In Jan 6 Case Zachary Rehl Argues For Return to Row House and His Parler Messages But No Decision

FEDERAL COURT, Nov 2 -- On November 2, months after the DC Circuit's decision in US v. Munchel, DDC Judge Timothy J. Kelly had before him the case of Capitol breach defendant Zachary Rehl, seeking to re-open his detention hearing and ultimately win release like Thomas Sibick did before Judge Amy Berman Jackson the week before. Inner City Press live tweeted that here (podcast here) (TV Q&A here).

now in Jan 6 case of US v. Zachary Rehl (described as leader of the Philadelphia Proud Boys) on his motion to be released from detention and other motions.

Defense: On July 1, the initial order to release Zachary was reversed - but without any new information. Then the court received a letter from Zachary Rehl about dissatisfaction with his counsel, for not communicating with him.

Rehl's (new) lawyer: This is a unique case. Without communicating with Zachary Rehl, you wouldn't know what he disagrees with. So the record was silent... I think the photographer just thought it was cool to zero in on Zach and Nordean with the bullhorn

 Rehl's lawyer: The grand jury didn't find Mr. Rehl to be a leader. There's just a photo of him with a bullhorn. Judge Timothy J. Kelly: Their argument that he's a leader is based on more. Isn't it a fair characterization of what is in the indictment as leadership?

 Rehl's lawyer: They've wrongfully accused him of being the leader of an event where 500,000 people showed up. They say Rehl is guilty because Domenic Pezzola broke a window.

Rehl's lawyer: I need to see the conversations. His electronics were seized so we don't have them. They quote him, "This is what patriotism looks like." But what did "this" refer to? Mr Rehl says, to the crowd. We need the whole conversations. [That is, discovery]

 Rehl's lawyer: They say Congress recessed at 2:20. But another defense lawyer looked it up and saw it was 2:18. Rehl went in unequipped and equivocal... He could be released. He lives in a modest row house.

 Rehl's lawyer: I wish there were some kind of half-way house that could monitor people. But there must be some way to release him. 

Judge Kelly: Let me hear from the government, noting that you do have a right to discovery. Let's here on detention, or re-opening AUSA: I don't know if we're going to lose Mr. Rehl. These usually are only for an hour. [So, 10 to 10:56 am]

Judge Kelly: I was not aware of that.

10:58 am: AUSA: There is nothing new in the filings. There was no reply brief. The court judged Mr. Rehl should be detained. There is no basis to disturb the determination. In terms of prior counsel's work, it wasn't in the briefing. We're working with new counsel

AUSA: In terms of statements on Parler -- Judge Kelly: If you don't have them, you don't have any obligation to produce them. I'm not going to resolve the detention motion today, but soon.

 Judge Kelly: For now, multi-defendant trials can only be held in the ceremonial courtroom. Your motion for a bill of particulars will be addressed at further date. The parties are dismissed.
