ICE Is Sued Under FOIA For Human Smuggling Handbook, Claims Good Faith, In Camera

SDNY COURTHOUSE, August 17 – U.S. Immigration and Customs Enforcement has been sued for non-response to a Freedom of Information Act request for its handbooks on human smuggling, counter-terrorism and its Narcotics and Transnational Organized Crime Rewards Program.    

      On August 17, U.S. District Court for the Southern District of New York Judge Jed S. Rakoff held a proceeding. Inner City Press covered it.

   ICE not surprisingly says it has acted in good faith. Judge Rakoff set a briefing schedule, including time for a reply and then sought to choose a time for argument.

 October 19 he was told he has both a criminal and a civil jury trial and something else at 4 pm.

He quipped, What are you guys doing at midnight?  

On October 29 Judge Rakoff held an oral argument, which Inner City Press again covered. At the end, Judge Rakoff again joked, this time that he was looking forward to reviewing documents "in camera." And he will.

The case is Brennan Center For Justice v. U.S. Immigration and Customs Enforcement, 21-cv-2443 (Rakoff)
