In MLM Case Against Trump ACN Seeks Delay To Seal Exhibits After Class Cert Denied

SDNY COURTHOUSE, Feb 19  – In 2018 the lawyer who in 2023 represented E. Jean Carroll at trial against Donald J. Trump filed a civil damages suit, with four unnamed plaintiffs, against Trump and his children for their promotion of "a company called ACN, a multi-level marketing company

  On May 19, 2023, U.S. District Court for the Southern District of New York Judge Lorna G. Schofield signed an order releasing from the case Eric Trump, Ivanka Trump and Donald J. Trump, Jr..

On June 22, Magistrate Judge Sarah L. Cave held a proceeding on the plaintiffs' request for depositions. Inner City Press covered it, thread here

On October 19, Judge Schofield ruled among other things: "Plaintiffs offer four questions common to the class -- whether Trump’s statements were false or misleading, whether those statements constituted fraud or misrepresentation or violated statutory law, whether Trump’s conduct injured class members and whether Defendants can be held liable for any class members’ financial loss as a result of participating as an ACN IBO. Plaintiffs have not established that these putative common issues predominate over individual issues."

On February 19, 2024 - Presidents' Day - ACN requested more time to try to justify sealing or redacting the "Brinckerhoff Exhibits and the Merriman Deposition." Inner City Press remains on the case(s).
