Watkins: There was the much maligned muffin theft... But my client was helping law enforcement. We provided a video of this to the government. He was given permission by a high ranking member of the Capitol Police, an Inspector Inner City Press
Watkins: He traversed the Capitol with the officers, telling people to get out. He stood on the grassy circle, now just dirt, allowing selfies to be taking of him by others. He had the door held open for him by the officer Watkins: There was friendly interactions with law enforcement, both inside and outside of the Capitol. The police did not seek to seize the flag pole. It was donned as part of the shaman costume, if you will
Watkins: Nail clippers were being confiscated, but not the flag pole. The most probative issue that has come to light is the mental health issues and vulnerabilities found by the armed forces in 2006. I have confirmed the results will be forthcoming in short order
Watkins: We ask for pre-trial release. The government is going to argue he is a flight risk because he lives in a state adjacent to a border. But he's lives in Phoenix his whole life, only left the US with the military.
Watkins: If the court is concerned about Arizona, he could stay in a secure place in St. Louis near me. I could tell your Honor about it off the record. Judge Lamberth: I'm not sure anything is different now on risk of flight. What is the new information?
Watkins: I didn't know how long he'd lived in Phoenix, the grandfather there, the cousins and other relatives...I was not aware of the vulnerability issues
AUSA: Mr. Watkins has spoken for 20 minutes and has said nothing new. He pushed past the police, he entered through a window broken by Domenic Pezzola. He called the Vice President a "f*cking traitor."
Judge Lamberth: Could not using the interest keep him from raising money for travel? AUSA: It's unenforceable.
Watkins: They asked how Mr. Chansley got to DC for the MAGA-man march, then again for Jan 6. They know how: he drove in a car. The other put in money Watkins: Mr. Chansley got $500 from an individual we've named to the government. He had a limited visibility on those social platforms. They knew he is a man of simple means who is not someone who is navigating the Internet on a routine basis
Watkins: His family home doesn't have Internet service and hasn't for a protracted period. The Shaman, the guy with the horns, he is disinterested in politics. We're in a pandemic era. I don't have the defendant whispering in my already compromised ears
Watkins: The government has had the flag pole. They can see the thing on top wasn't affixed. So they are being disingenuous. It's appalling. He is not off the grid. He got a traffic ticket in Oklahoma and made sure it got taken care of.
Watkins: I am the least touchy-feely person in the world. (There is a laugh, perhaps by Judge Lamberth) But there are issues here. There are mental health vulnerabilities. We don't want him civilly committed. He's been in solitary confinement for 150 days
