As Andrew Cuomo Sued for Sexual Harassment by Bennett Discovery Disputes Debated

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Oct 1 –   In the sexual harassment case of Charlotte Bennett against Andrew Cuomo a discovery conference was held on October 1 before U.S. District Court for the Southern District of New York Magistrate Judge Sarah L. Cave. Inner City Press live tweeted it - thread:

Counsel: We're talking 4000 text messages. Proportionality is the gold standard in determining discovery. Anything additional would be of only marginal value. Yes, one of the photos was redacted...   Judge: I thought there were more redactions.

Counsel: We have not seen black-box redactions. As a matter of law, text message chains are a single document. We have a protective order here - there is no burden in producing them. We've only gotten 400 of 4000 pages

Melissa DeRosa's counsel Sulkowski: The omission of pages of a text chain is a redaction - Judge: That is not a good argument, Ms. Sulkowski. But we do need to ask Ms. [Lillia] McEnaney to produce the videos. McEnaney's lawyer: We have to watch each video

Judge: I regret it's a burden, but it has to be done. Can you complete review and production by the end of the month? McEnaney's lawyer: No. She has a full time job. There are 100s of videos. And I am the managing partner of a small law firm.

Judge: I'm going to give her a month to do it. October 31. If you end of needing more, you can apply to me. McEnaney's lawyer: I hope the product is worth the emotional distress my client will feel. She had a panic attack. Judge: I regret it. But you must produce

Charlotte Bennett's lawyer: The defendants have delayed, they have made us pay for all the re-imaging of the multiple iPhones. We have spend 100s of lawyer hours going through the materials and videos. We want this to move forward. The defendants want to delay...Cuomo's lawyer: Ms. Bennett knew she would have to produce discovery. It is not just a technical problem. We want to correct the public record why we have had to expend resources - it is NOT because we are weaponizing the judicial system, that impugns our client

Cuomo's lawyer: We want to depose Ms. Bennett before the end of the year - and for that, she will have to complete discovery production by the end of October. This is frustrating. Judge: I understand. By the end of October.  Bennett's lawyer: We have worked hard

Judge: No one has explicitly asked for an extension of discovery and I'm not giving one out. We don't need to have every document in order to do the depositions. Let's calendar them. DeRosa's lawyer: Plaintiff's counsel is interfering- Bennett's lawyer: We object

Judge: You have to get through this case together. Be nice. I know the parties despise each other Cuomo's lawyer: We remain concerned about plaintiff's counsel's statements to the press. I am not specifically seeking a gag order but I want to raise it as an issue

Cuomo's lawyer: It's an attempt to prejudice our client. Judge: No relief is being sought. We are adjourned. Inner City Press will continue to cover the cases- The case is Bennett v. Cuomo, et al., 1:22-cv-07846 (Broderick / Cave)

Swiss Take Over UNSC No UNRWA Answers Nor On Indictment Re Corruption by UN

by Matthew Russell Lee, Patreon Book Substack

UN GATE, Oct 1 – Switzerland took over the UN Security Council presidency on October 1, 2024 - while Inner City Press is still banned from the UN, despite its June 19 application.

On September 30, Inner City Press wrote to the Swiss Mission: "This is a timely request that you allow Inner City Press to enter and cover, and/or provide the WebEx  pass code(s) to access to Switzerland's UNSC Presidency press briefing by your  Ambassador Pascale Christine Baeriswyl on October 1, 2024 at 12:30 pm. I have questions to ask on what you will do this month about Iran, Gaza and Sudan, Ukraine, DRC and Rwanda, about the SDNY indictment involving Turkey's Mission to the UN

as well as the coups in Gabon and Niger and the conflicts in Ukraine, Ethiopia, Cameroon, Yemen and Libya -  and on ongoing cases of sexual abuse and exploitation by UN peacekeepers, and Missions' abuses in NYC, on many of which Inner City Press first reported

Inner City Press also asked, in writing, about that "a majority of Switzerland’s parliament voted to suspend payments to UNRWA" - nothing.

Please note that Inner City Press and I participate in the WebEx briefings of, for example, the IMF: March 31, 2022 and since with new IMF spokesperson Sept 28, 2023:

Switzerland did not answer, even its "spokesperson" Pierre Gobet.

 Watch this site.

Inner City Press on June 19, 2024 again applied to the UN for access, as it gives 100s, to cover the UNGA week. Inner City Press has a NYC Press Pass and writes about the UN. From Sierra Leone and its UN Mission, nothing.

Watch this site.

In FTC Bid to Stop Handbag Merger of Capri & Tapestry Defense Trashes FTC Expert in Closing

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Sept 30 – At Day 7 of the hearing on the US Federal Trade Commission's bid to enjoin the merger of Tapestry and Capri started up before U.S. District Court for the Southern District of New York Judge Jennifer L. Rochon, Inner City Press was there, from the thread here, more on X for Subscribers here and Substack here

OK - now in last day of FTC v Tapestry preliminary injunction hearing, Tapestry witness is trashing FTC expert Dr Smith's analysis, we're on it to Judge Rochon's decision and beyond

Now in last day of preliminary injunction hearing, Judge Rochan asks what an acquisition by Tapestry could do for Michael Kors brand that Capri has been unable to do

Defense testimony continues, about how attempts by Capri to have the Michael Kors brand recapture "brand heat" just haven't worked. Judge: How would acquisition by Tapestry do for Michael Kors what Capri can't? Witness: Great question.

Judge: I try.

On Septmeber 23, Judge Rochon ordered: "The Court previously ordered all transcripts for the preliminary injunction hearing, which took place from September 9 through September 17, to be filed temporarily under seal. The Court now orders that the transcripts from the hearing are to be UNSEALED, with the exception of the following lines, which are to be REDACTED in the public versions of the transcripts and maintained under seal: As further set forth in this Order. The lines that the Court has ordered must remain under seal contain either confidential information of third-parties and commercially sensitive information or references to certain witness's private health information (which is not at issue in this case), thereby overcoming any presumption of public access. SO ORDERED (Signed by Judge Jennifer L. Rochon on 9/23/2024) Full order on Patreon here.

Inner City Press live tweeted closings, in which the defense focused on trashing the FTC's expert, on X for Subscribers here - and then:

FTC lawyer: We don't dispute there is competition. But is there competition which constrains participants in the market? They say we should define the market by product. But Tapestry's CEO said, Brand matters. Dr Smith's surveys ask the right questions...

FTC lawyer: Doctor Smith conservatively looked at 200 brands... They dominate the market. Thank you. Judge: How do you address defendants' argument that Doctor Smith's model always turns out the same? FTC lawyer: We don't want to ignore the market reality.

Judge: Anything further? No. I will take the matter under advisement.

Darden on Trial For Conning NBA Dwight Howard on Buying WNBA Dream as Creditor

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Sept 30 – Calvin Darden Jr. is on trial for defrauding NBA player Dwight Howard to convince him he was buying the WNBA team the Atlanta Dream. Inner City Press is covering the trial. September 30 thread:

AUSA: Did you ever meet directly with Calvin Darden?

Witness Schmidt: No, but those are my text messages about sales agreements under 10 (b) 5 (1), and Calvin Darden's Fidelity statement

AUSA: What is this?

Schmidt: A Wells Fargo statement labeled Calvin Darden.

AUSA: Did Dwight Howard pursue the investment?

Schmidt: Yes, this is the wire transfer of my client Dwight David Howard II for the marketing company related to the WNBA's Atlanta Dream

AUSA: Was Mr. Howard's line of credit increased to $10 million?

Schmidt: Yes. Here he wired to Legacy AC LLC to try to close on the purchase of the Atlanta Dream. But we learned Dwight could not own the Dream while an active NBA player - so he was to be a creditor
