SDNY COURTHOUSE, Aug 7 – A California businessman sentenced to 66 months in a criminal case before U.S. District Court for the Southern District of New York Judge Loretta A. Preska followed up by filing a $1 million, then $10 million, defamation suit about Press reporting of a proceeding in which his remand to jail was debated.
Because the transcript of that proceeding, held in open court, had been sealed in full, Judge Preska was asked to unseal, which she granted in large part, ruling that "the Conference was open to the public and the press... that warrants the filing of the transcript of the Conference on the public docket."
The transcript was filed in an Anti-SLAPP motion to strike. On August 7, Central District of California Judge Mark C. Scarsi granted the anti-SLAPP motion, noting that "the Court doubts Plaintiff could cure his claims" and setting a schedule to move for attorney's fees as provided for in anti-SLAPP law.
