In DOJ Live Nation Antitrust Suit SeatGeek Info Not to In House Counsel as Discovery Dates Set

SDNY COURTHOUSE, July 29 – In the lawsuit by the US Department of Justice and 30 states against Live Nation Entertainment and Ticketmaster, on July 29 U.S. District Court for the Southern District of New York Judge Arun Subramanian held a conference on the proposed protective order, and discovery timelines. Inner City Press live tweeted it, thread:

Judge Subramanian: I have received the parties proposed protective order, and filings by other including SeatGeek... Where are we in discovery?

DOJ: We will product discovery promptly under execution of the protective order. Third party subpoenas in mid-August 

Judge Subramian: I propose to move the paragraph on highly confidential information, and to limit it to outside counsel. Views? SeatGeek's lawyer: That's fine.

AEG [Anshultz Entertainment Group] lawyer: Fine by us. 

Outside defense counsel: We will need in-house lawyers Daniel Wall and Kimberly Tobias to have access to the information. They can compartmentalize it. Mr. Wall has 40 years of experience in this.

Judge Subramanian: They'd only be barred from highly confidential information Judge Subramanian: I'm going to keep it my way, even if it makes more work for me. Live Nations' lawyer: Can our motions be ex parte?

Judge Subramanian: I don't see why they should be, they would not involve work product. DOJ: We'd like a fixed day for them to respond to discovery requests. Judge: Mr. Marriott, what's the issue with that?

Live Nation's Cravath lawyer: That's not workable, 60 days. Judge:  How about a hearing in mid September? You propose the dates  Judge: Anything else? Counsel:

No. Judge: I'll get the protective order out today. We are adjourned.
