Seaman Sues Port Imperial Ferry For Bad Steps CFR Applicability to Hudson River Mulled

SDNY COURTHOUSE, July 17 –   Seaman Kenneth M. Keane has sued Port Imperial Ferry Corp. d/b/a NY Waterway for injury suffered on the M/V Patriot II due, he says, to a dangerous, defective and broken set of portable steps.

   A trial is set to begin on July 24, 2023. On July 17, the final pre-trial conference was held before U.S. District Court for the Southern District of New York Judge Jennifer L. Rochon. Inner City Press went to cover it. 

 Among other issues was the defendant's challenge to Keane proposed expert. Judge Rochon noted his credentials and that if he testifies, questions can be raised. Reference was made to OSHA and to 19 CFR 1915.17(a)(1).

Earlier there were questions of applicability given that the M/V Patriot II "operated exclusively on the Hudson River and not 'coastwide.'" 

 The case is Keane v. Port Imperial Ferry Corp d/b/a NY Waterway, 22-cv-2484 (Rochon)
