FEDERAL COURT, August 27 -- Months after the DC Circuit's decisions in US v. Munchel and more recently Tanios, on August 27 DDC Magistrate Judge Robin Meriweather had before her Capitol breach defendant Uliyahu Hayah.
Hayah is portrayed in the Capitol in a gas mask on January 6, 2021. But Inner City Press published local reports of his arrest in 2017 for waving a gun on Interstate-90 in Maryland; one site called him the "Raging Muslim" a/k/a Lemon. He was and remains detained. Now Jan 6 case of US v. ULIYAHU HAYAH - sealed complaint on Aug 25 (signed by Judge Harvey), arrested on Aug 26, now Aug 27 before Judge Meriweather
Hayah is only by phone, not video. Apparently they don't have video / laptops in the jail he's in. Judge Meriweather: It's an 8 count complaint. You would face eight years and a fine of $250,000.
Googling during the presentment, it seems local news called him or someone with same name "Raging Muslim" in 2017 waving gun on I-95 - now *this* brings up 404(b), cited earlier today: Raging Muslim Was Armed to the Teeth When Nabbed After Pointing Gun at Woman on I-95, here
Of course, Hayah is not yet up on DOJ's "Capitol Breach Cases" list. Hayah is seeking court-appointed counsel. Judge: Do you make $75,000 a year or more? Hayah: No, ma'am Judge: $50,000 in bank Hayah: No. Judge: Eligible for court appointed lawyer.
AUSA: Mr. Hayah is on parole. We ask for a hold to allow Maryland to act. [That I-95 incident?] Defense: I'm trying to find out where Mr. Hayah could reside during this. Judge Meriweather: So, hearing Wednesday. 3 day control hold. AUSA: We may ask for 10 days
From the previously Maryland story: "Hayah has an alias of Le Mon Raetheon Williams. In Virginia court records for Criminal/Traffic Court in Richmond County, records show “Lemon” as Williams’s first name. His race was shown as “Black-Non-Hispanic”.
So Hayah / "Lemon" will be detained until he's heard on September 1, by DDC Magistrate Faruqui.
AUSA: Let's extend time, let me put it on Mr. Hayah's record. This is the largest criminal prosecution in US history, over 550 defendants, 14,000 hours of Capitol video
Judge Meriweather: That concludes this matter. Mr Hayah is remanded to the custody to the Marshals.
On Kenneth Harrelson on August 5, Inner City Press filed a letter and motion with Judge Mehta, on its DocumentCloud here.
On August 16, this: "Judge Mehta is in receipt of your email requesting access to the videos filed in United States v. Harrelson, No. 21-cr-28-10. Under Standing Order No. 21-28, in order for the court to grant Inner City Press access to the videos filed in Mr. Harrelson’s case, you will need to file an application for access pursuant to D.D.C. Local Criminal Rule 57.6."
That rule provides: "Any news organization or other interested person, other than a party or a subpoenaed witness, who seeks relief relating to any aspect of proceedings in a criminal case... shall file an application for such relief with the Court. The application shall include a statement of the applicant's interest in the matter as to which relief is sought, a statement of facts, and a specific prayer for relief."

Now on August 19, it's been granted (shouldn't have been necessary): "MINUTE ORDER as to KENNETH HARRELSON (10) granting Inner City Press's 343 Application for Access to Video Exhibits. The United States shall make available to Inner City Press the video exhibits entered into evidence during the detention hearing of KENNETH HARRELSON (10), consistent with the procedures set forth in Standing Order 21-28. Inner City Press is granted permission to record, copy, download, retransmit, and otherwise further publish these video exhibits. Signed by Judge Amit P. Mehta on 8/19/2021."

Similarly, Inner City Press asked DOJ and then Judge Timothy Kelly for access to the videos that DOJ had shown to the court in the case: judicial documents that, under case law, must be made available to the public. But it was denied access, on the theory that Judge Kelly's order earlier in the month limited access to these judicial documents to a particular sub-set of the public.
