SDNY COURTHOUSE, May 18 – A beer and wine distributor has sued an employee of Southern Wine & Spirits and Canandaigua National Bank for misleading statements and concealment.
On March 5, U.S. District Court for the Southern District of New York Magistrate Judge Katharine H. Parker held a proceeding. Inner City Press covered it.
Judge Parker teed up issues, about foreclosure and ownership structure.
On April 15, Judge Parker held another proceeding, which Inner City Press again covered. Judge Parker ordered to parties to submit a proposed trial plan by April 30, including their availability for trial in the third quarter.
On May 18 District Judge Lewis A. Kaplan held a proceeding, and asked the parties to submit a joint letter on which of the remaining issues need, desire or merit a jury trial. Canandaigua National Bank, it emerges, is pushing for fees. But first, the issue of if there will be a jury, and on which issues. Judge Kaplan advised the parties to closely consider the 7th Amendment then added, I mean it.
