On Mashinsky Feb 15 Conflict Hearing Set After His Lawyers Appear for SBF Sentencing

SDNY COURTHOUSE, Feb 8 – On Mashinsky Feb 15 Conflict Hearing Set After His Lawyers Appear for SBF SentencingAfter Alexander Mashinsky of Celsius was arrested on July 13, US Attorney Damian Williams held a press conference, and Inner City Press asked him to explain his  thinking in agreeing to release on bail for Sam Bankman-Fried but demanding and obtaining the ongoing pre-trial detention of Avi Eisenberg and Miles Guo.  

 US Attorney Williams responded that every case is different. Inner City Press asked if his office would be seeking the detention of, or agreeing to release, Mashinsky. He declined to say either way, saying you will soon see.

At 2:45 pm the arraignment began, followed the the SDNY AUSAs' deal that Mashinsky would be released right after on bond. Inner City Press was there.

After 8 pm on January 12, 2024, Mashinsky's lawyers filed his motion to dismiss Counts 2 and 6, and to strike all references to Celsius' bankruptcy.

On February 8, Judge Koetlt set a conflict or Curcio hearing, after Mashinsky's lawyer went to also work with Sam Bankman-Fried on his sentencing: "ORDER as to Alexander Mashinsky. The Court will hold a Curcio Hearing regarding the defendant, Alexander Mashinsky, on Thursday, February 15, 2024, at 11:30am. The Criminal Justice Act attorney receiving cases on Thursday, February 15, 2024, is directed to be present for the hearing. (Signed by Judge John G. Koeltl on 2/8/2024)
