In Jan 6 Case Defendant Foy Asks To Leave Home To Work As Mechanic But Barely Granted By Judge Chutkan

FEDERAL COURT, Oct 22 -- On October 22, months after the DC Circuit's decision in US v. Munchel, DDC Judge Tanya S. Chutkan had before her Capitol breach defendant Michael Joseph Foy who wanted to be able, pre-trial, to leave home to work.  Inner City Press live tweeted it here

OK - now Jan 6 case of US v. Michael Joseph Foy, he wants to loosen his conditions of pre-trial release to allow leaving home for work as a mechanic. US is opposing.

 DDC Judge Chutkan: One of the things that concerns me is that he should be allowed to resume his life while facing such serious charges. He joined a mob and tried to stop the peaceful transfer of power. You don't accept the rule of law.

Judge Chutkan: Does he have GPS monitoring? A: Yes. Judge Chutkan: For what can he leave the home? A: Only for lawyer meetings or medical emergencies.

Judge Chutkan: Why can't I just add church and seeking employment?

 Judge Chutkan: What time is church?

Foy: 11. 

Judge Chutkan: What time is it over?

Foy: 12.

Judge Chutkan (laughs) I thought church takes longer than that. Can't you apply to be an mechanic online?

Defense lawyer: They want an in-person interview

Judge Chutkan: I'm not ready to go to 9 to 5 yet. Here's what I'm going to do: home detention but only allowed to leave home for scheduled job interviews, info to pre-trial services, also church on Sunday, 10:30 to 1. Other than that, in the home.

 Defense: Thank you, Your Honor. And if he gets a job offer, can he start in a week?

Judge Chutkan: You have to file a motion. Voice: Isn't that up to pre-trial? Judge Chutkan: I want to know where he will be working. This is a serious crime.


Judge Chutkan: Next status January 5 at 10 am.

AUSA: I think he'll have it resolved by then [meaning, guilty plea]. Adjourned

And on October 23, this: "MINUTE ORDER: GRANTING 52 Motion to Modify Conditions of Release. Defendants Conditions of Release are altered from Home Incarceration to Home Detention. Defendant may leave the home only to attend (1) religious services from 10:30 AM to 1:00 PM Eastern Time on Sundays and (2) pre-scheduled job interviews, with appropriate notice to Pre-Trial Services. If Defendant obtains a job, the conditions of his release may be further altered upon his Motion and verification by Pre-Trial Services. Signed by Judge Tanya S. Chutkan on 10/22/2021. (zjch, )"
