NY Adult Survivors Act Cited in 70s Case As SDNY Judge Urges Sides to Stand Down

SDNY COURTHOUSE, Feb 23 – A hundred sexual encounters between 1974 and 1978 have given rise to claims and counter-claims under the New York Adult Survivors Act, giving rise to a court proceeding on February 22, 2023 before U.S. District Court for the Southern District of New York Judge Lorna G. Schofield. Inner City Press covered it.  

 Victor Niederhoffer, an investor profiled in The New Yorker and elsewhere, preemptive sued in SDNY to stop Louis from suing him in state court.

On February 22, his counsel said if Ms. Louis refiles her counterclaim in state court, Niederhoffer will immediately move to remand, since he lives in Connecticut.

   Niederhoffer attached an email that Louis sent him, and says it proves the sexual encounters were voluntary. It says more.

Judge Schofield patiently read out the NYS statute, then suggested that both sides drop their claims. We will be watching the docket.
