SDNY COURTHOUSE, Sept 4 – A woman charged with phoning in bomb threats to 26 Federal Plaza when inquiring about her Green Card and A-Number pleaded guilty on March 10 to misdemeanor "assaulting an employee of the US" - a misdemeanor.
The March 13, 2024 complaint said she made 14 bomb threats in eight calls. The guilty plea is to only count one of an information, about February 1, 2045.
On August 6, her sentencing - her Federal Defender is asking for time served - was pushed to September 5. Her bail was revoked and she was remanded to the MDC.
On August 28 the Federal Defender wrote in that in her next appearance she will be asking out of the MDC to, among other things, work with her immigration attorney to "address the ICE warrant surreptitiously issued on August 5, 2025 and any attendant removal proceedings."
September 5 was changed to September 4 and Inner City Press went. Magistrate Judge Lehrburger granted the requested sentencing delay - asking for audio of the threats - and ordered her released. HSI / ICE agents were in the courtroom and Judge Lehburger ordered that she not be moved out of SDNY / EDNY, and declined to stay that part of his order.
The case is USA v. Serna Theran, 1:25-cr-95 (Lehrburger)
