Mahmoud Khalil Filed Habeas Corpus in SDNY Now Files FOIA Case Against DOJ for Records

SDNY COURTHOUSE, Nov 20 – As Mahmoud Khalil was sent to the ICE detention facility in Elizabeth, NJ - and then it seems to Louisiana - his lawyer filed a habeas corpus petition in the U.S. District Court for the Southern District of New York. It was not viewable on PACER but it was, at terminals in the courthouse itself. On Bluesky here, Threads here (later, on X - but see below)

  On March 10 it was assigned to Judge Jesse M. Furman who ordered: "a joint letter, no later than March 11, 2025, at 5:00 p.m., indicating whether the conference is necessary and addressing how the Court should handle the present Petition."

The letter was filed just before 7 pm, noting the US Attorney's Office's assertion is disputes on jurisdiction and possibility transferring the case, but still asking for the conference on March 12 on these issues. Letter on X - but now since November 17 Inner City Press is blocked from its X account, with no help from X Support.

On November 20, Khalil represented by CCR filed a FOIA lawsuit against DOJ for records requested on May 29. DOJ denied expedited processing, then administratively closed it as "overly broad." No response to appeal. Hence the suit, which Inner City Press (which often uses FOIA, with the Federal Reserve, OCC and others) will cover. The 25 page complaint is on Patreon here
