SDNY MAG COURT EXCLUSIVE, August 18 - In the U.S. District Court for the Southern District of New York on August 18, a detention or release proceeding was held by Magistrate Judge Barbara C. Moses on a defendant subject to a so-called "no bond warrant" from Southern District of Florida Magistrate Judge Lauren Fleischer Louis.
The defendant, Ms. Shamel Alvarado, is only 19 years old. She is charged with stealing two iPhones worth $3500. But while out on bond, she was not where she told her pre-trial services officer that she would be. She returned to The Bronx after 4 am, after being in Chelsea and Yonkers.
While Federal Defender Chris Flood argued that there is no such thing as a "no bond warrant," and that Judge Moses could and should release Alvarado on conditions, AUSA Amanda Weingarten said she would focus on the merits. She listed a string of violations.
Judge Moses said she did not have to yet to the interesting academic question of if she could release Alvarado, because even if she could, she would not, given the record. She did, however, order the Marshals to return Alvarado to Florida - for, strangely, an August 25 trial - "forthwith."
The SDNY case was said to be US v. Alvarado, 22-mj-6806 (Moses).
