SDNY COURTHOUSE, Oct 21 – A man up for sentencing after arrest for distributing CSAM of prepubescent boys had his sentencing memo heavily redacted by the Assistant US Attorney - and his Federal Defender's memo not even in the docket. Inner City Press went to the sentencing.
The Federal Defender emphasized that his client had cooperated. The AUSA concurred, and said, If you were to give a time served sentence.
But Judge Castel recounted a prior conviction in Michigan, and details about the materials distributed. He imposed a sentence of 84 months.
The Federal Defender asked that the transcript be sealed - and the Assistant US Attorney agreed. Inner City Press was there, and is publishing this report.
Voluntarily, we are not here including the name or docket number.
But something is wrong, including with sentencing memos not even in the docket, with no filing requesting or permitting that.
