Gets It Vacated so Files Habeas

April 24 รขA man from El
Salvador now in ICE detention
in Orange County Correctional
Facility filed a habeas corpus
petition in the U.S. District
Court for the Southern
District of New York, where
Inner City Press found
it. The
petition says while he pled
guilty to sexual abuse of a
person under 14 years of age
he had not been advised of the
immigration consequences. In
Nassau County Judge Robert A.
McDonald, citing SDNY Judge
Rakoff's book, vacated the
conviction. His order is
attached to the habeau
petition. Judge J.
Paul Oetken to whom the case
was assigned has ordered a
response by April 30, and a
May 6 hearing. The case is
Calderon v. Arteta,
1:26-cv-3399 (Oetken)
