Bob Menendez Got 11 Years Now US Asks 7 on Nadine With Redacted BOP Health Letter

SDNY COURTHOUSE, Aug 26 – Amid reports of investigation against Sen. Robert Menendez for taking gold bars, Inner City Press' sources on September 21 it to expect on Friday, September 22 an appearance in Federal court in Manhattan by Menendez and his wife Nadine Arslanian, now facing trial alone. This scoop was true.

Early on April 10 Nadine Menendez' lawyer wrote in that the US Attorney's Office is opposing the introduction of evidence it allowed in Bob Menendez's trial, and other issues - letter on Patreon here

In the April 10 trial day, former US Attorney for the District of New Jersey Philip Sellinger testified about being recused from the Daibes case and then Bob Menendez skipping his investiture in Trenton. Thread.

On April 17 after the Government's closing Nadine's lawyer Coburn took a different approach in reasonable doubt-land, saying there was no quid pro quo with Grewal and citing and even pantomiming Uribe's small bell. Thread.

On April 21 Nadine Menendez was found guilty; sentencing was set for June 12 with her lawyer implying he will be asking for delay, presumably on health grounds.

On May 7 her lawyer wrote in asking to push sentencing to September 11, saying "I had hoped to have detailed information this week from one of these professionals, but he is out of the country and" - letter on Patreon here

On April 22 Bob Menendez wrote in asking for a ruling on his motion for bail pending appeal- filing on Patreon here.

On May 9, Judge Stein gave Bob Menendez 11 final days: "as to Robert Menendez. IT IS HEREBY ORDERED that that defendant's request to adjourn his surrender date to the Bureau of Prisons from June 6 to June 17 is granted. No further adjournments will be granted. SO ORDERED: (Signed by Judge Sidney H. Stein on 5/9/2025)."

On June 11, the Second Circuit denied, with Judge Nathan disagreeing: "ORDER of USCA (Certified Copy) as to Robert Menendez re: [753] Notice of Appeal. USCA Case Number 25-0296. Defendant-Appellant Robert Menendez moves for bail pending appeal pursuant to Federal Rule of Appellate Procedure 9(b). The government opposes the motion. Upon due consideration, it is hereby ORDERED that the motion is DENIED. Judge Nathan would grant the motion. Catherine O'Hagan Wolfe, Clerk USCA for the Second Circuit, Clerk USCA. Certified: 6/11/2025."

On July 2, the US Attorney's Office docketed its 100 page opposition to Nadine Menenedez' bid for a new trial - along with a January 2025 list of possible witnesses it gave her lawyer, including the Federal Reserve's Joseph Catania.

On July 15, Judge Stein docketed his denial of Nadine Menendez' sealed bid for sentencing delay past September 11: "On May 16 the Court wrote "there will be no further adjournments." (ECF Doc. No. 858.) On July 14 the defendant in a sealed letter request sought an additional adjournment of sentencing; the government opposed her request. IT IS HEREBY ORDERED that defendant's request for an adjournment of sentencing is denied. The sentencing shall take place on September 11 at 10:00 a.m. (Signed by Judge Sidney H. On July 18 Judge Stein responded to Coburn's motion to withdraw: "ORDER as to Nadine Menendez: The Court is in receipt of Barry Coburn' s motion for leave to withdraw as counsel on behalf of himself, Sarah Schwietz, Marc Eisenstein, and their law firm Coburn & Greenbaum PLLC, dated July 18, 2025. (ECF No. 878.) Local Criminal Rule 1.l(b) applies Local Civil Rule 1.4(b) to attorney withdrawals. Rule 1.4(b) provides in relevant part as follows: [A]n attorney who has appeared for a party may be relieved or displaced only by order of the court. Such an order may be issued following the filing of a motion to withdraw, and only upon a showing by affidavit or otherwise of satisfactory reasons for withdrawal or displacement and the posture of the case, and whether or not the attorney is asserting a retaining or charging lien.... All motions to withdraw must be served upon the client and (unless excused by the court) upon all other parties. Proof of such service upon the client shall be filed on the docket in each case where withdrawal is sought. Local Civil Rule l.4(b). Mr. Coburn is directed to file the required affidavit by 12:00 p.m. on Monday, July 21, 2025. (Signed by Judge Sidney H. Stein on 7/18/2025."

On July 21 the US opposes Nadine Menendez' seal request for more delay; on the record they said it is partially based on a professor being in Spain.

On July 25, after three letters from Coburn including on IOLTA funds he said were raised by new counsel, Judge Stein let him out of the case.

On July 31 in a 51 page order Judge Stein denied Nadine Menendez' motions for acquittal or a new trial."

On August 22 Nadine Menendez' new counsel, formerly of SDNY, wrote in asking for a year and a day (to allow for "good time" credit), citing domestic abuse, in page after page redacted.

On August 26 the US Attorney's Office wrote in asking for 84 months or seven years on Nadine Menendez, annxed a letter about health care from BOP, also redacted: "I am aware of Ms. Menendez’s medical conditions as delineated in the sentencing letter from defense counsel and its exhibits. The records indicate Ms. Menendez suffers, or has recently suffered, from [REDACTED] The BOP has implemented a medical care level classification system- 6 page letter on Patreon here.
