Wells Fargo Is Sued For Not Paying Minimum Wage And Is Told Summary Judgment Unlikely

SDNY COURTHOUSE, August 24 – Thomas Lau sued Wells Fargo to recover overtime compensation, minimum wages and attorney's fees.

 On August 23, 2022 U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer held a proceeding. Inner City Press covered it. 

Wells Fargo had indication it wanted to move for summary judgment. Judge Engelmayer inquired into factual disputes, including when employees were told about Wells' overtime policies.  

  He said it looked unlikely that a summary judgment motion could succeed, but gave Wells Fargo's outside counsel until August 31 to confer with his client then file a letter if he will, in fact, move for summary judgment.

If not, a Pre Trial Order is due by October 18.

The case is Lau v. Wells Fargo & Company et al., 20-cv-3870 (Engelmayer)
