Mashinsky of Celsius Waives SBF Lawyer Conflict and Has Trial Pushed Back to Jan 2025

SDNY COURTHOUSE, Feb 20 – On Mashinsky Feb 15 Conflict Hearing Set After His Lawyers Appear for SBF SentencingAfter Alexander Mashinsky of Celsius was arrested on July 13, US Attorney Damian Williams held a press conference, and Inner City Press asked him to explain his  thinking in agreeing to release on bail for Sam Bankman-Fried but demanding and obtaining the ongoing pre-trial detention of Avi Eisenberg and Miles Guo.  

 US Attorney Williams responded that every case is different. Inner City Press asked if his office would be seeking the detention of, or agreeing to release, Mashinsky. He declined to say either way, saying you will soon see.

At 2:45 pm the arraignment began, followed the the SDNY AUSAs' deal that Mashinsky would be released right after on bond. Inner City Press was there.

On February 8, Judge Koetlt set a conflict or Curcio hearing, after Mashinsky's lawyer went to also work with Sam Bankman-Fried on his sentencing.

Judge: Mr Mashinsky, you have a right to a lawyer without conflicts of interest - they represent SBF

Judge: Celsius may claim to be a victim of Alameda Research, but your lawyers can't use the documents. Do you understand?

Mashinsky: This is my first time in a court. I am not an expert in this space... I am spending money to prove my innocence...

 Mashinsky: I assume SBF's sentencing will be completed before my trial. But we cannot know.

Judge: You waive the conflict?

Mashinsky: I do. Judge: Is your other lawyer here? Mashinsky: No. Judge: I will adjourn...

 In US v Mashinsky, they're back. Mukasey: He signed a waiver. Then he spoke with a lawyer at the Moscou firm... The CJA lawyer on duty today is here. Judge: Consult with him, then I'll hear from him. Later today

Then: "Court determines that conflict is waivable. Trial for deft Mashinsky adjourned to 1/28/2025 at 9:00am."
