In Jan 6 Case Yoga Studio Owner Mariposa Castrol Pleading Guilty May Face Deportation

FEDERAL COURT, Oct 26  -- On November 24, months after the DC Circuit's decision in US v. Munchel, DDC Judge Reggie B. Walton Jackson had before him the case of Capitol breach defendant Mariposa Castro. Inner City Press live tweeted it here (podcast here) (TV Q&A here)

The defendant is before Judge Walton, set to plead guilty. She is 49, a yoga studio owner from Gilroy, California. Mariposa Castro is pleading guilty to Count 4, parading. She promotes her yoga studio and tea lounge.

The issue arises whether in cases like this, Supervised Release is possible. If not, will Judge Walton when sentencing comes impose jail time on Yoga Studio?

 This is a "petty" offense. Seems no Supervised Release will be possible, as clarified (Judge Walton is said) by the Torres case. He's told that Probation might be possible.

 AUSA: "Castro continued uploading videos throughout January 6 from inside the Capitol. She knew she did not have permission to be there. She paraded or picketed."

Judge: Do you agree? Mariposa Castro: Yes. 

Judge: Have you discussed the immigration consequence? Assistant US Attorney: She is not a citizen. She is here legally. Judge: The government could choose to try to deport you. Castro: I understand.

 Judge: How do you plead, guilty or not guilty? Castro: Guilty. Judge: Did she damage any property? AUSA: No Judge: Any assaultive conduct that day? AUSA: No.

Walton: I am concerned you were gullible enough to do this at your age.

Castro: I will not do it again.

Judge Walton: A woman of your age, climbing through a window. You saw what happened to that other women, climbing through the window and she got shot.

 Judge: What state is she in?

Defense lawyer: She is now in Tennessee. She was in California but now has moved to Tennessee with her husband.

Judge Walton: Sentencing is Feb 23. Adjourned
