After January 6 Pushing Capitol Police Matthew Council in Court in DC Insurrection Blues

FEDERAL COURT, Jan 21 – Matthew Council, charged with on January 6 having "pushed a uniformed officer of the United States Capitol Police [and] was subsequently pepper sprayed by one or more other law enforcement officers," appeared on January 21 before U.S. District Court for the District of Columbia Magistrate Judge G. Michael Harvey.

Council is 49 years old. He was arrested in the Middle District of Florida on Jan 14.  US says "prior to being advised of his Miranda rights, COUNCIL spontaneously expressed remorse about pushing the officer and indicated that he did not intend to injure her."

 Judge Harvey: Are you paid more than $75,000 a year? Council: No. Judge Harvey: How much do you have in the bank? Council: Uh, like $160. Judge Harvey: You are eligible for appointed counsel.

 Judge Harvey: Is the US seeking detention?

AUSA: No. We request stay away from DC, call Pre-Trial once a week, no illegal firearms. No use of drugs including marijuana, submit to mental health evaluation. Courtesy supervision.

Pre-Trial told Judge Harvey they have a memo with more detail about the drug testing and mental health evaluation [proposed] conditions. Judge Harvey has stepped away to read it.

 Judge Harvey is back: "I have read the report from the Middle District of Florida... I understand why you have made the request... Mr. Council, you are to stay away from DC. Notify pre-trial of any travel outside of Florida. Psychiatric evaluation.

Council: I'm allowed to use the medical marijuana then?

AUSA: The Government is ok with anything prescribed by a medical professional. Council: yeah, it is, I don't know if it had anything to do with the Judge in Florida...

Pre-Trial: Show the prescription.

 Judge Harvey: Mr. Council, next conference will be Feb 11 at 11 am, you will Zoom in. Parties are excused.
