After Assault of Officer in MDC Bklyn Burke Incommunicado in Philly BOP, Contempt Looms

EDNY COURTHOUSE, September 1 – A prisoner who allegedly assaulted a Corrections Officer in Brooklyn's Metropolitan Detention Center was not produced on September 1 by the US Bureau of Prisons. The judge said he must be, next week, or she'd hold the BOP facility in contempt of court.          U.S. District Court for the Eastern District of New York Chief Judge Margo K. Brodie held the proceeding. Inner City Press, now covering the EDNY, live tweeted it here:

 Now EDNY case of US v. Destin Burks - he is in the SHU [Special Housing Unit] after allegedly assaulting a Corrections Officer.

They have not produced him; Marshals refuse to transport him, outside contractor only. After Burks allegedly assault a Corrections Officer in MDC Brooklyn, BOP moved him to FDC Philadelphia. But Marshall will not transport him to Cadman Plaza.

Initial cases were gun use on Staten Island. He's written a letter to the judge... 

They are discussing Burks, without him present.

Although Burke's letter was addressed to EDNY Judge Allyne Ross, this proceeding is overseen by EDNY Chief Judge Margo Brodie. She is ordering BOP to produce Burke on Sept 8 at 10 am or she will hold the facility in contempt
