FEDERAL COURT, Sept 9 -- On June 24, months after the DC Circuit's decision in US v. Munchel, DDC Judge Amit P. Mehta held a bond / detention hearing on defendant Peter Schwarz. Inner City Press live tweeted it, here and below.

Judge Mehta: Does Mr. Schwartz want to have Mr. Pierce continue as his lawyer? Interim counsel: Last week he was prepared to wait for Mr. Pierce - and he asserts his right to a speedy trial. Judge Mehta: Is that correct?
Schwartz: I would like Mr. Pierce only.
AUSA: There's going to be a separate platform for video. Mr. Schwartz was on the Lower West Terrace, the video is going to be of interest to him. It'll be in 2 to 4 weeks on a rolling basis. This is Mr. Pierce's first appearance in this case.
Judge Mehta: Next proceeding November 5 - and it will be virtual. Mr. Pierce, do you consent to virtual? Pierce: Yes. Adjourned.
Schwartz is at the DC Jail compound, essentially in solitary confinement, his lawyer says. "Discovery is massive, mostly video, not written - he need to be out to review it," the argument is.
[Inner City Press' argument is that these videos should be fully public. Court says ask Office of the US Attorney for DC, whose media inquiries line just rings and rings, not even a voicemail. Now have emails in, after filing with DDC judge here
AUSA says this is a crime of violence, citing a still unpublished decision. Judge Mehta says he'll look for it on the Court's website. AUSA says she'll email the judge and opposing counsel. Will it be docketed? Talk turns to pepper spray.
AUSA: Mr. Schwartz entered that tunnel with others. In the video, he hands off a canister to another rioter, to attack that police line. [OK - where is the video?]
AUSA: He said he was at war with the US. He texted his friends about throwing a chair at officers. Inner City Press @innercitypress · 47m AUSA: We haven't charged him with throwing a chair. But there's video... We haven't charged him with that, but we went looking for the video after we saw the text message. The decision in Munchel supports Mr. Schwartz' detention here.
AUSA: We have multiple videos of him attacking officers. We submitted them to the court. Judge Mehta: I didn't see him use the canister. AUSA: Exhibits 1 and 2. [Here's current CourtListener docket - these cited videos nowhere to be seen on it
Now the AUSA is playing the videos, for detention. But are they accessible to the public? So far, no. [Note: here SDNY , Inner City Press advocated for and won an order for exhibits to be put on *publicly accessible* website, here
AUSA: Mr. Schwartz has 16 prior convictions. One involves firearms. "He is a violent man... He is willing to use violence to achieve his ends." Says, maintain the detention.
Judge Mehta: Does the defense have anything to add? No? I'm going to look for the decision
Schwartz: Can I speak? Lawyer: No. I'm going to do the speaking. Can you put us in a breakout room? Granted. Feed will continue
Judge Mehta: Let's start with danger, that he will continue to engage in acts of violence to further his political views. But I think it's wider, violence period. The danger is not limited to politics, but assaultive behavior generally.
Judge Mehta: I will deny the motion. Mr. Schwartz will remain detained pending trial
