Third Trial for 1979 Murder of Etan Patz Green Lit by NYS Justice Rodney After SDNY Ruling

SDNY COURTHOUSE, April 20 –  When and if will Pedro Hernandez be retried for the 1979 kidnapping and murder of Etan Patz?

These questions were the subject of a hearing on October 14, 2025 before U.S. District Court for the Southern District of New York Judge Colleen McMahon. Inner City Press was there. Thread

Afterward Judge McMahon ruled that "a reasonable period for preparing this case for retrial extends from July 21, 2025 (the date on which the Second Circuit issued its decision) to and including June 1, 2026. If jury selection does not commence by June 1, 2026, Hernandez must be released pursuant to the writ" - 8 page order on Patreon here

Now in April 2026 NYS Justice Michele Rodney has declined to dismiss the charges against Hernandez and so green-lit the trial, ruling that what "It is true that the delay from [when] Etan Patz disappeared until [Hernandez] was arrested … was an extremely long period of time… law enforcement had no reason to suspect [Hernandez].” Inner City Press will continue to report on the case(s), both in 100 Centre Street and SDNY.
