Woman Was Arrested On Puerto Rico Warrant But Released RoR in SDNY As No Affidavit

SDNY MAG COURT EXCLUSIVE, August 10 -  In the U.S. District Court for the Southern District of New York on August 10, a presentment proceeding was held by Magistrate Judge Robert W. Lehrburger on a woman, referred to as Francisca Paredes, who had been arrested on a warrant from a 1996 Federal case in Puerto Rico.

There was a problem, however. There was not affidavit alleged that she was the person sought. After a time a solution was arrived at. The woman would be released on her own recognizance -- rare in SDNY -- with no bond or conditions.

   The Federal Defender asked for the warrant she was arrested on to be dismissed or modified. Judge Lehrburger said no, who knows, she might still get arrested if an affidavit is produced. She was released.

The case in Puerto Rico is US v. Olivares et al., 96-cr-251 (District of Puerto Rico)
