SDNY COURTHOUSE, Sept 19 – British billionaire Joseph Lewis, owner of the Tottenham Football Club, Tavistock, jets and yacht, was indicted and released on bail on securities fraud charges on July 26, 2023. Inner City Press was there and live tweeted, thread here.

On August 28, the assigned District Judge issued this: "counsel for Defendants Patrick OConnor and Bryan Marty Waugh alerted the Court to benefactor payments that could give rise to potential conflicts of interest. To that end, by September 6, 2023, counsel for Defendants OConnor and Waugh shall submit a joint letter further describing the payment arrangements at issue here (Signed by Judge Jessica G. L. On September 6 counsel to Marty Waugh wrote in to say that yes, Lewis' Tavistock is paying them - but they promise to exercise independent professional judgment...
On September 19 Judge Clarke set a Curcio hearing for October 2: "A Curcio hearing is scheduled for October 2, 2023 at 11:00 a.m. in Courtroom 20C at 500 Pearl Street, New York, New York. Counsel for Mr. O'Connor and Mr. Waugh are directed to assist Mr. O'Connor and Mr. Waugh in consulting with conflict counsel prior to the hearing, and that counsel shall also appear at the hearing. The Government asked the Court to confirm that conflict counsel will not be "paid directly or indirectly by Joseph Lewis, Tavistock Group or any other third party." ECF No. 40 at 3, n.1. Conflict counsel shall not be paid directly or indirectly by Joseph Lewis and Tavistock Group. To the extent the fees are paid by "any other third party," counsel for Mr. OConnor and Mr. Waugh shall confer with the Government regarding this issue, and if there is a dispute about whether conflict counsel is appropriate based on the source of conflict counsels fees, the parties shall file a joint letter with the Court by September 26, 2023 setting out the parties' positions.
