Belize Business Earl Ingarfield Got 30
Months Now US to Sept 15 on Supervision

Sept 9 รข Earl Ignarfield was
charged with securities fraud
in connection with the
acquisition of two Belize
international business
companies.
On November 24, 2021 U.S.
District Court for the
Southern District of New York
Judge Ronnie Abrams held a
proceeding. Inner City Press
covered it. There was
talk of producing discovery on
a hard drive, and the set-up
of a next status conference on
January 28, 2022. Counsel
asked in advance that it be
virtual. Judge Abrams said
that would depend on virtual
criminal proceedings still be
allowed. Why wouldn't they
be, as civil cases will going
forward? Has the Federal court
system, or SDNY, learned
nothing during the pandemic? Jump cut to April
4, 2023 in the run up to a
pre-trial conference,
Ingarfield through counsel has
argued that the prosecutors
have made it impossible to
know "the true scope of CW-1's
criminal conduct," and that
the prosecutors have not
heeded "the serious warnings
from the Nejad case." On April 6
Inner City Press went to the
final pre-trial conference.
Ingarfield's counsel argued
that all Giglio material is
Brady material; Judge Abrams
asked for the factual not
legal basis of the argument.
The trial, she said, would be
delayed but only slightly. The April
11 trial was canceled, and
time excluded to May 1. The US
Attorney's Office on Apri 7
put in a letter saying it does
not agree to "voluntarily seek
records from entities outside
the prosecution team," citing
"all FBI 302 reports regarding
CW-1's cooperation in the
Bandfield case." On April 27,
Judge Abrams denied motions
but moved back the trial date:
"Ingarfield's motions to
dismiss and to compel are
denied, but his motion to
continue trial is granted. As
the parties were previously
advised, given defense
counsel's availability and the
Court's own trial schedule,
this trial is hereby adjourned
to July 24, 2023. A final
pre-trial conference will be
held on July 20, 2023 at 2:30
p.m. The Clerk of Court is
respectfully directed to
terminate the motions pending
at docket numbers 82 and 87.

the case was reassigned to
Judge Jed S. Rakoff for trial.
On July 24 Judge Rakoff held a
proceeding. Inner City Press
was there. The defense said it
would seek to exclude emails
gotten from Yahoo, as "not
business records of Yahoo."
The prosecution said they
would simply authenticate them
before entry into evidence.
The trial was set for August
21, 2023. But on August 17
at 4 pm, Ingarfield appeared
before Judge Rakoff to plead
guilty to Count 1. Inner City
Press was there as Judge
Rakoff accepted the plea, and
said he would essentially
ignore the sentencing
guidelines. Inner City
Press has published the plea
agreements - guideline 63 to
78 months, but 60 month
statutory maximum - on Patreon
here. Sentencing was
set for December 18 at 4 pm. On December 8,
Ingarfield's lawyer filed a
memo asking for probation - or
a sentence of no longer than a
year and a day. On December 11
the US Attorney's Office wrote
it requesting five years. On December 18
Inner City Press went to the
sentencing. Judge Rakoff
cited, if only by analogy,
statutes of limitation and
said he was coming down
somewhere in the middle, at 30
months. The defendant
requested the camp in
Pensacola, Florida. Jump cut to
September 1, 2026 when Arizona
based defense counsel wrote in
asking for early termination
of supervised release. On September 9
Judge Rakoff ordered the US
and Probation to for their
response, if any, by September
