Ramos: What if the funds are laundered through US wires? Greenwood's lawyer: That's not what happened here. [Greenwood is here in pony tail, witg glasses in MDC beige prison garb]

Greenwood's lawyer says" this is a case of a domestic tail wagging a global dog; he keeps name checking Gilbert Armenta, as money launderer. Armenta's still not in jail.

Judge Ramos: Why can't I consider the global fraud as relevant conduct? Greenwood's lawyer: The Azim case says you can't.

Judge: You should have made that argument before pleading guilty. Greenwood's lawyer: We only pled to what he allocuted to

Assistant US Attorney: OneCoin was global: the funds were laundered through the US, to the tune of at least $700 million, which maxes out the sentencing guideline.

Judge Ramos: Is cryptocurrency a security?

AUSA: That's our position.

Judge Ramos: Has the [2d] Circuit spoken? AUSA: No.

Greenwood's lawyer: In any event, a *fake* crypto can't be a security.

Argument over - Judge Ramos takes 5 minutes (drum roll) Interim story soon. Inner City Press remains on the case(s)

Judge Ramos is back and says: I am denying the defendant's motion. I  am not deciding if crypto is a security. The money laundering was primarily in the US, Mr Armenta and Mr Scott...

   (vlog here)

On May 1, 2023 Greenwood's counsel submitted, absurdly under seal, exhibits from the US v. Scott trial, arguing for a low US loss figure for sentencing.  Meanwhile Armenta, whatever the legitimacy, is still not in detention. Most defendants are not treated this way.

On January 18, 2023, Gilbert Armenta's sentencing was request to be pushed back, yet again, this time from January 24 to February 16.

On January 27 Armenta's lawyer filed a heavily redacted sentencing memo - 12 pages about his crimes are blacked out - asking for a time served sentencing. Memo on Patreon here.

On January 31, Inner City Press filed a two-page motion to unseal - which Judge Ramos endorsed on February 8, with responses due February 10 and a hearing on February 14 at 10 am. Endorsed letter on DocumentCloud here.

(Just) before 5 pm on February 10, the US Attorney's Office filed a letter that Armenta's counsel would be unredacting - but when they did, after 9 pm, it was begrudging, and not enough. Amenta's letter, citing Jen Shah, here on Patreon.

And when Armenta's lawyers put in an after-hours response trying to use Inner City Press' filings on Jen Shah to support secrecy, it still redacted far too much - letter here on DocumentCloud, still too redacted filing on Patreon here.  Now until May, Armenta remains out.

On March 30, the argument on Sebastian Greenwood was delayed: "NOTICE as to Karl Sebastian Greenwood; Oral argument previously scheduled for April 4, 2023, is hereby rescheduled for April 11, 2023, at 2:00 p.m., will be held at the Thurgood Marshall United States Courthouse, 40 Foley Square, New York, New York 10007, Courtroom 619."

Back on March 21, SDNY prosecutors announce unsealing of charges against IRINA DILKINSKA in connection with her participation in the massive OneCoin fraud scheme.  OneCoin, which began operations in 2014 and was based in Sofia, Bulgaria, marketed and sold a fraudulent cryptocurrency by the same name through a global multi-level-marketing (“MLM”) network.  As a result of misrepresentations made about OneCoin, victims invested over $4 billion worldwide in the fraudulent cryptocurrency.  DILKINSKA was extradited from Bulgaria yesterday and will be presented before United States Magistrate Judge Sarah Netburn later today." More on Substack here.

On April 6, after a delay, Dilkinska was brought by US Marshals into Judge Ramos' courtroom. Inner City Press was there, but her lead CJA counsel was not. His stand-in consented to the exclusion of Speedy Trial Act time to July 6, the next conference. Judge Ramos asked, Wasn't much of the discovery provided for the extradition? Apparently not.

The AUSA said he thinks OneCoin is closed in Bulgaria, but there may still be promoters about there. Watch this site.

Back on December 16, on a mere hour's notice, Sebastian Greenwood was brought into court and pleaded guilty to three counts. His sentencing is set for April 5, but there will be briefing on a dispute if the sentencing guideline should be based on US or global losses.

On Patreon, superseding information and
Pimintel letter estimating 720 months both here

Inner City Press vlog here, live tweeted thread here:

OK- on OneCoin and Sebastian Greenwood, headed to hastily scheduled proceeding before Judge Ramos

Greenwood has been brought in, shackled. AUSA Nick Folly is signing papers. Inner City Press the first media here.

Folly apologizes to Judge Ramos' Deputy, somethong about "in 10 minutes." He has a jury out in trip 'n fall scan trial US v Dowd, which Inner City Press is also covering.

Greenwood is sporting a thin mustache and small pony tail / bun. He has a lawyer on each elbow, and 2 US Marshals behind him. Folly just stepped out, with umbrella. Will this proceed without him? Another AUSA just came in.

AUSA Ravi: There is a superseding information that Mr Greenwood will be pleading guilty to. Greenwood's lawyer: Yes. And there is no plea agreement. Judge Ramos: We are starting 20 minutes late.

AUSA Ravi: Mr Folly just had a verdict come in [in US v Dowd]

Judge: Are you being treated for any mental health issue? Greenwood's lawyer: He is having counseling, we could describe it but under seal. He is competent to plead. Judge: You are charged with wire fraud and conspiracy to commit money laundering and wire fraud

Judge Ramos: Maximum penalty (on count 3) is twenty years, more if consecutive - up to 60 years.

Greenwood: I understand. Judge: I could also order restitution to any victims. What is your status in this country? Greenwood: I am an inmate [laughs]. I am a citizen of the UK and Sweden. Greenwood's lawyer: He was arrested in Thailand.

Judge: Separate from the maximums, there are sentencing guidelines. There is a Pimintel letter from the government, estimsting your guideline. It is not a promise. Greenwood: I understand.

AUSA Folly [he's back] OneCoin was a ponzi scheme. Between 2014 and 2016 it made 4 billion Euros, with profits of 2.7 billion. It lacked a real blockchain: it marketed into the US.

Greenwood: I met Ruja Ignatova, we started OneLife, packages including OneCoin. We mis-compared it to Bitcoin. But I knew OneCoin had no intrinsic value. We targeted the US and concealed the source. I knew it was wrong.

Greenwood: I plead guilty.  Judge Ramos: I find you guilty. Sentencing date? Greenwood's lawyer: We disagree on how the guideline apply: worldwide or US-based conduct? We'll brief it.

Greenwood's sentencing is set for April 5 at 2 pm. But before that, briefs on whether sentencing guidelines should be based of global billions, or US only- Greenwood like Scott says $57,000: AUSA says US is tens of millions.

We'll have more on this.

Days earlier on December 12, 2022, the US Attorney's Office wrote to Judge Edgardo Ramos that his OneCoin case is related to another, unsealed this month, against Christopher Hamilton and Robert MacDonald (for whom their request for extradition has been denied in the UK). They are proposing that the cases, and the Armenta Case, be consolidated. Watch this site.

This case, for now, is US v. Hamilton, et al., 18-cr-793 (Broderick)

On June 30, 2022 the US FBI put Ruja Ignatova on its 10 Most Wanted List. Inner City Press went to the FBI press conference and asked about her security chief Frank Schneider saying she's dead, and the status of his extradition.

The FBI's New York Assistant Director-in-Charge, Michael J. Driscoll, told Inner City Press they have their reasons for putting Ruja on the list. US Attorney for the SDNY Damian Williams said he could not speak about extradition(s). Vlog here.

On November 9, 2022, the US Attorney's Office wrote to Judge Ramos asking to again extend the sentencing of Konstantin Ignatov, with a November 10 control date, for yet another 90 days, "because Defendant's cooperation is not yet complete."

On November 10, this: "Set/Reset Hearings as to Konstantin Ignatov: Sentencing set for 2/16/2023 at 02:30 PM before Judge Edgardo Ramos." Watch this site.

On October 25, Gilbert Armenta's sentencing was pushed back (again) to December 16: "ENDORSED LETTER as to Gilbert Armenta addressed to Judge Edgardo Ramos from Attorney Marc A. Weinstein dated October 24, 2022 re: We are writing to request: (i) an adjournment of Mr. Armenta's sentencing, scheduled for October 25, 2022 (ECF 47); and (ii) a corresponding adjournment of the parties' deadlines to file and serve their sentencing submissions. ENDORSEMENT: Sentencing is adjourned to December 16, 2022 at 10 a.m. SO ORDERED. ( Sentencing set for 12/16/2022 at 10:00 AM before Judge Edgardo Ramos. )(Signed by Judge Edgardo Ramos on 10/25/2022)."

And on October 14 for Sebastian Greenwood, yet more delay: "MEMO ENDORSEMENT as to Karl Sebastian Greenwood on [489] LETTER MOTION addressed to Judge Edgardo Ramos from Justin S. Weddle dated October 13, 2022 re: Adjourn Motion Schedule. ENDORSEMENT: The modified schedule is approved. The motion hearing is adjourned to February 1, 2023, at 2 p.m. Speedy trial time is excluded from October 13, 2022, until February 1, 2023, in the interest of justice. SO ORDERED."

On September 6, 2022, Ruja Ignatova's one time lover Gilbert Armenta asked Judge Edgardo Ramos for permission to modify the conditions of his release to allow him to travel from Miami (where Ruja spied on him, and vice versa) to New York City from September 11 to 15 to meet with his lawyers in advance of his much-delayed sentencing now set for October 25.

Judge Ramos endorsed / approved it: "ENDORSEMENT: Armenta is granted leave to travel to New York to meet with his attorneys in preparation for his sentencing. (Signed by Judge Edgardo Ramos on 9/6/2022)." Watch this site.

On August 8, 2022, the US Attorney's Office wrote in: "Re: United States v. Konstantin Ignatov, S7 17 Cr. 630 (ER) Dear Judge Ramos: A sentencing control date is presently set in the above-captioned case for August 10, 2022. Because the defendant’s cooperation is not yet complete, the Government respectfully requests that the sentencing control date be adjourned for approximately 90 days. The defense consents to this application." To testifying against his sister if she is found in the next 90 days?

On July 14, counsel for Gilbert Armenta wrote in with the US Attorney's Office's OK to ask that Gilbert Armenta be allowed out of his apartment four for hours a day: "on behalf of Gilbert Armenta, we respectfully submit this request seeking a modification  of Mr. Armenta's bail conditions to permit Mr. Armenta to leave his apartment from 10:00 a.m.  to 2:00 p.m. on Mondays through Saturdays each week. Neither the Government nor the  supervising Pre-trial Services Office objects to this request." Full letter on Patreon here.

It was endorsed. On July 25, the US Attorney's Office asked to push Armenta's sentencing off off, this time to Oct 25-27. Watch this site.

That case is US v. Armenta, 17-cr-556 (Ramos)

Sebastian Greenwood, meanwhile, is in detention in the MDC and will wait (at least) a year for a trial. And  in April 2022, yet more delay: "MEMO ENDORSEMENT as to Karl Sebastian Greenwood on LETTER MOTION addressed to Judge Edgardo Ramos from Juliana Murray dated 4/26/2022 re: Adjournment. ENDORSEMENT."

On June 21, the US pushed Greenwood's trial to May 15, 2023: "Re: United States v. Karl Sebastian Greenwood, S5 17 Cr. 630 (ER) Dear Judge Ramos: The Government respectfully submits this letter, on behalf of the parties (and with the consent of defense counsel), to make the following scheduling requests in the above-captioned case, subject to the Court’s availability: 1. The pretrial conference scheduled for June 28, 2022 is adjourned sine die. 2. The defendant’s pre-trial motions are due on October 17, 2022; the Government’s opposition is due on November 14,2022; and the defendant’s reply is due on December 5, 2022. 3. Oral argument on the defendant’s pre-trial motions, if any is requested, will be held on December 19, 2022. 4. Trial will be scheduled to commence on May 15, 2023." Letter on Patreon here.

David Pike got a lenient six to 12 month plea deal accepted on October 19, 2021.

On April 25 the long delayed argument on Mark Scott's various post-trial motions was held - and took two and a half hours. Inner City Press went in person and live tweeted it here, vlog here:

now at oral argument on Mark Scott's motions on Konstantin Ignatov perjury, etc.  Scott's lawyer: The US only cited to 3 FDIC-insured banks for bank fraud. Mr Armenta lied repeatedly to Mr Scott

Now Scott's lawyer complains he was not permitted to call Neil Bush as a witness at trial

Judge Ramos: Didn't the OneCoin folks at some point think Scott was a government informant? Arlo cuts off his colleague to answer Judge Ramos. They are arguing that the defrauding of $54,000 is " de minimis"

Scott's lawyer: #OneCoin was outside the US, as were most of its customers. None of the US funds ended up in the Fenero Funds. AUSA: There is no deminimis exception on wire fraud.

AUSA: We put in a video of Ruja Ignatova in 2015 announcing the "openning of the US market."

AUSA: Mr Armenta even had a romantic relationship [with Ruja - Inner City Press published audio Of Ruja's spurned voicemails to Armenta]

Now Judge Ramos turns to Konstantin Ignatov perjury and illegal cell phone in MCC.

Arlo Devlin-Brown: A new trial is required. Arlo cites his sur-sur-sur reply. Irina was in India, he insists. Say Konstantin Ignatov outright lied, about the laptop, as shown by Duncan Arthur. Demands a hearing

Scott's lawyer Arlo Devlin-Brown: One more before I sit down. [But he's been sitting down throughout. Judge Ramos: Putting aside for the moment the law...

Judge Ramos: Does the US consent to having a hearing? AUSA Folly: No. The perjury was not material. [There is another defense attirney in gallery, who spoke a lot with Arlo Devlin-Brown during Folly's break]

AUSA Folly is still going. Scott - still not in prison this long after conviction - is here in the courtroom. And the OneCoin victims?

Now AUSA Folly recounts that Ftank Schneider told Irina D. that Mark Scott might br an informant.  This hearing, now at 2 and 1/2 hours, has gone off the rails. Vlog here

On April 6, 2022 the US Attorney's Office asked for yet more delay in sentencing Gilbert Armenta, this time until July, citing "various forfeiture issues among other sentencing related issues." Hmm.

On March 1, Pike was in court for sentencing. He got two years probation, three months of which have a 7 to 7 curfew. Inner City Press went and live tweeted it, here, then vlog here

Six weeks after Pike was sentenced the US belated filed a draft order to notify OneCoin victims going forward: "MOTION for Victim Rights . Document filed by USA as to Mark S. Scott, Ruja Ignatova, Konstantin Ignatov, David R. Pike, Karl Sebastian Greenwood... While seeking the proposed order earlier in these proceedings would have been preferable, given that there remain a number of charges pending against various defendants, implementing the procedures described therein at this stage of the case is nonetheless appropriate." Filing on Patreon here.

Now One Coin money laundering sentencing of David Pike. DOJ's charge and deal leads to a 6 to 12 month guideline.

AUSA Folly: It should be toward the top. This is a large fraud and Pike participated for nearly 2 years.

AUSA Folly: Scott and Pike were the money laundering duo. After Scott was arrested, Pike lied.

AUSA Folly: Pike got $2 million. Mark Scott got at least $50 million. [Inner City Press: So who got the rest?

AUSA Folly: This was not a one time thing. [Woman two rows ahead of Inner City Press in the nearly empty gallery shakes her head no] Ms Raskin: We reauest a non incarceratory sentence.

Ms Raskin for Pike: Much of this occurred outside of the US. There should be no double counting. Pike believed Ruja Ignatova, Scott's client, was legit. He gradually drawn in.

AUSA Folly: He entered the KYC info from Ruja Ignatova and her team. Pike's lawyer quotes a Miami autism doctor who has written to Judge Ramos. Pike: I would like to apologize to the court and even more to my family. [Those defrauded by OneCoin not mentioned.

Judge Ramos: I sentence Mr Pike to two years probation, with the first three months with location monitoring [7 to 7 curfew] ... I believe that OneCoin is still on the market?

[Inner City Press wonders, How do Scott, and Greenwood, and Schneider awaiting extradiction, and Amr Abdelaziz, and Gilbert Armenta, view this?

On January 19, a French court OK-ed the extradition of Frank Schneider to the US. Order here. Inner City Press in Spring 2021 reported "Frank Schneider, arrested on April 29 in Joudreville in the Pays-Haut Meurthe-et-Mosellan trying to get back into Luxembourg and said to be awaiting extradition. Update: Inner City Press has put questions to the US Attorney's Office - still not answered on this.

On February 23, yet more delay: " MEMO ENDORSEMENT as to Karl Sebastian Greenwood (5) on [457] LETTER MOTION addressed to Judge Edgardo Ramos from Juliana Murray dated 2/23/2022 re: Adjournment. ENDORSEMENT: The pretrial conference is adjourned to April 28, 2022." This after Greenwood switched lawyers. Then delay to June 16, 2022....

Inner City Press previously exclusively reported:  Konstantin: I tried to find where OneCoin had money. I spoke with Frank Schneider. AUSA: Who was he? Konstantin: Ruja got her information about law enforcement investigations from him. He was a money launderer.

Meanwhile, Konstantin Ignatov's sentencing has been pushed back to May and he has a new lawyer...

On January 4, the US Attorney's Office requested that Pike's sentencing, set for January 21, be adjourned for approximately 45 days, citing "health concerns arising from the surging COVID-19 pandemic and related travel complications," and that the time for the pre-sentencing report be extended too.

On September 21, 2021 there was a proceeding on and with Greenwood and Inner City Press live tweeted it here and below (and podcast here)

On October 19, after many postponements, co-defendant David Pike finally pleaded guilty, albeit only to Count 1 of a superseding information. Inner City Press live tweeted it here.

During the change of plea proceeding, Judge Ramos did not read out what the plea deal was, only that Pike had signed it, on August 21, 2021. But the deal is for (only) six to twelve months, and forfeiture of $2,099,330. It states name checks the Fenero Funds, not OneCoin.

Nor does this.

On August 25, 2021 Inner City Press filed a letter with Judge Ramos, cc-ing the prosecutors and Scott's counsel, formally asking that the motion be unsealed - still not docketed as of Aug 30, unlike the practice of other SDNY judges.
(Now on DocumentCloud, here; podcast here).

Vlog here.

On September 13, counsel for Mark Scott and for the US Attorney's Office were told by Judge Ramos' chambers (to its credit), "Judge Ramos directs the parties to respond to this request."

The August 25 letter: Dear Judge Ramos:    This concerns, in the above-captioned criminal case that concerns money laundering for the OneCoin scheme, the request to entirely seal a judicial document requesting a new trial for the defendant. The filing(s) should be unsealed in full, or if the Court sees fit, in part.    I have been covering the case for Inner City Press, see also, e.g., The Guardian (UK), November 25, 2019, "In testimony live-tweeted by the investigative journalism website Inner City Press, Ignatov reportedly referred to Abdulaziz as 'one of the main money launderers' involved in the scheme."

Yesterday, Scott's counsel filed a letter (Dkt 390) requesting a sentencing adjournment based on "the need for the Court to consider and address the Supplemental Rule 22 Motion (including the request for an evidentiary hearing) filed under seal on August 23, 2021." That motion is a judicial document, within the meaning of United States v. Aref, 533 F.3d 72, 81-83 (2d Cir. 2008) and Lugosch v. Pyramid Co., 435 F.3d 110 (2d Cir. 2006) - it should be made available.

Inner City Press routinely files requests to unseal in this District, and other Districts - including as cited in its March 31 request, here  And Judge Broderick's docketing of Inner City Press' request to unseal in US v. Ashe / Piao, 15-cr-706, Dkt No 999 (Inner City Press letter) & Dkt 998 (ordering that sealing be justified or removed by April 9).

And see, regarding public access to allegedly confidential information, Judge Furman's recent grant of Inner City Press request to unseal in US v. Avenatti, 19-cr-374 (JMF), Docket No. 134. See also, July 27, 2021, NYLJ, "Judge Orders Release of Michael Avenatti's Financial Affidavits In Stormy Daniels Theft Case," "Journalist Matthew Russell Lee of Inner City Press had intervened, advocating for the affidavits' release."

(Now on DocumentCloud, here; podcast here).Watch this site.

Inner City Press back on March 13 asked the US Attorney's Office Press Office for its filings not yet in the public docket.  Here is Inner City Press' Periscope video upon leaving the courthouse. The case is US v. Scott, 17-cr-630 (Ramos).

In Extortion of Fire Victims Case Smith Mulled Pro Se But Reverses Course So August 14 Trial

By Matthew Russell Lee, Patreon Maxwell book

SDNY COURTHOUSE, May 1 –  The lead defendant in a criminal case alleging gang extortion in the field of clean-up services to properties damaged by fire asserted his Speedy Trial Act rights.

On September 9, 2022, U.S. District Court for the Southern District of New York Judge Jed S. Rakoff held an in-person arraignment and detention or bond proceeding, with the defendant's family and supporters filling half of the courtroom gallery. Inner City Press was there.

On the request to move up the scheduled May 2023 trial to October, Judge Rakoff said he will speak with Judge Analisa Torres about changing the schedule of her US v. Tim Shea (We Build the Wall) trial. We'll see.

On detention or release, the Assistant US Attorney recited from audio recordings of threatens, saying "N-word, I'm gonna kill you."

The defense lawyer, retained from Staten Island, pointed to those in the gallery and called the threats hyperbole. Judge Rakoff said the defendant clearly had supporters, but was a danger to the community. He was ordered detained.

Afterward by the elevators, supporters said of the prosecutors after they left in a separate elevator, "They lie."

Jump cut to March 27, 2023, when Judge Rakoff convened a Curcio hearing on the lead defendant. In short order he ruled, there is no conflict, and adjourned the proceeding. Ten days prior, Judge Rakoff had denied this request to suppress the forensic copy of his phone, taken after he was denied entry into Jamaica and was found with $10,000 upon his return.

Back on September 13, Judge Rakoff held a proceeding with co-defendants. The lead defendant Jatiek Smith applied to move his trial from October 17 to November 28 was granted, and three co-defendants were allowed to join him for trial beginning that date, one with a new lawyer. The others remain for trial on "5-1-22," which we take to mean May 1, 2023.

On April 27, Jatiek Smith appeared before Judge Rakoff, seeking to go pro se. His CJA lawyer, it was said on the record, collapsed in the subway; Inner City Press is voluntarily not report further medical details.

Jatiek Smith said he is tired of waiting for lawyers; he said, "You view me as an animal, so I'll just do it myself."

Judge Rakoff pointed out that the first CJA counsel's sickness was not his fault.

Then Jatiek Smith asked for the courtroom to be cleared to speak about his experience with his lawyers. Inner City Press did not contest the sealing; it stood by the elevators with six AUSAs and, separately, supporters of Smith. When summoned back in, it was put on the record that Smith will communicate by 5 pm on May 1 if he wants to go pro se - in which case trial would start May 8 or 15 -- or continue with another CJA lawyer, or two, on August 14, moved up in the sealed session from September 19.

It emerged that 3500 material and other discovery cannot be shared with Smith on the same timeline as other defendants, which would impact his ability - and Constitutional right - to represent himself. It was unclear how or if this was addressed in the sealed session.

Thing became clearer on May 1, when the trial date (and representation) were set: "ORDER as to (22-Cr-352-1) Jatiek Smith. On 4/27/23, the Court held an in-person conference with Jatiek Smith, his then-primary counsel Thomas Nooter and co-counsel Jill Shellow, and prospective counsel Andrew Patel, as well as counsel for the Government. See 4/27/23 Hr'g Tr. As discussed further on the record during that proceeding, severe and unexpected medical setbacks that had very recently arisen affecting Mr. Nooter's health meant that Mr. Nooter was no longer able to try this case (previously firmly set to begin on 5/1/23) in the foreseeable future. And the Court agreed with Ms. Shellow's representation that, given this case's substantial complexity (involving, inter alia, gigabytes of discovery, numerous fact witnesses, multiple months of wiretap recordings, and more) and her prior expectation that she would be proceeding only as co-counsel assisting Mr. Nooter, ensuring effective representation for Mr. Smith required delaying trial long enough to enable Ms. Shellow to adequately serve as primary counsel and for prospective co-counsel to get up to speed on the case. Ms. Shellow, after reaching out to several potential co-counsel who were unavailable, identified highly qualified co-counsel, Andrew Patel, who was willing to step in. However, Mr. Patel's other commitments coupled with the need to get up to speed on this case did not allow him (and Ms. Shellow) to be ready to try this case until August 14, 2023 (the very earliest date available to both counsel and the Court). Nonetheless, at the hearing, Mr. Smith initially expressed reluctance to delay trial and a preference to instead proceed with trial as previously scheduled representing himself pro se, and the Court informed Mr. Smith it would appoint Ms. Shellow as stand-by counsel to assist him if he wished to proceed prose for a trial in May. However, following an on-the-record (but sealed) colloquy regarding the risks of going prose, Mr. Smith asked for some time to further consider the issue. He has since written the Court (in a letter that has been docketed separately, see dkt. 211) stating his preference to remain represented by Ms. Shellow (as primary counsel) and Mr. Patel (as co-counsel) and proceed with an August 14 trial date." Watch this site.

The overall case is US v. Smith, et al., 22-cr-352 (Rakoff)

Trump Lawyer Asks Carroll of Not Screaming as Objections Sustained at SDNY Cross Ends

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, May 1 – When E. Jean Carroll testified on April 26 on direct examination about Donald Trump allegedly raping her in Bergdorf Goodman's in 1996, then defaming her in 2019, Trump's lawyer Joe Tacopina repeatedly objected.

U.S. District Court for the Southern District of New York  Judge Louis A. Kaplan denied most objections - and told Tacopina that his client might be subjecting himself to liability under other Federal statutes with his posts on Truth Social (and his son Eric's statements).

Now early on May 1, Trump's lawyer Tacopina has filed an 18-page motion for a mistrial. Motion on Patreon here.

Inner City Press live tweeted the direct testimony, thread here

Then on April 27, the cross examination, here

On May 1, the cross examination continued, concluding with re-direct and re-cross. Tacopina asked about the failure to scream, and what he called four reasons given. Many more objections by Carroll's counsel were substained. Thread here.

OK - Carroll v. Trump trial resumes now, after sealed filings (Inner City Press has written to the Court seeking to unseal  Judge Kaplan: The motion I found on my desk this morning from the defense, has that now been filed? Yes.

[But what about the sealed submissions, and Inner City Press' request to unseal? documentcloud.org In Trump Civil Trial, Motion to Unseal Carroll Filing of Sunday Night As Inner City Press Cites...

Judge Kaplan: Bring in the jury. Jury entering! Judge Kaplan: Ms. Carroll, you're still under oath. Proceed. Tacopina: Ms. Carroll, you continued to shop at Bergdorf's after the 1995 or 1996 event you describe? Carroll: Yes.

Tacopina: You went into dressing rooms? Carroll: I don't believe so. Tacoplina: I refer to Ms. Carroll's deposition of Jan 31 of this year, you said you would go into the changing room... Carroll: I think I was thinking about my niece, it was all a changing room

Tacopina: Since 1995 or 1996, you've been many purchases from Bergdorf's? Carroll: Not necessarily many, but several. Tacopina: I'm going to put up Exhibit AY - this is your document? Carroll: Yes a QuickBooks document by my sister Candy.

Tacopina: So there are four purchases - fair to say you were not afraid of going to Bergdorf's? Carroll: Correct. Tacopina: And at your niece's fitting, you had champagne with Lisa Birnback, the person you told about the alleged rape - and never thought about it?

Carroll: A vision may have streaked through my brain. This was a happy occasion. I wasn't there to remember the time in the dressing room in 1996. Tacopina: Did you talk about it with Lisa [Birnbach]? Carroll: No.

Tacopina: You remember the Apprenctice show? You were a fan? Carroll: Yes I was impressed. Ambitious young business people competing, that's what I liked. Not him firing people. Tacopina: But you posted that you were a big fan... Carroll: 2 of my friends were on

Tacopina: This Facebook post says, Would you have sex with Donald Trump for $17,000 if he couldn't speak - you joked around about this, right? Carroll: Yes.  Tacopina: You joked about having sex with Mr. Trump 5 years before. Judge Kaplan: We all know the math.

Tacopina: Your book, it has a list of hideous men? Carroll: It is a dark satire. Tacopina: According to you, it does not even include all the men you say assaulted you? Carroll's lawyer: Objection!

Judge Kaplan: Members of the jury, please go into the jury room.

Judge Kaplan: Mr. Ferrara? Ferrara: We've briefed to the course about prior sexual experiences. The question could elicit that... It is not appropriate for the jury to know of assaults outside the book, even some in the book. Tacopina: That was the question

Tacopina: She testified to the 21 most hideous men, it seemingly not including all those who apparently assaulted her. I can tell you the next questions.... Judge Kaplan: I want to hear your argument. Tacopina: It does not violation 412. Her book was in the direct

Judge Kaplan: There are cases saying that non consensual sex is covered by t412. So why would an answer this question be permissible? Tacopina: OK, I will withdraw the question... Carroll's lawyer: The book as a whole is not in.  The attacks by JJ and Moonves, yes

[JJ is John Johnson, who strangling of Carroll is described in the book - Geraldo was staying over too] Judge Kaplan: Brong the jury back. Tacopina asks about deposition answer [Deposition played]  Q: Did you report any of these assaults to the police? Carroll: No

Tacopina: So you didn't call the police? Carroll: I was a member of the silent generation. I only called once. I was staying in a farm house and kids hit Helen Hayes' mailbox. I called the police because I thought they were marring it. My only call to the police

Tacopina: So you would call the police about a mailbox, but not about being raped? Carroll: I would not call about something I was ashamed of. Tacopina: Strike as non-responsive. Carroll's counsel: It provides context.

Tacopina: But in your column you advised readers to call the police? Carroll: Yes. Tacopina: Let's go through some snippets. Ask E. Jean of May of 1994, you advised a reader, you gave the NY rape hot line number. Carroll: I always advised that

Tacopina: Here's another advise column, August of 2006, do you recall that? Carroll: Yes Carroll's lawyer: Nothing on the exhibit suggests a date. Tacopina: Please highlight the section. Carroll: It's an undated document. Judge Kaplan:  This is cumulative, move on

Tacopina: This one has a date in 2016, do you recall this? Carroll: Yes. Tacopina: You advised to call the police due to threatening emails? Carroll: Yes. Tacopina: May of 2017- Carroll's counsel: Objection! Cumulative! Judge Kaplan: Granted.

Tacoplina: You say Donald Trump accused you of lying about rape to increase book sales and carry out a political agenda, & you claims it's false? Carroll: Yes. Tacopina: But the story was in the book to market it? Carroll: At 76, I was no longer going to be silent

Carroll: I do not like Donald Trump and I thought that he was a terrible president. Tacopina: Carol Martin asked if she could be reimbursed for her travel from New Jersey to New York? Carroll: Yes. Tacopina: I'm going to show you exhibit BS [There is laughter]

Tacopina: Shortly after that, you replied in sum and substance that you would have that taken care of? Carroll: I had no idea how it would be taken care of. But I wanted to assure her, she was worried about costs of bridges and parking, she's on a fixed income

Carroll: I believe they had a Zoom meeting, so there were no costs. Tacopina: Then Carol Martin said, No more chats or texts -- Carroll's counsel: Objection. Not in evidence. Tacopina: It goes to state of mind. There's a response. Carroll's counsel: We object

Judge Kaplan: Let me see it...  Tacopina: The emoji doesn't show up on the print out, if you see -- Judge Kaplan: Never assume that I know about things like that. I don't think this comes in. Sustained. Tacopina: Was Carol Martin's counsel Noam Biale-- Objection!

Judge Kaplan: Sustained. Tacoplina: Mr. George Conway said you should seriously think about suing Donald Trump? Carroll: No. Tacopina: Let me read from your deposition... You said, I had a conversation with an actual lawyer who said, You should think about it?

Carroll: He explained to me the two ways, yes. Tacopina: You are aware of Mr. Conway's view of Donald Trump? Carroll: Yes. Tacopina: He recommended you to an attorney who you met two days later? Carroll: Yes Tacopina: You met with Carol and Lisa with the attorney?

Carroll: We had a dinner together. It wasn't an official meeting. Tacopina: It's your testimony you chose to sue Donald Trump because he called you a liar? Carroll: He did more than that. Tacopina: I'm going to play from a deposition...

[From deposition: Carroll: He called me a liar and I couldn't let it stand] Tacopina: In the book you also say Les Mooves of CBS assaulted you? Carroll: Yes.  Tacopina: He's on your most hideous men list?

Carroll: Yes Tacopina: You accuse him of going after you like an octopus while having an erection? Carroll: I wrote octopus, not erection Tacopina: You wrote that he was "pricking" Carroll: Yes Tacopina: Les Moonves denied it? Carroll: To NY Magazine. He said it never happened

Tacopina: He called you a liar. Carroll: He just denied it. He didn't grind my face into the mud like Donald Trump did. Tacopina: You didn't sue Les Moonves -- Judge Kaplan: This certainly sounds repetitious. You asked this before.

Tacopina: If Donald Trump had said it was consensual, you wouldn't have viewed it as him calling you a liar? Carroll's counsel: Objection! Argumentative! Calls for speculation! Judge Kaplan: Sustained. Tacopina: Let me play the deposition

[From deposition, Q: If he said it was consensual, he wouldn't be calling you a liar? Carroll: Right.] Carroll's counsel: We need 7 more lines, under the rule of completeness. Judge Kaplan: Sustained. [From deposition: Carroll: at 80 I expect nothing] I

Carroll: At least it would have been Donald Trump admitting that he was there.  Tacopina: Is this a good place to take our morning break? Judge Kaplan: Yes. 15 minutes.

OK, they're back. Judge KAPLAN: What evidentiary treats do we have in store? Tacopina: We seek to introduce this for Ms. Carroll's state of mind, not that of Ms. Natasha Stoynoff... Judge Kaplan: If I had a hard copy, we could have a record.

Tacopina: Here is exhibit BT.  Judge Kaplan: What's on the screen is just a subset. What you have up here now is the entirety of Page 21. This isn't put together. Tacopina:  I'll read it to you- Judge Kaplan: It ends somewhere on page 31? Tacopina: No. On page 23

Judge Kaplan: I understand what you are trying to do. Ms. Carroll asked Ms. Stoynoff if Donald Trump rubbed his body against her. You are trying to say Ms. Carroll was trying to suggest that Ms. Stoynoff quote unquote remember the event.  At 21, I don't recall...

Judge Kaplan: on the next offered page, she got, I don't think so. Then at page 37, she got If he did I can't remember it, I'm trying to think. Tacopina: The first time she said, I don't recall him doing it. And second, if he did, then...

Judge Kaplan: You should do this in 5 minutes. Let's get the jury. Jury entering! Judge Kaplan: Sorry for the longer than expected interruption. I think we have solved things that will save time. We are on or ahead of schedule. Proceed.

Tacopina: You were assaulted several time but only sued Donald Trump? Carroll: Yes. Judge Kaplan: Ladies & gentlemen of the jury, there are two lawsuit. The first was brought solely for defamation. At that time Ms Carroll could not sue him for allegedly raping her

Judge Kaplan: The law changed. She sued on that, and on the new defamation. Don't worry about the first case. Let' go. Tacopina: Ms. Carroll, you asked Ms. Stoynoff if Mr. Trump grinded on you - and she said, I don't recall -- Carroll's counsel: Objection!

Judge Kaplan: Sustained. Tacopina: After getting that response, you-- Carroll's lawyer: Objection! Judge Kaplan: Sustained.  Tacopina: OK. After your book excerpt you were contacted by Anderson Cooper and appeared on CNN - I'm going to play an 8 minute clip.Video playing (available on YouTube, in some placed edited...]

In courtroom: "Most people think of rape as being sexy." "Let's take a break." "You're fascinating to talk to." Tacopina: Most people don't of rape as something sexy. Do you? Carroll: Game of Thrones shows nine rapes, 50 attempts. Rape is everywhere in our entertainment world. It excites people and draws an audience. Hence I said, Most people think of rape as sexy... But to me, rape is the more violent act that can be done

Tacopina: Ms. Carroll, are you aware there is a Law & Order episode that -- Carroll's lawyer: Objection! Judge Kaplan: Come to the sidebar.  [Whispered, non-public sidebar ensues]

They're back. Tacopina: You are aware there is a Law & Order episode from 2012 about rape in a Bergdorf Goodman's fitting room? Carroll: I am aware. Tacopina: You are a fan of Law & Order? Carroll: Yes, but not SVU, it's too violent.

Carroll: It's an astonishing coincidence. Tacopina: And you didn't tell the writer of the episode about your story? Carroll: No. Tacopina: You don't blame Elle Magazine for firing you? Carroll: I understood it. But I was forlorn. They let me go after 27 years.

Tacopina: You are aware Elle Magazine says it was a business decision? Carroll: I agree that it was about business -- Carroll's lawyer: Objection! Judge Kaplan: Sustained. Tacopina: It's in a deposition...

Tacopina: You sent an email to your agent that after Nina Garcia, the editor of Elle, took over they cut your salary from $10,000 to $5000 a column. You were looking to get out of your contract, right? Carroll: I was looking for other work. At the Atlantic.

Carroll: My column used to be in the well of the magazine. The new folks moved it around. They also buried it online.  Tacopina: They were mad you published your book excerpt in New York Magazine? Carroll: Yes.  Tacopina: That was Nina Garcia? Carroll: Yes.

Carroll: When the president of the US called me a liar for three straight days, my trustworthiness crumbled.  Tacopina: In your email to your agent, you said Nina Garcia loathed you? Carroll: Yes.  She hated me and she loathed me.

Tacopina: Let me refresh your recollection. Page 187 to 189.  Just read it - [Carroll starts reading out loud] Judge Kaplan: No, no, this is just to refresh. Tacopina: It's that Elle didn't feel comfortable-- Carroll's lawyer: Objection! May we approach? A: Yes.

After a whispered sidebar, they're back. Tacopina: Let me know you a deposition from October 2022. Carroll's lawyer: We object to the hearsay in this. Judge Kaplan: Sustained. Tacopina: I'll move on to damages. Mr. [John] Johnson was your last relationship?

Tacopina: And you testified you haven't had sex since what you say happened with Mr. Trump? Carroll: Yes. Tacopina: You were asked, Have you had any relationships since? You said No, because Donald Trump raped me. Carroll: Yes. Tacopina: I'll show you AQ

Judge Kaplan: Do you have a hard copy? Tacopina: Just a moment. The good news, your Honor, is that this is going to be the last time we'll be doing this. Carroll's counsel: We would not object. Audio: Carroll: Maybe I didn't have sex since because I lacked luck

Judge Kaplan: You didn't play the whole excerpt. Tacopina reads more, about Carroll not meeting the right person. Then asks, You're now asking for emotional damages from the alleged rape? Carroll: Yes.

Tacopina: You wrote, I am fine, I never suffered. That was the public E. Jean, not the private? Carroll: Yes. Tacopina: That was from your book? Judge Kaplan: That's established. Carroll: I didn't reveal my whole self, I held something back.

Carroll: I put on the go get 'em face that I've always had. Tacopina: Your perception only started to change in 2017? Carroll: I was coming to understand some terrible things. Tacopina: It was the MeToo movement and the Harvey Weinstein story? Carroll: Yes

Judge Kaplan: Mr. Tacopina are we getting close? Tacopina: Close. Judge Kaplan: Define close. Tacopina: 10 or 15 minutes. Judge Kaplan: Let's take a break. Thread will continue.

They're back. Judge Kaplan: Mr. Tacopina, you said you'd be done by lunch. Tacopina: It got a little complicated. I haven't had lunch Judge Kaplan: You want to keep you hungry (laughs). Your colleague could get your Kansas City ribs.

Jury entering! Tacopina: On Jan 31, 2023 you testified things changed in 2016? Carroll: I had to get used to seeing Donald Trump everywhere. Tacopina: I'll show you defense exhibit CU.  Judge Kaplan: Can we move this along? Tacopina: We've moved a lot

Tacopina: We're putting in this Instagram post. It's about the hideous men of NYC walking tour. What's that? Carroll: NYC has a best walking tours. So I thought of one about hideous men. You'd start at Tiffany's. Women were told not to speak at meetings.

Carroll: Then we'd go to NBC, then Fox News, then CBS. Then where Studio 54 was.  Tacopina: You posted this picture with the man in the Donald Trump mask. You're smiling. You're having a wonderful time? Carroll: It was a very instructive tour.

Tacopina: One last podcast. [On audio, Carroll says, it's been fabulous.] Tacopina: No futher questions. Judge Kaplan: Re-direct. Carroll's lawyer: Have you had negative moments? Carroll: Yes but I've never mentioned them.

Carroll's lawyer: How do you feel about having found some happiness later in life? Carroll: I feel good about it. That's the goal of all of us in this courtroom, to find a little bit of happiness.... This is a satisfying moment for me, to be here (voice breaks)

Carroll: When people ask me how I am, I'm more concerned with them. I don't want to, as they say, unload on them. Counsel: You said your desire for desire was killed. Carroll: I believe in luck. You make your own. I was getting in my own way. I did not flirt.

Carroll's lawyer: Did you ever see that Law & Order SVU episode? Carroll: No. Carroll's lawyer: Mr. Tacopina asked you, Why didn't you scream, yes? Carroll: I was amazed that a woman be asked that in 2023. Tacopina: Objection! Judge Kaplan: I'll allow it.

Counsel: Why didn't you take your own advice? Carroll: Donald Trump was very powerful. Women of my age just took our licks and went on. I've looked this up, at the National --

Tacopina: Objection!

Carroll's lawyer: OK, how many men on your hideous men list? Carroll: 21. Counsel: How old are you:  Carroll: Almost 80. Most of the men I've met are not hideous.  Counsel:  Ever a doubt Mr. Trump penetrate you with his fingers? Carroll: No doubt

Carroll's lawyer: Plaintiff offers Exhibit 52.  Judge Kaplan: Received. Carroll's lawyer: It's an email from Steph, what does it stay. Carroll: It says, You're going to get hurt. Carroll's lawyer: No further questions.

Judge Kaplan: Any re-cross? Tacopino: Briefly. Ms. Carroll, are you happy? Carroll: With overtones. Tacopino: I am not judging you for not screaming, but for given four reasons. Judge Kaplan: Jury will disregard. Not an appropriate question. Move on.

Tacopina: You prepared with a list of Q&A, anticipating you'd be asked why you didn't scream? Carroll's lawyer: Objection. Argumentative. Judge Kaplan: Sustained. Ms. Carroll you are excused. Jurors, tomorrow 10 am.

Switzerland as UNSC President Leaves Press Questions Unanswered As Cavorts with GMaxer

By Matthew Russell Lee, Patreon Maxwell Book

UN GATE, May 1 – With Switzerland taking over presidency of the UN Security Council on May 1, 2023, Inner City Press wrote to the Swiss Mission to the UN to request access to its May 1 and all other press conferences by Ambassador  Pascale Baeriswyl.

To submit the request, Inner City Press wrote to the Swiss Mission at its UN Blue Book address and at the UN email addresses listed by its purported partner - that is,     newyork.un [at] eda.admin.ch and pierre.gobet [at] eda.admin.ch

From the Swiss Mission, nothing at all. The Ambassador took softball questions from, among others, a UN Correspondent who did a fundraiser with convicted global pedophile Ghislaine Maxwell. Video here.

Inner City Press asked the SwissMission, and the UN, about Sudan and the abandonment of UN national staff, about Daniela Bas, and the MONUSCO scandal - sex for UN Volunteer jobs paid with taxpayers' funds - in the DRC Congo. Inner City Press exclusive here. Also: "On December 2, 2022 I was told to file an appeal with DSS and I did on December 5 - you should ensure response (there has been none) and granting. See here."

This while Inner City Press is banned from entry, which it had for years until it exposed UN corruption. No response to this July 2021 appeal. Impunity.

Inner City Press will be covering the Swiss presidency, quite actively, this month.

Our requests and questions remain; we will publish any responses, and also on non-responses. Watch this site.

In Trump Trial Motion to Unseal Carroll Filing of Sunday Night As Press Cites Public Interest

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, May 1 – When E. Jean Carroll testified on April 26 on direct examination about Donald Trump allegedly raping her in Bergdorf Goodman's in 1996, then defaming her in 2019, Trump's lawyer Joe Tacopina repeatedly objected.

U.S. District Court for the Southern District of New York  Judge Louis A. Kaplan denied most objections - and told Tacopina that his client might be subjecting himself to liability under other Federal statutes with his posts on Truth Social (and his son Eric's tweets).

On Sunday April 30 Carroll's lawyer docketed a letter referencing a sealed filing: "On the morning of Thursday, April 27, 2023, the Court held a brief proceeding under seal concerning an issue that had arisen during trial. During that proceeding, the Court invited further briefing. Plaintiff now files such briefing and corresponding papers, and respectfully requests leave to file them under seal given the nature of the issue. Plaintiff further respectfully requests that any subsequent filings and hearings relating to Plaintiff’s motion be under seal as well."

Early on May 1, Inner City Press submitted to the Court and parties a request to unseal, for now on its DocumentCloud here

First Republic Given to JPM Chase by FDIC Despite Antitrust and Dimon Epstein Link

by Matthew Russell Lee, Patreon Book Substack

FEDERAL COURTHOUSE, May 1 – After the failures of Silicon Valley Bank and Signature Bank in New York, now it's First Republic Bank.

At 3 am Eastern time on May 1, the First Republic (and $13 billion) was given to JPMorgan Chase, which is already over the "maximum" 10% of US deposits threshold - and whose CEO Jamie Dimon has been ordered deposed about his knowledge of, and link to, the pedophile conspiracy of Jeffrey Epstein. It's come to this.

The JPM Chase complaint is on Patreon, here.

On March 20, 2023 U.S. District Court for the Southern District of New York Judge Jed S. Rakoff in a bottom line order dismissed some but not all claims, in the Epstein-related cases against JPMC and Deutsche Bank.

Inner City Press,, which reports daily on the SDNY (and the Community Reinvestment Act evasions of Chase and other banks like KeyCorp) put the order on its DocumentCloud here.

April 30, 2023 piece on JPM Chasing First Republic amid WHCA glitz and the E. Jean Carroll v. Trump trial, on Substack here

There was no public input into the sell-off, including into how many of First Republic's 84 branches for example in New York City will be closed.

Back on April 18, after a telephone conference without transcription, Judge Rakoff ordered: "Jamie Dimon should be set aside two days for his deposition. On the first day, plaintiffs will have the opportunity to depose Mr. Dimon for a combined total of five hours. Mr. Staley will have the opportunity to depose Mr. Dimon for two hours. If, at the end of the first day, any party believes that it needs more time to depose Mr. Dimon, it must convene a joint call to Chambers by no later than 5:00 PM to explain why. The Court will then rule as to whether Mr. Dimons deposition should continue for a second day and, if so, for how long."

Will that call be open to the press and public?
